RESOLUTION NO. 3493
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE
EXCEPTION 96-002 PERMITTING AN ADDITIONAL 44 SQUARE
FOOT SUPPLEMENTAL COPY SIGN WITH EXPOSED NEON AND
AMENDING CONDITION 1.6 OF PLANNING COMMISSION
RESOLUTION NO. 3403 RELATED TO SIGN CODE EXCEPTION
95-007, LOCATED AT 14081 YORBA STREET (ENDERLE
CENTER).
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, for Sign Code Exception
96-002 has been filed by Promotional Signs
requesting authorization to install an additional
44 square feet of supplemental copy with exposed
neon on an existing sign and amendment to Condition
1.6 of Planning Commission Resolution No. 3403
related to sign code exception 95-007, located at
14081 Yorba Street.

Pursuant to Sign Code Section 9405.C, the request
to install the additional sign copy can be
supported by the following findings:

Siqn size and placement restriction of the
Siqn Code shall be as closely followed as
practicable. "
The total size of the existing and proposed
signs is 119 square feet. The size of the sign
is consistent with the size and scale of the
building wall which is 5,400 square feet in
size. The proposed location of the
supplementary copy is consistent with the sign
Code standards in that it is incorporated into
the existing sign and reads as one sign.

The intent and purpose of the Sign Requlations
of the land use zone in which the siqn is to
be located shall be followed as closely as
practicable.
The purpose and intent of a Center
Identification sign is to identify the name of
the center and either specific businesses or
types of services. The proposed supplementary
copy is intended to identify the types of

services and businesses located within the
commercial portion of Enderle Center;
therefore, installation of this additional
sign copy is consistent with the purpose and
intent of the sign regulations.
There are special circumstances unique to the
property to justify the exception.
The additional 44 square feet of signage is
justifiable as Enderle Center is a relatively
large project (12 acres and 113,600 square
feet of leasable space) and the wall space on
which the sign is proposed is large (5,400
square feet). A 119 square foot sign may be
more compatible with the scale of such a large
building facade. In addition, motorists on
the freeway would not as easily read a smaller
sign in this location.
Grantinq of the exception will not have
neqative impact on the surroundina properties.
There are no other signs on this building nor
are there any other center identification
signs on this freeway frontage. The proposed
supplementary copy sign will not have a
negative impact on surrounding properties in
that the sign is compatible with the size and
scale of the project, will be consistent with
the overall design theme for center signs and
will promote the commercial center to the
community.

The sign application promotes the public
health, safety, welfare and aesthetics of the
community in that .the qrantinq of the
exception meets the findinqs and intent of the
Siqn Code.
The subject Sign Code Exception would be a
benefit to the community in that the proposed
supplementary copy sign would improve the
quality'of Center identification and minimize
visual sign clutter by incorporating it into
the existing wall sign.

C.
Pursuant to Section 9404c2 of the Tustin City Code,
the Commission finds that the. exposed neon sign
will be permanently incorporated into the sign
design and is compatible with the architectural
design of the building and center as a whole.
D.
That Condition 1.6 of Planning Commission
Resolution No. 3403 requiring a formal reciprocal
parking, access and landscaping easement between
the office building and the retail portion of
Enderle Center is not necessary or required by the
sign code. The subject parcel is part of the same
Planned Community-Commercial zoning designation,
was included on the compostie site plan at original
development processing, has always been considered
part of the Center and included in the parking
summary for the project. The Master Sign Program
for the Center will be modified to incorporate this
center identification sign.

That this project has been determined to be
Categorically Exempt (Class 11) pursuant to Section
15311 of the California Environmental Quality Act.
III. The' Planning Commission hereby approves Sign Code
Exception 96-002 for an additional 44 square feet of
supplemental sign copy with exposed neon and'amendment to
Condition 1.6 of Planning Commission Resolution No. 3403
related to sign code exceptiono95-007, located at 14081
Yorba Street, subject to the conditions contained in
Exhibit A, attached hereto.
PASSED ANDADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 12th day of November, 1996.

CONDITIONS OF APPROVAL

SIGN CODE EXCEPTION 96-002/AMENDMENT TO
SIGN CODE EXCEPTION 95-007
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped November 12, 1996
on file with the Community Development Department, as herein
modified, or as modified by 'the Director of Community
Development Department in accordance with this Exhibit. The
Director of Community Development may also approve subsequent
minor modifications to plans during plan check if such
modifications' are to be consistent with provisions of the
Tustin City Code or other applicable regulations.
(1) 1.2 Unless otherwise specified, the conditions contained in this
Exhibit shall be complied with prior to the issuance of any
sign permits for the project, subject to review and approval
by the Community Development Department.
(1) 1.3 The subject project approval shall become null and void unless
sign permits for the proposed project are issued within twelve
(12) months of the date of this Exhibit and substantial
construction is underway. Time extensions may be granted if
a written request is received by the Community Development
Department prior to expiration.
(1) 1.4 Approval of Sign Code Exception 96-002 is. contingent upon the
applicant and property owner signing and returning an
"Agreement to Conditions Imposed" form as established by the
Director of Community Development.
(1) 1.5 The applicant shall hold and defend the City of Tustin
harmless for all claims and liabilities arising out of the
City's approval of the entitlement process for this project.
*** 1.6 Condition 1.6 of Planning Commission Resolution No. 3403 shall
be amended to read as follows:
"The center identification wall sign authorized by SCE 95-007
and SCE 96-002 shall be removed if the subject site and office
building are ever severed or removed from Enderle Center."

PLAN SUBMITTAL
(1) 2.1 At building permit plan check, submit three (3) complete sets
of sign plans. Requirements 'of the Uniform Building Code
shall be complied with as approved by the Building Official.
All construction shall be in accordance with the 1991 UBC,
applicable City Codes and the City's Security Code. No field
changes shall be made without corrections submitted to and
approved by the Community Development Department.
FEES
(6) 3.1 Prior to issuance of any permits, the applicant shall pay all
applicable building plan check and permit fees to the
Community Development Department. Payment will be required
based upon the rate in effect at the time of permit issuance
and are subject to change.
(1) 3.2 Within forty-eight (48) hours of approval of the subject
(5) project, the applicant shall deliver to the Community
Development Department, a cashier's check payable to the
COUNTY CLERK in the amount of $38.00 (thirty-eight dollars) to
enable the City to file the appropriate environmental
documenfation for the project. If within such forty-eight
(48) hour period that applicant has not delivered to the
Community Development Department the above-noted check, the
statute of limitations for any interested party to .challenge
the environmental determination under the provisions of the
California Environmental Quality Act could be significantly
lengthened.
