HomeMy WebLinkAboutPC RES 34831 RESOLUTION NO. 3483 5 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 96-027 AUTHORIZING TRACT 15350, A 316-UNIT CONDOMINIUM DEVELOPMENT, TO BE LEASED AS APARTMENTS. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ao That a proper application, Conditional Use Permit 96-027, has been filed by Irvine Apartment Communities requesting authorization to lease a 316-unit condominium development as apartments on Tract 15350, pursuant to Section 3.6.2.A of the East Tustin Specific Plan. B· That a public hearing was duly called, noticed and held for said application by the Planning Commission on October 28, 1996. Ce That an Environmental Impact Report EIR 85-2, as modified by supplements and addenda, for the East Tustin Specific Plan has been certified in conformance with the requirements of the California Environmental Quality Act for the subject project. De That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort or general welfare of the persons residin~ or working in the neighborhood of such proposed use, nor detrimental to the property and improvements in the neighborhood of the subject property, not to the general welfare of the City of Tustin as evidenced by the following: I · The proposed development is consistent with development standards for condominiums, and exceeds the minimum development standards for apartments, as provided for by the East Tustin Specific Plan. · The proposed project is consistent with the East Tustin Development Agreement, as amended, authorizing the total number of dwelling units to be constructed within the East Tustin Specific Plan ', area. · In the event'the proposed apartments are converted to condominiums, the development has been designed in accordance with' the requirements for condominiums, as specified in the East Tustin Specific Plan. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 Resolution No. 3483 Page 2 II. The Planning Commission hereby approves Conditional use Permit 96-027 authorizing Tract 15350, a 316-unit condominium project, to be leased as apartments, subject to the conditions contained in Exhibit A of Planning Commission Resolution Nos. 3482 and 3484, attached thereto and incorporated herein by reference.
