HomeMy WebLinkAboutPC RES 340310 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 3403 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE EXCEPTION 95-007 PERMITTING A 75 SQUARE FOOT WALL MOUNTED CENTER IDENTIFICATION SIGN LOCATED AT 14081 YORBA STREET (ENDERLE CENTER). The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application, for Sign Code Exception 95-007 has been filed by Promotional Signs requesting authorization to install a 75 square foot wall mounted center identification sign located at 14081 Yorba Street. Bo Pursuant to Sign Code Section 9405.C, the request to install a. wall mounted center identification sign can be supported by the following findings: · Sign size and placement restriction of the Siqn Code shall be as closely followed as practicable. The.total size of the center identification sign is in conformance with the provisions of the S~gn Code. The extent of the proposed Sign Code Exception relates to the type of sign which is proposed to be a wall mounted sign rather than a monument sign so that it is visible from the adjacent SR-55 Freeway. The proposed wall mounted sign would be below the roof eave as required by the Sign Code for wall sign installations thereby following the Sign Code requirements as close as practical. · The intent and ~rpose of the Siqn Regulations of the land use zone in which the sign is to be located shall be followed as closely as practicable. Provided that reciprocal parking and access easements are recorded between the subject office property and the retail portion of Enderle Center, a Center Identification sign would be. permitted at the subject location. The installation as a wall sign, rather than a monument sign, is needed to provide adequate visibility from the freeway frontage. Therefore, the intent and purpose of the Sign Code is being followed as closely as possible by providing the applicant with the opportunity for effective sign identification. · There are special circumstances unique to the property to ~ustify the exception. The' location of the existing building and parking areas at the subject office building hinder the placement of a monument sign that would effectively promote the identity of the center. Motorists on the freeway would not see a monument sign on this site or know of the center location without clear and prominent identification on the building. · Grantinq of the exception will not have a negative impact on the surrounding properties. There are not other signs on this building nor are there any other center identification signs on this freeway frontage. The proposed center identification sign will not have a negative impact on surrounding properties in that. sign will be consistent with the overall size requirements allowed by the Sign Code and will promote the Commercial Center to the community. · The siqn application promotes the public health, safety, welfare and aesthetics of the community in that the qrantinq of the exception meets the findinqs and'intent of.the Siqn Code. The subject Sign Code Exception would be a benefit to the community in that the proposed center identification sign would improve the quality of Center identification and minimize visual sign clutter by limiting sign location to an existing structure, rather than creating an additional structure. In addition, the sign is located in an area on the building which could be occupied by tenant identification signage and therefore not be an unusual location for a sign. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution 3403 Page 3 Ce That this project has been determined to be Categorically Exempt (Class 11) pursuant to Section 15311 of the California Environmental Quality Act. III. The Planning Commission hereby approves Sign Code Exception 95-007 for a wall mounted center identification sign located at 14081 Yorba Street, subject to the conditions contained in Exhibit A, attached hereto. Recording Secretary EXHIBIT A CONDITIONS OF APPROVAL RESOLUTION NO. 3403 OCTOBER 23, 1995 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted, plans for the project date stamped October 23, 1995, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. The Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are to be consistent with provisions of the Tustin City Code or other applicable regulations. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any sign permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 The subject project approval shall become null and void unless sign permits for the proposed project are issued within twelve (12) months of the date of this Exhibit and substantial' construction is underway. Time extensions may be granted if a written request is received by the Community Development Department within thirty (30) days prior to expiration. (1) 1.4 Approval of Sign Code Exception 95-007 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. 1) 1.5 The applicant shall hold and defend the City of Tustin harmless for all claims and liabilities arising out of the city's approval of the entitlement process for this project. SOURCE CODES (1) STANDARD CONDITION (5) RESPONSIBLE AGENCY REQUIREMENT (2) CEQA MITIGATION (6) LANDSCAPING GUIDELINES (3) UNIFORM BUILDING CODE/S (7) PC/CC POLICY (4) DESIGN REVIEW *** EXCEPTION Exhibit A Conditions of Approval Resolution No. 3403 Page 2 *** 1.6 The applicant shall prepare and record an easement for irrevocable access, parking and landscaping between the subject office property at 14081 Yorba Street and the retail portion of Enderle Center bounded by 17th Street on the north, Yorba Street on the west, Vandenberg Lane on the south and Enderle Center Drive on the east. Said easement shall be reviewed and approved by the Community Development Department and the City Attorney prior to recording with the Orange County Recorders Office. Any modified, altered or replacement signs shall comply with City of Tustin Sign Code in effect at the time and if determined by the Community Development Department to no longer require reciprocal parking and access, then said easement may be voided. PLAN SUBMITTAL (1) 2.1 At building permit plan Check, submit three (3) complete sets of sign plans. Requirements of the Uniform Building Code shall be complied with as approved by the Building Official. All construction shall be in accordance with the 1991 UBC, applicable City Codes and the City's Security Code. No field changes shall be made without corrections submitted to and approved by the Community Development Department. FEES (1) 3.1 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the' Community Development Department, a cashier's check payable to the County Clerk, in the amount of $25.00 (twenty five dollars) to enable the City to file with the County Clerk, the appropriate environmental documentation pursuant to the California Environmental Quality Act. If within such forty- eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened. (1) 3.2 Within forty-eight (48)' hours of approval of the subject project, the applicant shall submit to the Community Development Department the additional development processing fee of $25 dollars for the Notice of Exemption.
