A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING DESIGN REVIEW 95-036 APPROVED
BY THE COMMUNITY DEVELOPMENT DEPARTMENT FOR THE
CONSTRUCTION OF A GARAGE ADDITION, SUBJECT TO
MODIFICATION OF CONDITION 2.3 OF PARCEL MAP 91-288
BY THE CITY COUNCIL, LOCATED AT 18262 ALEXANDRA
PLACE.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:
That the applicant has filed an appeal of
Conditions 3.2 (a) and (c) of Design Review 95-036
approved by the Community Development Department on
September 7, 1995 for the construction of a garage
addition at an existing residential project located
at 18262 Alexandra Place.

That the said appeal was considered by the Planning
Commission on October 9, 1995.

Pursuant to Section 9272 of the Tustin Municipal
Code, the Planning Commission finds that the
location, size, architectural features and general
appearance of the proposed development will not
impair the orderly and harmonious development of
the area, the present or future development
therein, or the occupancy as a whole. In making
such findings, the Planning Commission has
considered at least the following items:

Exterior materials and colors.
Landscaping and traffic circulation.
Development Guidelines and criteria as adopted
by the City Council.

That this project has been determined to be
· Categorically Exempt (Class 3) pursuant to Section
15303 of the California Environmental Quality Act.
II. The Planning Commission hereby approves Design Review 95-
036 approved by the Community Development Department for
the construction of a garage addition at an existing
residence located at 18262 Alexandra Place, subject to
modification of Condition 2.3 of Parcel Map 91-288 by the
City Council, and subject to the conditions contained in
Exhibit A, attached hereto.

CONDITIONS OF APPROVAL
APPEAL OF DESIGN REVIEW 95-036
GENERAL
(1)* 1.1 The proposed project shall substantially conform with 'the
submitted plans for the project date stamped October 9,
1995 on file with the Community Development Department,
as herein modified, or as modified by the Director of the
Community Development Department in accordance with this
Exhibit.' The Director of Community Development may also
approve subsequent minor modifications to plans during
plan check if such modifications are to be consistent
with provisions of the Tustin City Code.
(1) * 1.2
Unless otherwise specified, the conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building permits for the project subject to review
and approval by the Community Development Department.
(1) * 1.3
Design Review approval shall become null and void unless
building permits are issued within eighteen (18) months
of the date of this Exhibit.
(1)* 1.4 Any public improvements damaged by the applicant adjacent
to this property shall be repaired and/or replaced as
determined by the Engineering Division and shall include,
but not be limited to, curb and gutter, street paving and
drive apron.
(1)* 1.5 Ail construction shall be in accordance with the 1991
Uniform Building Code (UBC) and applicable City Codes.
(i)
1.6 Approval of Design Review 95-036 is contingent upon the
applicant signing and returning an "Agreement to
Conditions Imposed" form as established by the Director
of Community Development.

1.7 The applicant shall hold and defend the City of Tustin
harmless for all claims and liabilities, arising out of
the City's approval of the entitlement process for this
project.

ARCHITECTURE/SITE PLAN
(4) 2.1 Any exposed metal flashing or trim shall be painted to
match the building.
(4) 2.2 Ail finish colors and materials'to be consistent with the
existing color and texture of the building elevations and
roof elements, subject to final approval of the Community
Development Department.
(c) 2.3 Ail exterior light fixtures shall be decorative in design
and consistent with the architecture of the proposed
building and residence. All light rays shall be confined
to the property and shall not produce glare which
negatively affect adjacent properties.
PLAN SUBMITTAL
(3) 3.1 At building plan check, submit four (4) sets of
construction plans including structural details and
Calculations. Requirements of the Uniform Building
Codes, Energy Requirements, and applicable City Codes and
adopted Guidelines shall be complied with as approved by
the Building Official. No field changes shall be made
without corrections submitted to and approved by the
Community Development Department.
(1) 3.2 The following information shall be identified on the
plans at plan check:
a ·
Provide a final grading plan prepared and signed by
a licensed Civil Engineer indicating the amount of
surface flow of water caused by the construction of
the proposed garage.
3.3 Prior to the issuance of Building Permits, the applicant
shall submit for City Council review and approval an
application for modification of Condition 2.3 of Parcel
Map 91-288. Any conditions that may be imposed by the
City Council as a result of said action shall also be
satisfied prior to the issuance of any permits.

FEES
(1)* 4.1 Payment of all building plan check and permit fees to the
Community Development Department shall be made prior to
the issuance of any building permits in accordance with
the Tustin City Code.
(1)* 4.2 Within forty-eight '(48) hours of approval of the subject
project, the applicant shall deliver to the Community
Development Department, a cashier's check payable to the
COUNTY CLERK, in the amount of $25.00 (twenty five)
dollars) to enable the City to file with the County
Clerk, the appropriate environmental documentation
pursuant to the California Environmental Quality Act. If
within such forty-eight (48) hour period, the applicant
has not delivered to the Community Development Department
the above noted check, the approval for the project
granted herein shall'be considered automatically null and
void.
