HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/FIELD SERVICES DIVISION SUBJECT: CONTRACT RENEWAL FOR LANDSCAPE MAINTENANCE SERVICES FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AREAS WITH TRUGREEN LAND CARE I I III IIIIII III~ II IIIII I I SUMMARY Approval of the second contract amendment with TruGreen Land Care will extend the contract for landscape maintenance services for the Tustin Landscape and Lighting District parkway areas for the period from July 1,2002 to June 30, 2003 with a 2.1 percent increase in compensation. RECOMMENDATION It is recommended that the City Council approve the second amendment to the Contract with TruGreen Land Care extending the contract for landscape maintenance services for the Tustin Landscape and Lighting District areas for the period from July 1,2002 to June 30, 2003. FISCAL IMPACT The proposed 2.1% adjustment will increase the monthly price by $329.39 per month and increase the annual 12-month contract total amount to $192,177.12. Adequate funds will be requested in the 2002/2003 Fiscal Year Budget. DISCUSSION The City has contracted with TruGreen Land Care since July 1, 2000 for the maintenance of the Tustin Landscape and Lighting Distdct parkway landscaping. The original contract was for a 1- year period with three 1-year term extensions available to the City. This contract amendment would extend the contract for the second time from July 1, 2002 through June 30, 2003, and would grant the contractor a 2.1% increase in the monthly base price effective July 1, 2002. The existing contract allows for an adjustment in compensation based on the Consumer Price Index for the Los Angeles, Orange and Riverside county areas. The increase in Consumer Pdce Index over the last 12 months was 2.1%. Therefore, the overall increase in the contract price is $329.39 per month or $3,952.68 over a 12-month period. Contract Renewal for Landscape Maintenance Services for Tustin Landscape and Lighting District Areas with Trugreen Land Care May 6, 2002 Page 2 TruGreen Land Care has provided consistent service of a reasonably high quality over the last year and has been very responsive to the correction of maintenance issues when not up to City standards. The implementation of this extension will allow the City to continue to receive the same quality and responsiveness from TruGreen Land Care that the City has received before. Tim D. This Amendment is made with reference to the following: RECITALS A. WHEREAS, City and Contractor entered into an Agreement dated July 1, 2000, the "Agreement", wherein Contractor agreed to perform landscape maintenance services in accordance with the agreement and specifications entitled "Annual Landscape Maintenance Services for the Assessment District Areas"; B. WHEREAS, the initial term of the Agreement was one year, with the option to be extended for three additional one-year terms by written agreement of the parties; C. WHEREAS, City and Contractor entered into the first Amendment to the Agreement on August 20, 2001; and extended the Agreement until June 30, 2002 D. WHEREAS, City and Contractor desire to exercise the extension clause pursuant to Section D, Page D-2, Paragraph 4, "Length of Contract", Item B, to extend the Agreement for one year; E. WHEREAS, City and Contractor also desire to adjust Contractor's compensation under this Agreement, to reflect a 2. 1% increase effective July 1, 2002 for the 2002/2003 fiscal year. This increase will reflect the rise in the Consumer Price Index, for Los Angeles, Orange, and Riverside Counties, pursuant to section D, page D-3, paragraph 2, "Extension of the Term of Contract" AGREEMENT The Agreement is hereby amended as follows: Ao The term of the Agreement is extended for one year, through June 30, 2003, unless sooner terminated pursuant to Section D, Page D-8, Item 6-5 of the Agreement. B. City shall pay the Contractor the following sums for the periods indicated: 1. From July 1, 2002 to June 30, 2003, the City shall pay the Contractor, on a monthly basis, an amount equal to $16,014.76. 2. City shall pay the Contractor a sum not to exceed $192,177.12 for the period From July 1, 2002, to June 30, 2003. C.
