HomeMy WebLinkAboutPC RES 33811 RESOLUTION NO. 3381 10 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COM}4ISSION OF THE CITY OF TUSTIN, CONDITIONALLY APPROVING DESIGN REVIEW 95-005 TO MODIFY THE ON-SITE CIRCULATION AND SITE DESIGN OF THE TUSTIN MARKETPLACE, LOCATED ON WEST DRIVE, SOUTH OF EL CAMINO REAL. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ao That proper applications for Design Review 95-005 was filed by Donahue Schriber on behalf of The Irvine Company requesting approval to modify the site design and on-site circulation in the vicinity of West Drive and E1 Camino Real, in the Tustin Marketplace. B. Pursuant to Section 9272 of the Tustin Municipal Code, the Commission finds that the location, design, landscaping, circulation and general appearance of Design Review 95-005 will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Commission has considered at least the following items: 1. Location of buildings. 2. Setbacks and site planning. · Landscaping, parking area design and traffic circulation. . Physical relationship of proposed improvements to existing structures in the neighborhood. · Appearance and design relationship of proposed improvements to existing structures and possible future structures in the neighborhood and public thoroughfares. . Development Guidelines and criteria as adopted by the City Council. C. That the implementation of the circulation improvements approved as part of this Design Review would satisfy Condition No. 1.2 of Exhibit B of Planning Commission Resolution No. 3174 related to the Black Angus Design Review DR 93-005. 6 10 11 12 13 14 15 16 Resolution No. 3381 Page 2 18 D. That this project has been determined-to be a minor modification to an existing development and is therefore categorically exempt (class 1) pursuant to Section 15301 of the California Environmental Quality Act. E. That the project has been reviewed for consistency with the Air Quality Sub-Element of the City of Tustin General Plan and has been determined to be consistent or has been conditioned to be consistent with the Air Quality Sub- Element. II. The Planning Commission hereby approves Design Review 95-005 to modify the Marketplace site plan and on-site circulation, subject to the conditions contained in Exhibit A, attached hereto. The Director may also approve minor modifications to the plans if such modifications are determined to be consistent with the approved plans. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building or grading permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Design Review approval shall become null and void unless all building and/or grading permits are issued within six (6) months of the date of this Exhibit and substantial construction is underway. (1) 1.4 The applicant and property owner shall sign and return an "Agreement to Conditions Imposed" form prior to issuance of building and/or grading permits. (1) 1.5 The applicant and property owner shall hold and defend the City of Tustin harmless for all claims and liabilities arising out of the City's approval of the entitlement process for this project. PLAN SUBMITTAL (2) 2.1 At building plan check the following shall be submitted: (3) A. Final grading and specifications consistent with the site plan, prepared by a registered Civil Engineer for approval of the Community Development Department and based on the Orange County Surveyor's bench mark datum. SITE CONDITIONS (4) 3.1 A revised master site plan (scale 1"=60') for the entire Tustin Marketplace shall be provided to the Community Development Department identifying the number and location of all existing and proposed parking spaces, drive aisles, buildings and/or pads and compact and handicapped parking spaces. All compact and handicapped parking spaces shall be labeled appropriately on the site plan. (4) 3.2 Provide plans and details for all lighting fixtures and note locations on the site plan. One footcandle of light throughout the parking lot is required. Any additional light standards shall be consistent in size, type and design with those existing in the parking area. (4) 3.3 The entry drive to Beacon Bay shall be modified to provide a smooth transition from the entry drive to the car wash site. LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS (1) 4.1 Submit at plan check complete detailed landscaping and (7) irrigation plans for all modified landscaping areas consistent with adopted City of Tustin Landscaping and Irrigation Guidelines and consistent with the landscaping concept plan. Said plans shall be consistent with the existing landscape palette for the Tustin Marketplace. Provide summary table applying indexing identification to plant materials in their actual location. The plant table shall list botanical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control of backflow prevention devices (screened from view from right-of-way and on-site by shrubs), pipe size, sprinkler type, spacing and coverage. Details for all equipment shall be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk widths, parkway areas, and wall locations. The Department of Community Development may request minor substitutions of plant Exhibit A Design Review 95-005 Resolution No. 3381 Page 3 materials or request additional sizing or quantity. Note on plans that adequacy of coverage of landscaping and irrigation materials is subject to field inspection at project completion by the Department of Community Development. (7) 4.2 The submitted landscaping plans at plan check shall reflect the following requirements: ae Shrubs shall be a minimum of 5 gallon size and shall be spaced a minimum of 8 feet on center when intended as screen planting. Be Ground cover shall be planted between 8 to 12 inches on center. Ce When 1 gallon plant sizes are used, the spacing may vary according to materials used. De Ail plant materials shall be installed in a healthy vigorous condition typical to the species and landscaping must be maintained in a neat and healthy condition. This will include but not be limited to trimming, mowing, weeding, removal of litter, fertilizing, regular watering, or replacement of diseased or dead plants. TRAFFIC CIRCULATION IMPROVEMENTS (4) 5.1 At the time of future pad development or any expansion of the Tustin Marketplace south of E1Camino Real, whichever occurs first, the property owner shall be required to consider the following: ne Provide an additional left-turn lane from westbound E1 Camino Real southbound into the Center, in the vicinity of Carl's Jr; and Widening of East Drive to provide two (2) southbound travel lanes between the first and second drive aisle south of E1 Camino Real. Exhibit A Design Review 95-005 Resolution No. 3381 Page 4 FEES (6) 6.~ Prior to issuance of any permits, the applicant shall pay the following fees: A® Ail applicable grading and building plan check and permit fees to the Community Development Department; *** 6.2 Within forty-eight (48) hours of approval of the subject (5) project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $25.00 (twenty-five dollars) to enable the City to file the appropriate environmental documentation for the project. If within such forty-eight (48) hour period that applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act. could be significantly lengthened.
