ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO
FILE THE NOTICE OF COMPLETION FOR THE CONSTRUCTION OF THE
NEWPORT AVENUE AND MAIN STREET TRAFFIC SIGNAL
MODIFICATION (CIP NO. 4061)
SUMMARY
Construction of the Traffic Signal Modification at Newport Avenue and Main Street (CIP No. 4061)
has been completed to the satisfaction of the City Engineer and is now ready for City Council
acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 02-60 accepting the construction of
the Newport Avenue and Main Street Traffic Signal Modification (CIP No. 4061), and authorizing
the recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one-year after the date of
recordation of the Notice of Completion; and
Assuming no claims or stop payment notices are filed, it is further recommended that thirty-five
(35) days after the date of recordation of the Notice of Completion the City Council authorize
payment of the final 10% retention in the amount of $17,005.25 to Baxter-Griffin Company, Inc.
This amount, together with previous contract payments of $153,047.25 represents 100% of the
final contract cost.
FISCAL IMPACT
The final construction contract cost of this project is $170,052.50. The project was funded by the
City's Capital Improvement Program (02-999-4061) and the City's Annual Sidewalk Repair
Account (No. 402-6235).

BACKGROUND AND DISCUSSION
Construction of the Newport Avenue and Main Street Traffic Signal Modification (CIP No. 4061)
was completed on May 28, 2002. The project modified and upgraded the existing traffic signal
equipment at Newport Avenue and Main Street, and included the addition of fully protected left-
turn phasing for the Main Street approaches. The project also included the modification of curb
ramps and two pedestrian islands to meet the Federal American with Disabilities Act (ADA)
requirements. All of the construction work has been completed to the satisfaction of the City
Engineer, and the project is now ready for City Council acceptance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR
THE CONSTRUCTION OF THE NEWPORT AVENUE AND MAIN STREET
TRAFFIC SIGNAL MODIFICATION (CIP NO. 4061)
WHEREAS, Baxter-Griffin Company, Inc., having a contract with the City of
Tustin to construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:

(CIP No. 4061)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file the Notice of Completion for the acceptance of
said public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 17th day of June 2002.
