HUSTON, INTERIM CITY MANAGER & RDA EXECUTIVE DIRECTOR FROM: CHRISTINE SHINGLETON, ASSISTANT CITY MANAGER SUBJECT: PROPOSED REFERENDUM TO INVALIDATE AB 1X 27 SUMMARY Referendum 1494 has recently been filed with the California Secretary of State and proposes a vote to eliminate AB 27 (the "Alternative Voluntary Redevelopment Program" or "Opt-in Bill"). RECOMMENDATION It is recommended that the City Council take an action on the record to oppose Referendum 1494. FISCAL IMPACT Proposed Referendum 1494, if adopted, would have the effect of eliminating redevelopment agencies in California and require all assets and resources of such agencies to be conveyed to successor agencies pursuant to the provisions of AB 26. AB 27 has been currently stayed by the California Supreme Court and certain provisions of AB 26 have also been stayed (the City Council reviewed these specifics at their special meeting on August 24, 2011). BACKGROUND The California Secretary of State recently announced that a proposed referendum that affects the implementation of Voluntary Program under AB 27 was recently filed (Referendum No. is 1494 and Attorney General's Tracking Number is 11-0025). Referendum 1494 is proposed by a group called "California Alliance to Protect Private Property Owners". The Referendum proposes that Sections 1 2 and 3 of AB 27 be "vetoed" by the people. (See the attached documents filed with the Secretary of State.) Section 2 of AB 27 is Agenda Report Proposed Referendum to Invalidate AB 1X 27 Page 2 the key section that established the "Alternative Voluntary Redevelopment Program" after AB 26 de-authorized redevelopment agencies. In simple terms, the Referendum, if approved, would veto the Alternative Voluntary Redevelopment Program, and leave AB 26 in effect. Thus, if AB 26 survives its legal challenges and remains in effect, and if this Referendum is approved, the net effect would be to eliminate local redevelopment agencies and the alternative provided by AB 27 to revive them. To qualify a referendum for inclusion on the ballot, a referendum petition must be signed by at least five percent of the number of voters in the previous gubernatorial election. It is also known as a "petition referendum" or "people's veto". See In the case of Referendum 1494, this means that petitions must be signed by 504,760 registered voters, and those signatures must be filed with county elections officials within 90 days of the enactment of the bill. (AB 27 was enacted on June 29, 2011). As a result, the petition submission deadline is September 27, 2011. Staff has checked with the referendum's proponent, the California Alliance to Protect Property Rights group. They indicate that there is nothing else available in the way of information regarding the referendum and referred staff to the Secretary of State referendum summary available on the Secretary of State's website. In the meantime, sources at CRA and ACC-OC indicate the following: • They don't know at this point if the petitioners have enough funds to circulate the petition. Their sources tell them that no signature gathering firms have been contacted yet. • They believe that 504,760 signatures of registered voters would be almost impossible to obtain by September 27, 2011 and there is no statewide activity on this referendum that they are witnessing. As a result, they believe it is unlikely that the proponents will be successful in obtaining the required signatures to get this referendum an the ballot for November. Based on what we know now, the referendum should be watched fully opposed in any event.
