On December 10, 2001, the Planning Commission recommended that the City Council approve Tentative Parcel Map 2001-235 with conditions to ensure compliance with the Subdivision Map Act. On January 7, 2002, the City Council adopted Resolution 02-03 approving Tentative Parcel Map 2001-235. (Owners/Applicants: Lang Verst Homes, Inc.) RECOMMENDATION: That the City Council adopt Resolution No. 02-35 approving Final Parcel Map 2001-235. FISCAL IMPACT: The Final Parcel Map is an applicant-initiated project. The applicants have paid applicable fees for the processing of this map. ENVIRONMENTAL: Final Parcel Map 2001-235 is Categorically Exempt pursuant to Section 15315, Class 15 of Title 14, Chapter 3 of the Califomia Code of Regulations (Guidelines for the California Environmental Quality Act). DISCUSSION: The existing parcel, located at 12882 Elizabeth Way (Attachment 1 - Location Map), is currently developed with an existing single family home and three sheds located to the rear of the property. The applicant wishes to subdivide the parcel into two parcels; one parcel would contain the existing single family home and the other would accommodate the development of a new single family home (Attachment 2). A separate Design Review (DR) 01-039 application for the proposed new single family home was submitted and approved by the Community Development Director. City Council Report Final Parcel Map 2001-235 May 6, 2002 Page 2 The proposed subdivision would be configured as follows: Assessor Parcel No. Gross Area (Acres) Parcel 1 0.30 Parcel 2 0.20 Total 0.50 80 feet by 165.34 feet 52 feet by 165.34 feet Both parcels would meet all the applicable development standards of the Suburban Residential Zoning District (R-4) and the General Plan' land use designation of Low Density Residential, including the minimum site area, minimum lot area, and maximum dwelling units per acre. The existing residence would comply with all setback requirements under the proposed configuration. The new residence would be required to comply with all applicable development standards in conjunction with the Design Review application (DR 01-039). On December 10, 2001, the Planning Commission recommended that the City Council approve Tentative Parcel Map 2001-235 with conditions to ensure compliance with the Subdivision Map Act. On January 7, 2002, the City Council adopted Resolution 02-03 approving Tentative Parcel Map 2001-235. Upon fulfillment of the conditions imposed on Tentative Parcel Map 2001-235 by Resolution 02-03, the Final Map will be in substantial conformance with the Tentative Parcel Map, the City's Zoning and Subdivision Codes, and the State Subdivision Map Act. Staff recommends that the City Council approve Final Map 2001-235, subject to the fulfillment of all conditions imposed on the Tentative Parcel Map 2001-235 and the satisfaction of the City Engineer prior to recordation. The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: A! That Final Parcel Map 2001-235 to subdivide an existing 0.50 acre parcel into two parcels that are 0.30 and 0.20 acres in size to accommodate an existing single family home and construction of a new single family home was submitted by Lang Verst Homes, Inc. for consideration; B, The Planning Commission recommended that the City Council approve Tentative Parcel Map 2001-235 on December 10, 2001, and the City Council approved the Tentative Parcel Map on January 7, 2002; C. The Final Parcel Map 2001-235 was considered by the City Council on May 6, 2002; D, The project is Categorically Exempt pursuant to Section 15315, Class 15 of Title 14, Chapter 3 of the Califomia Code of Regulations (Guidelines for the Califomia Environmental Quality Act). E, As conditioned, the proposed subdivision will conform with the Tustin Area General Plan, Tustin Zoning Code, State Subdivision Map Act, and the City's Subdivision Code. F. The site is physically suitable for the type of development proposed. G. The site is physically suitable for the proposed density of development. H, The design of the subdivision is not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat.
