HomeMy WebLinkAboutPC RES 349910 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 3499 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, RECOMMENDING THAT THE TUSTIN CITY COUNCIL APPROVE AMENDMENT NO. 2 TO VESTING TENTATIVE TRACT MAP 14188 LOCATED ON THE WEST SIDE OF TOWNSHIP DRIVE AT RAWLINGS WAY. The Planning Commission of the City of Tustin does hereby resolve as follows' I. The Planning Commission finds and determines as follows: ao That Amendment No. 2 to Vesting Tentative Tract Map 14188 located on the west side of Township Drive at Rawlings Way was submitted to the Planning Commission by Standard Pacific for consideration; $. That a public hearing was duly called, noticed and held for said Amendment No. 2 by the Planning Commission on November 12, 1996; Ce That an Environmental Impact Report EIR 85-2, as amended, for the East Tustin Specific Plan has been certified in conformance with the requirements of the California Environmental Quality Act for the subject project; De That the proposed subdivision is in conformance with the Tustin General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act; Ee The .7182 acres of parkland required for this development was previously dedicated with recordation of Tract 12870; Fe That the City has reviewed the status of the School Facilities Agreements between the Irvine Company and the Tustin Unified School District for the impact of Amendment No. 2 to Vesting Tentative Tract 14188 on School District facilities, and changes in State law. Impact§ associated with this approval on School District facilities are adequately addressed; G~ That the site is physically suitable for the type of development proposed; He That the site is physically suitable for the proposed density of development; I · That the design of the subdivision or the proposed improvements are not likely to cause substantial 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 Resolution No. 3499 Page 2 environmental damage or substantially and avoidably injure fish or wildlife in their habitat;" J. That the design of the subdivision or the type of improvements proposed will not conflict with easement acquired by the public at large, for access through or use of the property within the proposed subdivision; and Ke That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. II. The Planning Commission hereby recommends that the City Council approve Amendment No. 2 to Vesting Tentative Tract Map 14188 located on the west side of Township. Drive at Rawlings Way to add two new product types to the buildout of the previously approved development on Tract 14188, subject to the Conditions contained in Exhibit A, attached hereto. REYE$ Re¢oz~ing Secretary 28 EXHIBIT A AMENDMENT NO. 2 TO VESTING TENTATIVE TRACT 14188 RESOLUTION NO. 3499 CONDITIONS OF APPROVAL GENERAL *** 1.1 Condition No. 10.6 of Planning Commission Resolution No. · 2767 is hereby revised to read as follows: "Prior to the release of building permits, all conditions of approval of Design Review 89-82, Design Review 94-033 and Design Review 96-041 for the subject project shall be complied with as shown in Exhibit A attached to Planning Commission Resolution Nos. 2766, 3324 and 3498 respectively." Ail other conditions of Planning Commission Resolution No. 2767 remain in full force and effect. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be .complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 The subject project approval shall become null and void unless permits for the proposed project are issued within twenty four (24) months of the date of this Exhibit and substantial construction is underway. Time extensions may be granted if a written request is received by the Community Development Department within thirty (30) days .prior to expiration. (1) 1.4 Approval of Amendment No. 2 to Vesting Tentative Tract 14188 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The applicant shall hold and defend the City of Tustin harmless for all claims and liabilities arising out of City's approval of the entitlement process for this project.
