HomeMy WebLinkAboutPC RES 35091 RESOLUTION NO. 3509 5 10 11 12 13 14 15 16 17 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL APPROVE FINAL TRACT MAP 15316 (TRACT NOS. 15373, 15374, 15375 AND 15316) The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ao That Final Tract Map 15316 (Tract Nos. 15373, 15374, 15375 and 15316) has been submitted by Kaufman and Broad Coastal, Inc; B . That a public hearing was held by the Planning Commission on October 28, 1996. At this hearing the Planning Commission recommended that the City Council approve Tentative Tract Map 15316. Subsequently, the City Council approved Tentative Tract Map 15055 on November 18, 1996; Co D , E . Pursuant to Section 15268(b) of the California Environmental Quality Act (CEQA), the Final Map is considered statutorily exempt from the requirements of CEQA. · That the proposed subdivision is in conformance with the Tustin General Plan, the Tustin Zoning Code and Subdivision Map Act; The 0.5964 acres 'of parkland required for this development was previously dedicated with recordation of Tract 15055; F o That the City has reviewed the status of the School Facilities Agreements between the Irvine Company and the Tustin Unified School District for the impact of Tentative Tract 15055 on School District facilities, and changes in state law. Impacts associated with this approval on School District facilities are adequately addressed; G. That the site is physically suitable for the type of development proposed; H. That the site is physically suitable for the proposed density of development; I · That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat; 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 Resolution No. 3509 Page 2 J. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public-at-large, for access through or use of the property within the proposed subdivision; K. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems; and, m . That the Final Map is in substantial conformance with the Vesting Tentative Tract Map. II. The Planning Commission hereby recommends that the City Council approve Final Tract Map 15316 (Tract Nos. 15373, 15374, 15375 and 15316), subject to final approval by the City Engineer.
