HomeMy WebLinkAboutPC RES 3451. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 3451 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING DESIGN REVIEW 96-018 TO PERMIT THE CONSTRUCTION OF A 60 FOOT HIGH MONOPOLE WITH 5 FOOT HIGH ANTENNAS AND ACCESSORY STRUCTURE LOCATED AT 36 AUTO CENTER DRIVE. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application, for Design Review 96-018 has been filed by Nextel Communications requesting the construction of a sixty (60) foot high monopole with 5 five (5) foot antennas and equipment shelter located at 36 Auto Center. Be That this item was considered by the Planning Commission on May 28, 1996. Ce That pursuant to Section 9272(c) of the Tustin City Code, the Community Development Department finds that the location, size, architectural features and general appearance of the proposal will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Community Department has considered at least the following items: 1. Setbacks and site planning. 2. Exterior materials and colors. · Landscaping, parking area design and traffic circulation. · Physical relationship of proposed structures to existing structure in the neighborhood. · Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24' 25 26 27 28 Resolution No. 3451 Page 2 De That this project involves the construction of a new small facility or structure and is, therefore, categorically exempt (Class 3) from the requirements of the California Environmental Quality Act, (CEQA) pursuant to Section 15303 of the State CEQA Guideline. II. The Planning Commission hereby conditionally approves Design Review 96-018 for the establishment of a 60 foot high monopole with 5 foot high antennas and a 200 square foot accessory structure located at 36 auto center drive, subject to'the conditions contained in Exhibit A attached hereto. Recording Secretary EXHIBIT A CONDITIONS OF APPROVAL DESIGN REVIEW 96-018 RESOLUTION NO. 3451 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped May 28, 1996 on file with the Community Development Department, as herein modified, or as modified by the Director of the Community Development Department in accordance with this Exhibit. The Director of Community Development may also approve subsequent minor modification to plans during plan check if such modifications are to be consistent with provisions of the Tustin City Code. (1) 1.2 Design Review approval shall become null and void unless building permit are issued within eighteen (18) months of the date of this Exhibit. (1) 1.3 The applicant shall sign and return an Agreement to Conditions Imposed form prior to the issuance of any permits. (1) 1.4 Ail conditions in this Exhibit shall be complied with prior to the issuance of any building permits for this project, subject to review and approval of plans by the Community Development Department. (1) 1.5 Any public improvements damaged by the applicant adjacent to this project shall be repaired and/or replaced by the applicant as determined by the Engineering Division and shall include but not be limited to curb, gutter, street paving and drive apron. (***)1.6 Prior to the issuance of building permits, the applicant shall provide to the Community Development Department documentation issued by the California Public Utilities Commission confirming that Nextel Communications Enhanced Specialized Mobile Radio (ESMR) is a public utility. SOURCE CODES (1) STANDARD CONDITIONS (2) DESIGN REVIEW (3) MUNICIPAL CODE *** EXCEPTION (4) UNIFORM BUILDING CODE (5) RESPONSIBLE AGENCY REQUIREMENT Exhibit A Conditions of Approval Design Review 96-018 Page 2 (1) 1.7 The applicant shall hold and defend the City of Tustin harmless from all claims and liabilities arising out of the City's approval of entitlements for this project. *** 1.8 Design Review approval shall be reviewed by the Director of. Community Development on May 21, 2001. The Director may recommend to the City Council additional conditions or modifications to the existing conditions or facilities as part of such review to protect the public health, safety and general welfare. *** 1.9 Except as otherwise stated in Condition 1.2, Design Review approval shall remain valid for a period not to exceed the term of the lease on the subject property, including any extension thereof. A copy of said lease shall be submitted to the Community Development Director prior to issuance of any permits. If the lease is extended or terminated, notice and evidence thereof shall be provided to the Community Development Director. Upon termination or expiration of the lease, the facilities shall be removed from the subject property. NOISE (1) 2.1 Ail construction operations including engine warm up shall be subject to the provisions of the City Noise Ordinance, as amended, and may take place only during the hours of 7:00 a.m. until 6:00 p.m., Monday through Friday and 9:00 a.m. until 5:00 p.m. on Saturday unless the Building Official determines that said activity will be in substantial conformance with the Noise Ordinance and that public health and safety will not be impaired, subject to application being made at the time the permit for the work is awarded or during progress of the work. PLAN SUBMITTAL (4) 3.1 The height of the monopole structure shall be sixty (60') feet. The overall height of the facility, including whip antenna and arrays shall not exceed sixty five (65') feet. (4). 3.2 A 3'-0" minimum wide by 6'-8" high pedestrian door shall be provided at the proposed building entrance for exiting purposes. Exhibit A Conditions of Approval Design Review 96-018 Page 3 (4) 3.3 Completed drawing, details and calculations shall be submitted to the Building Division for review and approval. (4) 3.4 The construction plans shall comply with the prevailing building codes, City ordinances and state and federal laws and regulations. All sets of plans shall be wet- stamped and signed by the architect and/or engineer. (2) 3.5 Exterior colors shall be tan or earthtone consistent with the auto center and subject to review and approval by the Community Development Director. All exterior treatments shall be coordinated with regard to color, materials and detailing and noted on submitted construction plans and elevations and shall indicate all colors and materials to be used. FIRE DEPARTMENT (5) 4.1 Prior to the issuance of any building permit, construction details for any emergency access gate shall be submitted to and approved by the Fire Chief. Contact the Orange County Fire Authority at (714) 744-6623 for a copy of the "Guidelines for Fire Authority Emergency Access." (5) 4.2 Prior to the issuance of building ore grading permits, the applicant shall submit to the Fire Chief a list of the quantities of all hazardous, flammable and combustible materials, liquids or gases. These liquids and materials are to be classified according to the "Orange County Fire Authority Chemical Classification Handout." The submittal shall provide a summary sheet listing each hazard class, the total quantity of chemicals stored per class and the total quantity of chemicals used in that class. A1 forms of materials are to be converted to units of measure in ponds, gallons and cubic feet. (5) 4.3 Prior to the issuance of any building permits, contact the Orange County Fire Authority Hazardous Materials Disclosure Office at (714) 744-0463 to obtain a "Hazardous Materials Business Information and Chemical Inventory Packet." This shall be completed and submitted to the Fire Chief before the issuance of any building permits. Exhibit A Conditions of Approval Design Review 96-018 Page 4 (5) 4.4 Prior to the issuance of any building 'permits, the applicant shall submit plans for the review and approval of the Fire Chief. The applicant .shall include information on the plans required by the Fire Chief. Contact the Orange County Fire Authority Plans review Section at (714) 744-0403 for the Fire Safety Site/Architectural Notes to be placed on the plans. (5) 4.5 Prior to installation, plans for an approved fire- suppression system shall be submitted to the Fire Chief for review and approval. FEES (1) 5.1 Prior to issuance of any building permits, payment shall be made of all applicable fees, including but not limited to the following. Payment shall be required based upon those rates in effect at the time of payment and are subject to change. ne Building plan check and permit fees to the Community Development Department based on the most current schedule. B . .Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $25.00 (twenty-five dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development' Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under 'the provisions of the California Environmental Quality Act could be significantly lengthened.
