CODE AMENDMENT 02-004 - NOTIFICATION DISTANCE
OF 500 FEET
Staff recommends that the public hearing on this item be
continued to allow staff sufficient time to complete an
expanded survey of additional communities and to research
their ordinances pertaining to notification distances. Staff
also will analyze notification distances for subdivision maps,
which were not previously considered.

RESOLUTION NO. 02-52 -A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE
OF COMPLETION FOR THE TRAFFIC SIGNAL
MODIFICATIONS AT MCFADDEN/VVILLIAMS AND
MCFADDEN/RITCHEY (CIP NO. 4057)
Recommendation: Adopt Resolution No. 02-52, accepting
the Traffic Signal Modifications at McFadden/Williams and
McFadden/Ritchey (ClP No. 4057), and authorizing the
recordation of the Notice of Completion, and direct the City
Clerk to.' 1) Release the Labor and Materials Bond not
sooner than thirty-five (35) days after the date of recordation
of the Notice of Completion; and 2) Release the Faithful
Performance Bond not sooner than one-year after the date
of recordation of the Notice of Completion; and assuming no
claims or stop payment notices are filed, thirty-five (35) days
after the date of recordation of the Notice of Completion the
City Council authorize payment of the final 10% retention in
the amount of $23,556.30. This amount, together with the
previous contract payments and change order amounts of
$212,006.73 represents 100% of the final contract cost as
recommended by the Public Works Department/Engineering
Division.

Recommendation: Adopt Resolution No. 02-51, adopting
the U.S. Conference of Mayors (USCM and also known as
PEBSCO and/or NRS, Nationwide Retirement Solutions)
Deferred Compensation Plan for eligible non-regular part-
time and other temporary, seasonal and intermittent
employees pursuant to the Omnibus Reconciliation Act of

REGULATIONS ORDINANCE
Code Amendment 02-003 is an amendment to the Tustin
City Code relating to business regulations and the License
and Permit Board. On Apdl 8, 2002, the Planning
Commission reviewed the proposed code amendment and
expressed their support for the proposed business
regulations.

The City Council, at their meeting of March 4, 2002,
adopted Resolution No. 02-26 which ordered the
preparation of an Engineer's Report for the levy of annual
assessments for the Tustin Landscape and Lighting District.
Subsequently, at their meeting of May 6, 2002, the City
Council adopted the following resolutions: 1 ) Resolution
No. 02-43 approving the Engineer's Report for Fiscal Year
2002-2003; and 2) Resolution No. 02-44 declaring the City
Council's intention to levy assessments for Fiscal Year
2002-2003 and set a public hearing for June 3, 2002.

1. Open the public hearing to receive testimony on the

PERMIT FEES
Code Amendment 02-003 (Ordinance No. 1252) is an
amendment to Article 3 and Part 3 of Chapter 5 of Article 1
of the Tustin City Code relating to business regulations and
the License and Permit Board. Resolution No. 02-57 would
establish the application and appeal fees for the permits
identified in Article 3 of the Tustin City Code.

POTENTIAL FOR INTERIM LEASE ACTIVITIES AT MCAS,
TUSTIN
The Department of the Navy has recently conveyed or
leased to the City of Tustin approximately 1,153 acres of
property at the former Marine Corps Air Station (MCAS)
Tustin. Councilmember Doyle has requested that staff

Said the Chili Cook Off event was outstanding and commended
staff for maintaining a clean site.
Spoke on govemment channel programming.
Stated he was recuperating from surgery.
Noted that he had been a judge for the Tustin Pride essay contest.
Requested agendizing staff costs for community events.
Requested a mayoral letter be sent supporting hosting the
Veterans Day parade in Tustin.
Stated there were 14,000 to 15,000 people in attendance at the
Street Fair and commended staff for a wonderful event.
Requested staff attends the WACO meeting this week.
Announced the starting time for the Veterans Day parade.
Commented on the large crowd at the Chili Cook Off.
Stated tonight's action on the proposed library had been a big step
for the City.
Reminded everyone to examine the facts on ocean outfall.
Spoke on AB 1969 and requested staff obtain Ross Johnson's
position is on it.
Thanked staff and the Chamber of Commerce for the State of the
City event.
