RESOLUTION NO. 3456
A RESOLUTIONOF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, FINDING THE
PROPOSED REPAIRS FOR THE EL MODENA CHANNEL ARE
IN CONFORMANCE WITH THE CITY OF TUSTIN'S
GENERAL PLAN.
The Planning Commission of the City of Tustin'does hereby
resolve as follows:
I .
The Planning Commission determines and finds as
fol lows:
The Orange County Flood Control District
(OCFCD) has requested a finding of General
Plan'conformance for channel repairs to the E1
Modena Irvine Channel within the City of
Tustin for the purpose of restoring the 1995
flood damaged channel to pre-1995 flood
protection conditions.

Government Code Section 65402 requires that
when a public agency proposes to construct
facilities within another agency's
jurisdiction, the Planning Commission of that
jurisdiction must make a finding that the
proposed action conforms to the applicable
General Plan.

The Orange County Environmental Management
Agency is the lead agency for the project and
has prepared and adopted a Negative
Declaration and mitigation measures for the
proposed project. The public comment period
on the Negative Declaration closed April 19,
1996.

The Planning Commission did on the 8th day of
July 1996, hold a duly noticed public meeting
as prescribed by law to consider said request.

II. Now, therefore, be it resolved that the Planning
Commission of the City of Tustin finds as follows:

That the above recitations are true and
correct'
Based on the evidence presented at the public
meeting, the Commission finds the proposed
project in conformance with the City of Tustin
General Plan for the following reasons:

The proposed improvement, as mitigated in
the Negative Declaration, will be
consistent and compatible with the
surrounding residential and commercial
land uses;
The proposed project will restore the
1995 flood damaged channel to pre-1995
flood protection conditions;
The proposed project will improve flood
protection for residences,' buildings and
the City's surrounding infrastructure;
The General Plan contains various goals
of ensuring~hat all portions of the City
are adequately served with essential
services and maintenance of public
facilities, protection from flooding and
the provision for adequate flood control
facilities are considered essential
services; and
The General Plan contains goals related
to minimizing the risk of flooding by
proper planning and maintenance of flood
control channels. The. proposed project
fulfills these goals.
