AN ORDINANCE OF THE CITY OF TUSTIN, CALI-
FORNIA, AMENDING THE TUSTIN CITY CODE TO
REQUIRE LICENSING OF ICE CREAM VENDORS
The City of Tustin, California, ordains that Chapter
4
Eleven of the Tustin-City Code be amended as follows:
1. Section 11-12 is hereby repealed.
2. There is hereby added to Chapter Eleven the following:
Section 11-12 Ice Cream Vendors

No person f f~irm or company shall drive or operate
9 within the City of Tustin any vehicle for the primary
purpose of selling or offering for sale to the public
10 in the public streets, ice cream, ice milk, or other
frozen confections, without holding a valid vendor' s
11 permit from the License and Permit Board for such activity
for each vehicle so engaged in the City and for each per-
1~ son so employed in the City.
Section 11-13 Application
14 Any person desiring a vend0r's permit shall make
application in the form_ prescribed by the Licenze and
15 Pe~it Board. Applications shall include the following _
information:
a) The name and address of the applicant;

b) A description of each vehicle proposed to be
18 operated;
19 c) The name and address of the registered owner of
each vehicle proposed to be operated;

D) The naLme, address, birthdate, City and State of
~'1 birth, physical description and social security
number of each driver proposed to operate a
~ vehicle to be licensed.
e) The name, address, birthdate, City and State of
birth, physical description and social security
number of each person, other than a driver, proposed
to ride in, on or upon a vehicle to be licensed.

Section 11-14 Inspection, Photoq~ng .~L_~i_~erprinting

All persons proposed to ~]rive or oper'ate or to ridge in,
27 on or upon any vehicle to be licensed shall be photograpPled-
and fingerprinted at the Tustin Police Depar'~nt. The
~8 Police Department shall make a record Check of e~ch such
person and shall, make. a report thereon to the License and
29 Permit Board. All vehicles proposed to be licensed shall
be inspected for safety at the Tustin Police D~Lp~rtment.

Section 11.15 Determination
The License and Permit Board shall hold a hearing on
the application, Evidence shall be presented a't the
~1 hearing as to the character and background of proposed
licensees and the safety of vehicles proposed to be
,--- 2 licensed. The applicant and any other interested persons
may present relevant testimony and other evidence. At the
3 conclusion of the hearing the License and Permit Board
shall, upon a determination that the applicant's proposed
4 activities do' not present any unreasonable threat to the
public health and safety generally, and to young children
5 in particular, grant a permit upon such terms and conditions
as afford reasonable protection

Section 11-16 Hours of Operation
No person, firm or company shall sell or offer for sale
8 to the public in the public streets in the City of tustin,
ice cream, ice milk, or other frozen confection other than
9 during the hours between 9:00 a.m. and one half hour after
sunset.

11 PASSED AND ADOPTED at a regular meeting of the City
12 Council, held on the 18th day of June, 1973.

certify that the whole number of members of the City Council
of the City of Tustin is five; that'the above and fore-
going Ordinance No. 585 was duly and regularly introduced
and read at a regular meeting of the City Council held on
the 4th day of June , 19 7 3 , and was given
its second reading ~nd duly passed and adopted at a regular
meeting held on the 18th day of June f 1973, by
the following vote:
