The Planning commission of the City of Tustin does hereby resolve as follows:' I o The Planning Commission finds and determines as follows: k. That a proper application was filed by The . Irvine Company for the Sector Plan and Design Review 96-050 was filed by Richmond American Homes, Inc. requesting approval of a 162-unit single-family detached project on a 31-acre site identified as Tract. 15380; B · That said application was considered by the Planning Commission on July 14, 1997; Co That an Environmental Impact Report EIR 85-2, as modified by supplements and addenda, for the East Tustin 'Specific Plan has been recommended' for certification in conformance' with the requirements of the California Environmental Quality Act for the subject project; and, De That General Plan Amendment 96-003 and Zone Change 96-003 and Third Amendment to the East Tustin. Development Agreement have been recommended for approval to a/low for the development of this project. E o Pursuant to Section 9272 of the Tustin Municipal Code, the Commission finds that the location, size, architectural features and' general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Commission has considered at least the following items: 1. Height, bulk and area of buildings. 2. Location, height and exterior illumination. standards of . Location and appearance of equipment located outside of an enclosed structure. 10. Location and method of refuse storage. 11. Physical relationship of proposed structures to existing structures in the neighborhood. 12. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 13. Proposed signage. 14. Development Guidelines. and criteria as adopted by the City Council. II. The Planning Commission hereby approves Sector Plans for ETSP Planning Sector 6 and Design Review 96-050 authorizing construction of a 162-unit single-family detached.project, subject to condition~ contained in Exhibit A attached hereto. BARBARA REYES ~ Recording Secretary GENERAL EXHIBIT A DESIGN REVIEW 96-050 CONDITIONS OF APPROVAL RESOLUTION NO. 3528 1(1) 1ol The proposed project shall substantially conform with the submitted plans for the project date stamped July 14, 1997, on file with the Community Development Department, as herein modified, or as modified by the Director of the Community Development Department in accordance with this Exhibit. The Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are to be consistent with provisions of the Tustin City Code or other applicable regulations. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval of the Community Development Department. (1) 1.3 The subject project approval shall become null and void unless permits for the proposed project are issued within twenty four (24) months of the date of this Exhibit and substantial construction is underway. Time extensions · may be granted if a written request is received by the Community Development Department within thirty (30) days prior to expiration. (1) 1.4 Approval of Design Review 96-050' is contingent upon the applicant and' property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of a challenge of the City's approval of this project. (1) 1.6 Approval of Design Review 96-050 is contingent upon the execution of the Third Amendment to the East Tustin Development Agreement, and approval of General Plan Amendment 96-003, Zone Change 96-003 and Tentative Tract Map 15380 by the City Council. Exhibit A Design Review 96-050 Conditions of Approval Resolution No. 3528 Page 2 PLAN SUBMITTAL 2.1 At building plan check, the following items shall be submitted: (3) A. (2) B. (3) '(2) (3) (1)' (3) (i) Construction plans, structural calculations, and Title 24 energy calculations. The plans shall comply with the 1994 Uniform Building Code, State Handicap and Energy Requirements, other rela~ed codes, City Ordinances, and state and federal laws and regulations (including: City of Tustin Grading Ordinance, Tustin Landscape and Irrigation Guidelines, Tustin Private Improvement Standards and Tustin Security Ordinance). Requirements of the Uniform Building. Codes shall be complied with as approved by the Building Official. Preliminary technical details and plans for all utility installations including cable TV, telephone, gas, water and electricity. Addition- ally, a note on plans shall be included stating that no 'field changes shall be made without corrections submitted to and approved by the Building Official. C. Rough and/or Precise. 'grading plans and specifications consistent with the site plan and landscaping plans and prepared by a registered civil engineer for approval by the Community Development Department. D. A precise soils engineering report provided by a soils engineer written.in the previous twelve (12) months from the date of plan check submittal. Expanded information regarding the levels of hydrocarb6ns and ground water contamination .found on-site shall be provided in. the submitted soils report. Ee Information, plans and/or specifications to ensure satisfaction of Conditions of Approval of Exhibit A of Planning Commission. A model .complex plan identifying all temporary fencing, landscaping, elevation alterations, parking facilities and other temporary model complex facilities subject to approval of the Community Development Department. Project identification signage and flags located along the project perimeter or otherwise outside of the tract boundaries shall comply with the Tustin Ranch Planned Sign Program. (2) G. (3) A detailed acoustical noise study prepared by a qualified acoustical expert, subject to review and approval by the Community Development Department, to insure that interior noise levels do not exceed a maximum of 45 dB CNEL and exterior noise levels shall not exceed a maximum of 65 dB CNEL. The report and any subsequent field inspection shall comply with condition 7.1 and 7.2 of Exhibit A of Planning Commission Resolution No. 3529. (1) 2.2 Architectural plans shall not be submitted for plan check unless accompanied by a letter approving proposed design by The Irvine Company. (4) 2°3 Building plans shall be submitted for plan check in conformance with the Development Phasing Plan submitted as part of this application. SITE AND BUILDING CONDITIONS (1) 3.1 The building plans shall .provide exact details for exterior doors and window types and treatments (i.e., framing, color and glass tint). Architectural details shall be provided for all building elevations. The appearance and design of said details shall be subject to the approval of the Community Development Department. (1) 3.2 Trim/surrounds shall be provided on all glazed areas. (1) 3°3 indicate on the final plans', the location of exterior electric meters and include screening details. Screening adequacy, appearance and compatibility shall be subject to approval of the Community Development Department. Exhibit A Design Review 96-050 Conditions of Approval Resolution No. 3528 Page 4 (1) 3.4 Ail final exterior colors to be used shall be subject to review and approval of the Director of the Community Development Department. All exterior treatments shall be coordinated with regard to color, materials and detailing and noted on submitted construction plans and elevations. (1) 3.5 The applicant shall note on final plans that a six-foot- high chain linked fence shall .be installed around the site prior to building construction stages. Gated entrances shall be permitted along the perimeter of the site for construction vehicles. (1) 3.6 Ail mechanical .and electrical fixtures and equipment (4) shall be adequately and decoratively screened. The screen shall be considered as an element of the overall design of the project and shall blend with the architectural design of buildings. All telephone and electrical boxes shall be indicated on the building plans and shall be completely screened. Electrical transformers shall be located toward the interior of the project maintaining a sufficient distance to minimize visual impacts on entry points along Pioneer Road. If visible from the backbone road or auto court, air conditioning units shall be screened from. view by architectural features. (1) 3.7 Exterior elevations of the buildings shall indicate any (4) fixtures or equipment to be located on the roof 6f the building, equipment heights and type of screening. (1) 3.8 Perimeter walls constructed by the subdivider shall be (3) consistent with wall concept plans for Tustin Ranch. (4) Private yard walls which do not also serve as perimeter walls for the project shall be compatible with main building treatments or community theme wall as reviewed and approved by the Community Development. Department during plan check. Where wood fences are utilized,, the structural'post shall be of galvanized steel. (1) 3.9 Final mailbox architectural details indicating color and (4) exterior treatment shall be included in the working drawings, and subject to review and approval of the Community Development Department during plan check. The design and location of mailboxes shall be consistent with the City Guidelines which require two mailboxes per post, located at side property lines. Exhibit A Design Review 96-050 Conditions of Approval Resolution No. 3528 Page 5 (4) 3.10 Mailboxes shall be located in "short" areas between driveways wherever possible to avoid conflicts with parked cars. (4) 3.11 The side and rear elevations that face Jamboree Road, Tustin Ranch Road and Portola Parkway shall be modified to include architectural variety, design details, staggered building mass and varied roof elements similar to the front elevations to provide relief from the flat wall appearance, subject to approval of the Director of Community Development. (4) 3.12 The developer shall provide a minimum of 162 guest parking spaces for the project, either on-street or on third-car garage driveway space. LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS (1) 4.1 The applicant shall submit at plan check complete detailed landscaping and irrigation plans for all landscaping areas, including the model complex, consistent with adopted City of Tustin Landscaping and Irrigation Guidelines. Landscaping plans shall be approved by the Community Development Department prior to issuance of any building permits. Provide summary table identifying plant materials. Landscaping plans must be approved prior to issuance of any building permits. The plant table shall list botanical and common names, sizes, spacing, location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control of backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for'all equipment must be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk widths, parkway areas, and wall locations. The Department of Community Development may request minor substitutions of plant materials or request additional sizing or quantity of materials during plan check. Note on landscaping plan that coverage of landscaping and irrigation materials is subject to field inspection at project completion by the Department of Community Development. Exhibit A Design Review 96-050 Conditions of Approval R~solution No. 3528 Page 6 (7) 4.2 The submitted landscaping plans at plan check shall reflect the following requirements: ao Turf is unacceptable for grades over 25 percent. A combination of planting materials must be used, ground cover on large areas- alone is not acceptable. B . Shrubs shall be spaced a minimum of 5 feet on center. C. Ground cover shall be planted between 8 tO 12 inches on center. D. Fences, walls and equipment areas, shall be screened with shrubs and/or vines and trees. · Ail plant materials shall be installed in a · healthy, neat condition typical to the species. Maintenance includes but is not limited to trimming, mowing, weeding, removal of litter, fertilizing, regular watering, and replacement of diseased or dead plants. F. The main entry to the project shall be planted with specimen trees to create a theme. G· Landscaping adjacent to the right-of-way shall be coordinated with parkway landscaping. Perimeter walls shall be treated with vines to relieve large wall expanses. Vines shall be informally grouped with training devices installed. (1) 4.3 Screening adjacent to roadways, whenever possible, shall (7) compliment 'the architecture, color and construction (4) material of primary buildings on the site. (1) 4.4 Ail walls, fences or landscaping adjacent to streets (7) should be designed to provide adequate sight distance for (4) vehicles exiting the tract via the private streets. (1) 4.5 Landscape and irrigation plans Shall indicate intersection sight lines per OCEMA Standard No.'Ill7. Exhibit A Design Review 96-050 Conditions of Approval Resolution No. 3528 Page 7 (1) 4.6 Show the location of all street light standards (proposed and existing) on the landscape and irmigation plans. A 20-foot lateral clear zone from all street lights for street trees shall be provided, unless otherwise approved by the Public Works Department. (1) 4.7 The entry to the project site should be the focal point. (4) In addition to larger trees, this area should (7) include a variety of color and types of landscaping. (1) 4.8 A complete, detailed project sign program including (4) design, location, sizes, colors, and materials shall be approved by The Irvine Company then submitted for review and approval of the Department of Community Development. The sign program shall include temporary project identification, addressing and street signs. Address .signs shall be illuminated. (1) 4.9 The final site improvement plans and working drawings shall indicate a lighting scheme for the project. Note locations of all exterior'lights and types of fixtures on the elevations. All street lighting shall be in accordance with City standards. Lights to be installed on buildings shall be a decorative design. No lights shall be permitted which may create any glare or have a negative impact on adjoining properties. The location and types of lighting shall be subject to the approval of the Director of Community Development. (1) 4.10 The lighting on the buildihgs shall compl~ with the City's Security Ordinance. (4) 4oll Prior to the issuance of certificate of Occupancy for the Model Complex, the developer shall install all landscaping on perimeter Lots "A" through "E" and Lots "P" and "Q". FEES (1) 5.1 Payment of all fees required in Condition 10.1 .through (6) 10.5 of Exhibit A of Planning Commission Resolution No. 3529. ..
