HomeMy WebLinkAboutPC RES 338910 11 12 13 14 15 16 17 18 -' 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 3389 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE EXCEPTION 95-006 INCREASING THE MAXIMUM PERMITTED TENANT SIGN COPY AREA FROM 6 SQUARE FEET TO 18 SQUARE FEET ON A NEW CENTER IDENTIFICATION SIGN FOR a NEW RESTAURANT LOCATED AT 17320 17TH STREET (ENDERLE CENTER). The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application, for Sign Code Exception 95-006 has been filed by Corporate Designs requesting authorization to increase the maximum allowable tenant sign copy area for "Hof's Hut Bakery and Restaurant" on a center identification monument sign located on the 17th Street frontage of the Enderle Commercial Cent'er. B~ Pursuant to Sign Code Section 9405.C, the request to increase the tenant identification on a Center identification monument sign can be supported by the following findings: $iqn size and placement restriction of th~ $iqn Code shall be as closely followed as practicable. The actual total cabinet size of the monument sign is in conformance with the provisions of the Sign Code. The proposed Sign Code Exception relates to the amount of sign area proposed by a single tenant. The proposed tenant sign area is increased because the existing site design of the Commercial Center blocks any other direct views of the tenants' wall signs. Moreover, the overall sign area of the monument sign will not increase and the proposed tenant sign area for the Center identification sign will be limited to one tenant sign (Hof's Hut). Potentially, every tenant in the Center could request a tenant identification on the sign resulting in more than 18 square feet of tenant sign area. The applicant is permitted to have a tenant .directory sign on the Center identification sign, however, the sign area is limited to 6 square feet. Increased tenant sign area is necessary due to the site design of the Commercial Center. Existing buildings to the west, north and east block direct line of sight views to the pad tenant building from 17th Street. Without the increased tenant sign area, the pad tenant does not have adequate identification to traffic on 17th Street. Therefore, the intent and purpose of the Sign Code is being followed as closely as possible by providing the applicant with the opportunity for effective sign identification. There are special circumstances unique to the property to.~ustify the exception. The location of the primary wall signs on the pad tenant building are blocked by the existing service station and adjacent buildings to the west, north and east and therefore, ineffective to promote the identity of the new pad tenant. Vehicles on 17th Street will not see the wall signs on the building or know of the new tenant without clear and prominent identification on 17th Street via the Center identification sign. · Grantinq of the exception will not have a Deqative impact on the surrounding properties. The applicant is proposing to remove the existing monument sign and replace it with a new monument sign. The renovation of the existing monument signs will not have a negative impact on surrounding properties in that signs will be consistent with the overall height and size requirements allowed by the Sign Code and will promote a fresher image of the Commercial Center to the community. 6 10 11 12 13 14 15 16 17 18 20 21 22 23 24 25 26 27 28 Resolution 3389 Page 3 · The siqn application promotes the public health, safety, welfare an~ aesthetics o5 the communi%.y. ~n that the qran~inq of the ~xceP~-~~'~ts the f indinqs and intent of the sig.n Code~ The proposed Sign Code Exception would be a benefit to the community in that monument signs would improve the quality of Center · identification and minimize visual sign clutter through limiting the maximum number of permitted tenant signs on the proposed monument sign to one single tenant who occupies a freestanding building. Co That this project has been determined to be Categorically Exempt (Class 11) pursuant to Section 15311 of the California Environmental Quality Act. III. The Planning Commission hereby approves Sign Code Exception 95-006 for increased tenant sign area for a restaurant located at 17320 17th Street, subject to the conditions contained in Exhibit A, attached hereto. Recording Secretary EXHIBIT A COALITIONS OF APPROVAL RESOLUTION NO. 3389 SEPTEMBER 25, 1995 GENERAL (1). 1.1 The proposed project shall substantially conform with the submitted.plans for the project date stamped September 25, 1995, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. The Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are to be consistent with provisions of the Tustin City Code or other applicable regulations. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 The subject project approval shall become null and void unless permits for the proposed project are issued within twelve (12) months of the date of this Exhibit and substantial construction is underway. Time extensions may be granted if a written request is received by the Community Development Department within thirty (30) days prior to expiration. (1) 1.4 Approval of Sign Code Exception 95-006 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The applicant shall hold and defend the City of Tustin harmless for all claims and liabilities arising out of the City's approval of the entitlement process for this project. *** 1.6 The applicant shall remove the existing Center identification monument sign for the Enderle Center located on 17th Street and the existing pad tenant identification monument sign located on Yorba Street and replace them with the proposed signs approved as part of the subject Sign Code Exception. PLkN SUBMITTAL (1) 2.1 At building permit plan check, submit three (3) complete sets of construction plans and two (2) sets of calculations. Requirements of the Uniform Building Code and State handicap requirements shall be complied with as approved by the Building'Official. All construction shall be in accordance with the 1991 UBC, applicable City Codes and the City's Security Code. No field changes shall be made without corrections submitted to and approved by the Community Development Department. FEES (1) 3.1 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the County Clerk, in the amount of $25.00 (twenty five dollars) to enable the City to file with the County Clerk, the appropriate environmental documentation pursuant to the California Environmental Quality Act. If within such forty- eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened. (1) 3.2 Within forty-eight (48) hours of approval of the subject project, the applicant shall submit to the Community Development Department the additional development processing fee of $25 dollars for the Notice of Exemption.
