HomeMy WebLinkAboutCC RES 02-50RESOLUTION NO. 02-50 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PROVIDING FOR CONTINUATION OF ADDITIONAL TEMPORARY PARTIALLY PAID MILITARY LEAVE OF ABSENCE AND CONTINUATION OF BENEFITS FOR ELIGIBLE CITY EMPLOYEES CALLED TO ACTIVE DUTY WITH THE ARMED FORCES WHEREAS, the City of Tustin currently provides fully paid leave of absence and continuation of benefits for a maximum of thirty (30) calendar days per year to employees who have been in City service for at least one (1) year and who are ordered to report to active duty; and WHEREAS, on October 15, 2001 the City Council of the City of Tustin adopted Resolution 01-96 establishing additional temporary partially paid military leave of absence and continuation of benefits, through June 30, 2002, for eligible City employees called to active duty in connection with the nation's response to the terrorist attack on the United States of America; and WHEREAS, several City employees have been alerted and have been, or may be in the future, called into active military service in connection with actions to combat terrorism against America; and WHEREAS, the City Council of the City of Tustin desires to continue to alleviate financial hardships which employees, and their families, may experience as a result of serving on active duty during such crisis. NOW, THEREFORE, The City Council of the City of Tustin, California does hereby resolve as follows: 1. In addition to the fully paid military leave currently provided by the City of Tustin, each full time officer or employee of the City who is eligible to receive such paid leave and, who has been, or is in the future, called to involuntary active military service with the Armed Forces of the United States to serve in support of the current actions to combat terrorism against America, shall be entitled to military leave with partial pay pursuant to the terms of this Resolution for the period of absence on active duty in excess of the period covered by current paid military leave provisions. 2. The amount of pay that each such employee shall be entitled to receive from the City for said additional period of military leave shall be the difference between the gross pay and allowances actually received by the officer or employee from the United States for such service and the salary schedule gross wages that said officer or employee would have received from the City of Tustin if he or she had not been called to active military duty, subject to all required and appropriate deductions and withholdings. 3. The City shall provide continued health and welfare benefits to such employees' dependents, provided that the dependents were covered for such benefits prior to the employee being called to active duty. Wage or benefits pursuant to this Resolution are conditioned upon the officer or employee requesting such payment and providing satisfactory proof and documentation of eligibility to receive payment in accordance with the procedures established by the Human Resources Director. 5. The pay and benefits authorized by this Resolution shall terminate on and be of no further force or effect on midnight, June 30, 2003, unless extended by the City Council or otherwise required by law.
