HomeMy WebLinkAboutPC RES 35551 RESOLUTION NO. 3555 !0 !1 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL APPROVE ZONE CHANGE 97-002 TO AMEND SECTION 2.0 AND EXHIBIT 1 OF THE JAMBOREE PLAZA DISTRICT REGULATIONS TO MODIFY THE PLANNING AREA BOUNDARIES WITHIN THE JAMBOREE PLAZA DEVELOPMENT LOCATED ON THE NORTHWEST CORATER OF EDINGER AVENUE AND JAMBOREE ROAD. The Planning Commission of the City of Tustin does hereby resolve as follows: I o The Planning Commission finds and determines as follows: A. That an application has been filed by California Pacific Equities, requesting approval of Zone Change 97-002 to amend Section 2.0 and Exhibit ! of the Jamboree Plaza District Regulations to modify the Planning Area Boundaries within the Jamboree Plaza development. B . That a Public Hearing was duly noticed, called and held on said application by the Planning Commission on October 27, 1997. C. That the Tiered Negative Declaration for the' Jamboree Plaza District Regulations has been certified in conformance with the requirements of the California Environmental Quality Act for the subject project. Do Proposed Zone Change 97-002 is consistent with the policies of the General Plan Land Use Element, including Policy 6.8, to create an "office park" or "campus-like" environment for industrial and business park developments. II. The applicant shall pay City's defense costs (including attorneys' fees) and indemnify and hold City harmless from and against any claims, losses, liabilities or damages assessed or awarded against City by way of judgement, settlement or stipulation (including awards for costs, attorneys' fees, and expert witness fees), arising from actions filed against the City challenging the City's.approval of Zone Change 97-002. The Planning Commission hereby recommends that the City Council approve Zone Change 97-002 as follows% 4 A. 10 !1 12 13 14 15 16 17 18 19 2O 21 22 23 '24 25 26 27 Section 2.0 of the Jamboree Plaza District Regulations shall be changed to read as shown in Exhibit A, attached hereto. B. Exhibit 1 of the Jamboree Plaza District Regulations shall be revised as shown in Exhibit B, attached hereto.
