HUSTON, INTERIM CITY MANAGER FROM: CITY MANAGER'S OFFICE & PUBLIC WORKS DEPARTMENT SUBJECT: APPROVAL OF AMENDMENT NO. 4 TO CONSULTANT SERVICES AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES FOR TUSTIN LEGACY BACKBONE INFRASTRUCTURE BETWEEN THE CITY AND HUNSAKER & ASSOCIATES SUMMARY Approval is requested of Amendment No. 4 to a Consultant Services Agreement for Tustin Legacy backbone infrastructure between the City and Hunsaker & Associates to provide additional engineering services related to construction support for Tustin Ranch Road Phase 1 improvements. RECOMMENDATION It is recommended that the City Council: 1. Approve Amendment No. 4 to a Consultant Services Agreement for engineering construction support services for Tustin ranch Road Phase 1 improvements between the City and Hunsaker & Associates, increasing the not to exceed amount by $98,000 to $822,450, and authorize the City Manager and/or Assistant City Manager to execute the Amendment; and 2. Appropriate $98,000 from unappropriated funds in CFD 06-01 Fund (434} to the Tustin Ranch Road Extension Project Capital Improvement Program Fund (CIP No. 70100 and No. 7o20s}. FISCAL IMPACT The consulting services will be compensated on a time and material basis with a not to exceed budget of $98,000. The Scope of Services will require an appropriation fram unappropriated funds in the CFD 06-01 Fund (434} to cover the additional engineering services related to construction support for Tustin Ranch Road roadway improvements. DISCUSSION On September 7, 2010, a Consultant Services Agreement ("Agreement"} with Hunsaker & Associates to provide engineering services at Tustin Legacy related to the City's Disposition Strategy and Business Plan, aerial mapping, and improvements related to Tustin Ranch Road and Valencia Avenue. Subsequently, amendments to the Agreement were approved by the City Council as follows: Hunsaker & Associates Contract Amendment No. 4 September 6, 2011 Page 2 • On November 2, 2010, Amendment No. 1 to the Agreement was approved for engineering services related to preparation of a final tract map for conveyance purposes. • On February 1, 2011, Amendment No. 2 to the Agreement was approved for engineering services related to infrastructure design requirements for Tustin Ranch Road roadway improvements, Valencia Avenue traffic signal and sewer line modifications, and Park Avenue roadway, storm drain, water, and sewer improvements. • Qn May 3, 2011, Amendment No. 3 to the Agreement was approved for additional engineering services related to infrastructure and grading design requirements for Tustin Ranch Road roadway improvements and mapping services related to the City's Disposition Strategy and Business Plan. Subsequently, the a proposal was requested for additional engineering support services from Hunsaker & Associates related to construction support for Tustin Ranch Road Phase 1 improvements. Typically, these support services are provided by the Engineer of Record. Tasks included on-call attendance to field meetings, submittal review, shop drawing review and approval, response to Contractor request for information (RFIs), written certifications/verifications for certain completed items of work (i.e. line and grade}, validation of fix quantities, change order review and support, costing and record drawings. An itemized list of approved Tustin Legacy agreements for professional consulting services, including pending approvals, is attached for reference. Christine A. WHEREAS, City and Consultant entered into a Consultant Services Agreement on September 7, 2010, to provide consulting services to the City for engineering services for the Tustin Legacy Disposition Strategy and Business Plan; and WHEREAS, City requested certain additional engineering services related to construction support for Tustin Ranch Road roadway improvements; and WHEREAS, Hunsaker & Associates submitted an authorization request for additional engineering services dated August 18, 2011, attached hereto as Exhibit "A"; and THEREFORE, it is agreed that the Original Agreement be amended as follows to reflect the modifications requested by Hunsaker & Associates and authorized by the City of Tustin: 1. Modification of Compensation. Section 2 entitled "Compensation" is amended to provide additional engineering services as identified in Exhibit "A" of this Amendment No. 4 to be charged on an hourly rate up to a not to exceed additional compensation amount of $98,000. 2. General Requirements. Certifications and Verifications ................................................. $ 32,000 On completion of the construction work {or various phases thereof), H&A shall prepare written certifications signed by a licensed civil engineer verifying completion of the work in substantial compliance with the intent of the plans and specifications. H&A shall validate fixed quantities as work is complete. H&A shall attend a Final Quantity review meeting with City's Construction Manager. Following the meeting, H&A shall review the Final Quantity Summary addressing all items of work, inaluding change orders, and submit the Summary with a letter signed by a licensed civil engineer verifying the quantities to City's Construction Manager. 4. Record Drawings ...................................................................... $ 12,000 H&A shall compile documents provided by the City's Construction Manager affecting the final configuration of the work. These may include Contractor's as-built drawings, survey records, plan changes, change orders, and other contract documents. H&A shall produce the Record Drawings for the future reference of Gity and other Public Agencies. The Reeard Drawings shall be a full set of plans stamped "As- Built" in red. 5.
