A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, APPROVING DESIGN REVIEW 94-037
TO AUTHORIZE THE FACADE REMODEL OF THE
EXISTING RETAIL CLOTHING ESTABLISHMENT LOCATED
AT 2899 EL CAMINO REAL, TUSTIN.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I .
The Planning Commission finds and determines as
follows:

That a proper' application, Design Review 94-
037, has been filed by Gap, Inc. to authorize
the facade remodel of the existing retail
clothing establishment located at 2899 E1
Camino Real.
·
Pursuant to Section 9272 of the Tustin
Municipal Code, the Planning Commission finds
that the architectural features, materials and
colors will not impair the orderly and
harmonious development of the area, the
present or future development therein, or the
occupancy as a whole. In making such
findings, the Planning Commission has
considered at least the following items:
1. Height, bulk and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and colors.
4. Type and pitch of roofs.
Size and spacing of windows, doors and
other openings.
Towers, chimneys, roof structures,
flagpoles, radio and television antennae.

Location, height and
exterior illumination.

located outside of an enclosed structure.

That the proposed project is categorically
exempt (Class 1) pursuant to the California
Environmental Quality Act 15301.
This project has been reviewed for consistency
with the Air Quality Sub-Element of the City
of Tustin General Plan and has been determined
to be consistent or has been conditioned to be
consistent with the Air Quality Sub-Element.
II. The Planning Commission hereby approves Design
Review 94-037 to authorize the facade remodel of an
existing clothing store located at 2899 E1 Camino
Real, Tustin, subject to the conditions contained
in Exhibit A, attached hereto.

DESIGN REVIEW 94-037
CONDITIONS OF APPROVAL
RESOLUTION NO. 3357
GENERAL
(1) 1.l The proposed project shall substantially conform with the
submitted plans dated stamped May 8, 1995 on file with
the Community Development Department as herein modified
or as modified by the Director of Community Development
in accordance with this Exhibit. Minor modifications at
working drawings submittal may be submitted for review
and approval by the Director of Community Development if
found to be in substantial conformance with the approved
plans.
(1) 1.2 Unless otherwise specified, the conditions contained in
the Exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Design review approval shall become null and void unless
all building permits are issued within eighteen (18)
months of the date of this Exhibit.
(1) ~.4 The applicant shall sign and return an Agreement to
Conditions Imposed form prior to issuance of building
permits.
(1) ~.5 The applicant and property owner shall hold harmless and
defend the City of Tustin for all claims and liabilities
arising out of the City's approval of the entitlement
process for ~his project.
(1) 1.6 Ail construction shall be in accordance with the 1991
UBC, applicable City Codes and the City's Security Code.
ARCHITECTURE
(4) 2.~ No exterior downspouts shall be permitted on the proposed
facade improvements; all roof drainage shall utilize
interior piping but may have exterior outlets at base of
building.

(4) 2.2 Exterior elevations of the building shall indicate any
equipment to be located on the roof, equipment height and
type of screening. All parapets shall be at least six
inches (6") above all rooftop equipment for the purpose
of screening, subject to the review and approval of the
Community Development Department. At plan check, provide
a roof plan identifying roof mounted equipment, heights
of such equipment, heights of parapets, and section
details to illustrate conformance.
(4)' 2.3 Ail exposed metal flashing or trim shall be painted to
match the building.
(4) 2.4 The finish color and materials shall be consistent with
the existing "jean brown" color and materials of the
Tustin Marketplace.
PLAN SUBMITTAL
(1) 3.1 At building plan check, submit three (3) complete sets of
construction plans with structural calculations.
Requirements of the Uniform Building Code (UBC) and State
handicap requirements shall be complied with as approved
by the Building Official. No field changes shall be made
without corrections submitted to and approved by the
Community Development Department.
(5) 3.2 At building permit plan check, please provide the
location and details of required access and vents for the
tower which comply with Uniform Building Code Section
3205.
FIRE DEPARTMENT
(5) 4.1 The proposed soffit area shall be fire sprink!ered.
FEES
(1) 5.1 Payment of all Building plan check and permit fees and
sign design review fees shall be made prior to the
issuance of any building permits in accordance with the
Tustin City Code. Payment will be required based upon
those rates in effect at the time of payment and are
subject to change.

(1) 5.2 Within forty-eight (48) hours of approval of the subject
project, the applicant shall deliver to the Community
Development Department, a cashier's check payable to the
COUNTY CLERK in the amount of $25.00 (twenty five
dollars) pursuant to AB 3158, Chapter 1706, Statutes of
1990, to enable the City to file the appropriate
environmental documentation required under Public
Resources Code Section 21152 and 14 Cal. Code of
Regulations 15075. If within such forty-eight (48) hour
period that applicant has not delivered to the Community
Development Department the above-noted check, the
approval for the project granted herein shall be
considered automatically null and void.
