HomeMy WebLinkAboutPC RES 35041 RESOLUTION NO. 3504 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL APPROVE CODE AMENDMENT 96-3 - AN ORDINANCE (ORD. NO. 1173) AMENDING TUSTIN CITY CODE SECTION 9272 RELATED TO DESIGN REVIEW. The Planning Commission of the City of Tustin does resolve as follows: I. The Planning Commission finds and determines as follows: A, Residential developers have been requesting changes to product-type through the Design Review approval process, after a development is under construction, units sold, and homes are occupied; B o Residential subdividers have proposed design changes that may diminish the property values of existing homes in the development, by proposing different exterior designs, cheaper materials, fewer amenities, and different square footages; C o Homeowners in such developments have expressed great concerns about such product design modifications, because of the effect on neighborhood aesthetics and property values; D . While allowing for reasonable changes to adjust to market demand, residential developers should be encouraged to buildout their projects with the original product design, and be discouraged from piece mealing their projects. Unless regulated as provided in the proposed ordinance, the current ability to modify design review approval will adversely affect the aesthetics and residential property values of the community; E . The proposed amendment implements the Tustin General Plan by establishing uniform regulations to ensure compatible and complementary development occurs; Fe Adoption of the Code Amendment will advance the preservation of the environment by establishing procedures and requirements for modifications to previously approved residential projects; G. A Negative Declaration was prepared for this project as set forth in the California Environmental Quality Act. The Negative Declaration was considered by the Planning Commission Resolution No. 3503 and recommended for approval to the City Council; 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 28 Resolution No. 3504 Page 2 I o The Planning Commission did, on the 25th day of November, 1996, hold a duly noticed public hearing as prescribed by law to consider Code Amendment 96-3; and At said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission considered all factors relating to the Code Amendment. II. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Tustin, California, recommends that the City Council adopt Code Amendment 96-3 amending the text of Section 9272. Design Review as identified in the attached "Exhibit A." PASSED AND ADOPTED by the Planning Commission of the City of Tustin at a regular meeting held on the 25th day of November, 1996.
