A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN DENYING CONDITIONAL USE PERMIT 95-009
SUBMITTED BY CAR CAPITAL INC. REQUESTING THE
ESTABLISHMENT OF AN AUTOMOBILE PAWN BROKERING
BUSINESS LOCATED AT 18001 IRVINE BOULEVARD.
The Planning Commission of the city of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, Conditional Use Permit
95-009, has been filed by Car Capital Inc.
requesting authorization to establish an automobile
pawn business located at 18001 Irvine Boulevard.

That on April 24, 1995, the Planning Commission
approved Use Determination 95-002, authorizing
automobile pawn business in the Professional (PR)
District, subject to approval of a Conditional Use
Permit.

A public hearing was duly noticed, called and held
for said application on July 10, July 24, and
August 14, 1995, by the Planning Commission.

That the establishment, maintenance, and operation
of the use applied for will, under the normal
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use, and be injurious
or detrimental to the property and improvements in
the neighborhood of the subject property, or to the
general welfare of the City of Tustin as evidenced
by the following:
The physical site configuration of the parking
lot on the subject property does not lend
itself to frequent customers and clients
accessing the site and entering and exiting
the parking lot which would pose a conflict
with pedestrians and employees on the subject
property and adjacent properties. The parking
lot is designed for limited office use which
would typically result in an employees vehicle
being parked in the parking lot for a long
duration of time.

The operational characteristics of the
proposed use would require an employee and
vehicle owner to inspect and appraise a
vehicle being considered for pawn within the
parking lot of the subject property. This
would result in a business activity taking
place outside of the office building which
would be inconsistent and incompatible with
other office uses in the vicinity.

The use of the parking lot on the subject
property is further compromised by the fact
that the property owner allows commercial
maintenance vehicles to traverse the site to
access a storage yard in a residential zone
located in unincorporated territory of the
County. Such access poses additional conflict
between vehicles and pedestrians on the
subject property and adjacent properties.
Portions of the fence located between the
subject property and the residential property
have been removed to provide-such access in
conflict with City Code Section 9271.f.2.a
which requires a solid wall between the
Professional Office District and any
Residential District.
II. The Planning Commission hereby denies Conditional Use
Permit 95-009, requesting the establishment of an auto
pawn brokering business within the Professional (PR)
zoning district at 18001 Irvine Boulevard.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 14th day of August, 1995.
