HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FUND TRANSFER REQUEST FOR THE TUSTIN COMMUTER RAIL STATION (CIP NO. 7138) SUMMARY Construction of the Tustin Commuter Rail Station was completed on March 22, 2002. At that time, the Contractor had fulfilled his contractual requirements. However, the costs of several change orders were still being negotiated when the City Council approved the Notice of Completion for the project. Negotiations have been completed and a transfer of funds is necessary to complete payment of the outstanding change orders. RECOMMENDATION It is recommended that the City Council approve a fund transfer in the amount of $447,000.00 for FY 2001/02 from the unappropriated balance of the Air Quality Management District Fund (AB 2766) to the Tustin Commuter Rail Station Project (CIP No. 7138). FISCAL IMPACT The final construction cost of this project is $5,396,171.47. The project is funded by a combination of City Capital Improvement Program funds, State Transit Capital Improvement Program funds, State Proposition 116 funds, various Measure 'M' Program funds, and Air Quality Management District funds (AB 2766). The $447,000.00 in additional funds are needed to fund the remaining contract change orders as well as final costs for inspection and construction management required to complete payments on the project. There are sufficient unappropriated funds in the amount of $447,000.00 in the Air Quality Management District Fund (AB 2766) to finance this project. BACKGROUND The final construction cost for the Tustin Commuter Rail Station includes completion of the construction contract with Urbantec Engineers (Contractor), construction change orders, inspection costs, construction management costs and costs related to work performed by the Southern California Regional Rail Authority. The contract change orders are the result of design changes in the field and consisted of various items to complete construction of the station. The construction change orders represent a 10.5% increase in the construction contract. The additional inspection and contract management costs are related to providing those services related to the contract change orders. Fund Transfer Request for the Tustin Commuter Rail Station June 3, 2002 Page 2 Each year the City receives Air Quality Management District funds (AB 2766) to offset costs for State mandated vehicle emission programs. Forty percent of funds from the Department of Motor Vehicle registration fees are returned to local governments for local vehicle emission reduction programs as mandated by AB 2766. Since FY 1993/94, the City Council has authorized the use of either all or a portion of the annual allocation of AB 2766 funds for the development and/or construction of the Tustin Commuter Rail Station. At the November 19, 2001 City Council meeting, the Council authorized the entire AB 2766 Fiscal Year 2001/02 turn-back funds be allocated to the Tustin Commuter Rail Station. There are sufficient funds in the unappropriated AB 2766 Fund available to accommodate this request. Tim D. Serlet Director of Public Works/City Engineer Dana R.
