HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION CITY OF TUSTIN MEASURE M GROWTH MANAGEMENT PROGRAM ANNUAL COMPLIANCE (FISCAL YEAR 2002-2003) SUMMARY In order to maintain eligibility for the Measure M Growth Management Program, the City is required to annually submit a compliance package to the Orange County Transportation Authority (OCTA) that includes: (1) an updated Seven-Year Capital Improvement Program, (2) a Maintenance of Effort Certification, (3) a Pavement Management Program Certification, (4) a Growth Management Element Statement of Compliance, and (5) a Master Plan of Arterial Highways Consistency Resolution. RECOMMENDATION In order to maintain eligibility for the Measure M Growth Management Program (GMP), it is recommended that the City Council take the following actions in compliance with the Measure M GMP requirements: A. Adopt the attached draft Measure M Growth Management Seven-Year Capital Improvement Program (Fiscal Year 2002-2003 through Fiscal Year 2008-2009). B. Adopt Resolution No. 02-61 concerning the City's Circulation Element for Master Plan of Arterial Highways consistency. C. Authorize the Public Works Director / City Engineer to submit the City of Tustin's Measure M GMP eligibility package, including certification of the City's Maintenance of Effort (MOE) and Pavement Management Program (PMP) to the Orange County Transportation Authority. FISCAL IMPACT Compliance with Measure M requirements will ensure continued City eligibility for the Measure M Local Turnback Program and the Measure M Competitive Programs. BACKGROUND In November 1990, the voters of Orange County approved Measure M, the revised Traffic Improvement and Growth Management Program (GMP), which established a one-half cent sales tax over a 20-year period. In order to receive revenue from these programs for facility improvements the City of Tustin and other Orange County cities must continue to meet certain requirements. City of Tustin Measure M Growth Management Program Annual Compliance (Fiscal Year 2002-2003) June 17, 2002 Page 2 Tustin's Measure M eligibility package for Fiscal Year 2001-2002 was approved by OCTA last year. In order to maintain eligibility for these programs, the City is required to submit the following items for the Fiscal Year 2002-2003 compliance submittal: Seven-Year Capital Improvement Program (CIP) The draft CIP is a seven-year projection of specific projects upon which Measure M funds may be expended. Adoption of the seven year CIP is a requirement of the Measure M GMP. Included in the plan are projects that could be submitted to OCTA during the future Measure M call for projects. The proposed CIP is currently in draft form until the formal adoption of the City's seven- year Capital Improvement Program as part of the Fiscal Year 2002-2003 budget process. The finalized seven-year CIP will be forwarded to OCTA when the budget has been adopted by the City Council. Maintenance of Effort (MOE) A Maintenance of Effort Reporting Form, with a statement certifying that the City will meet its MOE expenditure in accordance with Measure M requirements for Fiscal Year 2002-2003, must be submitted with a copy of the City's draft budget sections showing these expenditures. Upon authorization, the certifications will be executed by the Director of Public Works / City Engineer and submitted to OCTA. Pavement Management Plan (PMP) The City of Tustin has had a PMP in place since July 1989. In June 1997, a new five-year plan was developed by Infrastructure Management System (IMS) and submitted to OCTA as part of the Measure M compliance package. To comply with Measure M requirements, the City has to maintain and update the plan every two years. The last update of the PMP was on June 30, 2001. The City is currently in the process of updating the PMP, which will be completed by June 30, 2003 in accordance with Measure M requirements. Certification of the local PMP will be executed by the Director of Public Works / City Engineer and submitted to OCTA. Master Plan of Arterial Highways (MPAH) Consistency The City of Tustin is required to affirm, by a City Council resolution, that no unilateral reduction in through lanes has been made on any MPAH arterial on the City's circulation element. The City has completed studies for the amendment of the MPAH to reclassify El Camino Real, between First Street and Newport Avenue, and submitted those studies to OCTA. The City is currently processing a General Plan Circulation Element Amendment to reclassify El Camino Real between First Street and Newport Avenue. Upon adoption, the resolution will be submitted to OCTA. City of Tustin Measure M Growth Management Program Annual Compliance (Fiscal Year 2002-2003) June 17, 2002 Page 3 Growth Management Element (GME) In compliance with Measure M Growth Management Element requirements, the City maintains and updates performance-monitoring mechanisms for development projects. The following components of the Growth Management Element of the City's General plan will be submitted to OCTA to fulfill this requirement: · Traffic level of service standards · Planning standards for fire, police, library, flood control, parks and open space, and other locally determined needs · Development mitigation program · Development phasing program · Seven-year Capital Improvement Program · Participation in inter-jurisdictional planning forums · Balanced housing options and job opportunities addressed · Transportation Demand Management Ordinance Compliance with the Measure M requirements will ensure the City's continued eligibility with the Measure M Growth Management Program. Kasd~n' ' ~ Engineering Services Manager S:\City Coundl Items\02 City Council Items\Measure M Annual Compliance & Resolution ~:)2-61 .doc Attachments: Resolution 02-61 Draft 7 Year ClP (OCTA format) 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 02-61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA CONCERNING THE STATUS OF THE CIRCULATION ELEMENT FOR THE CITY OF TUSTIN WHEREAS, the City of Tustin desires to maintain and improve the streets within its jurisdiction, including those arterials contained in the Master Plan of Arterial Highways (MPAH); and WHEREAS, the City of Tustin has endorsed a definition of and a process for determining consistency of the City's Arterial Highway Plan with the MPAH; and WHEREAS, the City has adopted a General Plan Circulation Element which does not preclude implementation of the MPAH within its jurisdiction; and WHEREAS, the City has completed studies for the amendment of the MPAH to reclassify El Camino Real, between First Street and Newport Avenue, and submitted those studies to OCTA, and the City is currently processing a General Plan Circulation Element Amendment to reclassify El Camino Real between First Street and Newport Avenue; and WHEREAS, the City is required to adopt a resolution every even numbered year informing the Orange County Transportation Authority (OCTA) that the City Circulation Element is in conformance with the MPAH and whether any changes to any arterial highways of said Circulation Element have been adopted by the City during Fiscal Years 2000-2001 and 2001-2002; and WHEREAS, the City is required to send every even numbered year to the OCTA all recommended changes to the City Circulation Element and the MPAH for the purpose of requalifying for participation in the Combined Transportation Funding Programs. NOW, THEREFORE, BE IT RESOLVED that the City of Tustin does hereby inform the OCTA that: a) The arterial highway portion of the Circulation Element of the City is in conformance with the County's Master Plan of Arterial Highways. b) The City attests that no unilateral reduction in through lanes has been made on any MPAH arterials during Fiscal Years 2000-2001 and 2001-2002. c) The City has adopted a uniform setback ordinance providing for the preservation of rights-of-way consistent with the MPAH arterial classification. d) The City has adopted provisions for the limitation of access to arterial highways in order to protect the integrity of the system. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution 02-61 June 17, 2002 Page 2 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 17th day of June 2002.
