RESOLUTION NO. 3356
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING
CONDITIONAL USE PERMIT 94-031, TO AMEND THE
TUSTIN MARKET PLACE MASTER SIGN PLAN TO
INCREASE THE AMOUNT OF SIGNAGE PERMITTED FOR
CERTAIN TENANTS IN PHASES I AND II.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I ·
The Planning Commission finds and determines as
follows:
A·
That a proper application for Conditional Use
Permit 94-031 was filed by Gap, Inc. to amend
the Tustin Market Place Master Sign Plan to
increase the amount of signage permitted for
certain tenants in Phases I and II.
B·
That a public hearing was duly called, noticed
and held on said application on May 8, 1995 by
the Planning Commission.

That modifying the existing Master Sign Plan
to permit a maximum of 250 square feet of
signage for Phase I and II tenants with
enhanced facades and three or more bays will
not, under the circumstances of this case, be
detrimental to the health, safety, morals,
comfort or general welfare of the persons
residing or working in the neighborhood of
such proposed use since the larger amount of
signage will be in proportion with the size
and scale of the larger facade. The maximum
250 square feet of sign copy is also less than
the total sign copy that would be permitted
for three single bay tenants, and is equal to
that permitted for one single bay and one
double bay tenant.

That the establishment, maintenance and
operation of the proposed use will not be
injurious or detrimental to the property and
improvements in the neighborhood of the
subject property, nor to the general welfare
of the City of Tustin since the Master Sign
Plan currently provides for larger signs on
the major anchor tenants existing within the
center. An enhanced facade and tenant with
three or more bays can accommodate the larger
amount of signage without being over-powering
or obtrusive in character.

II. The Planning Commission hereby approves Conditional
Use Permit 94-031 to modify the amount of signage
permitted for Phase I and II tenants by revising
Subsection B of the Tustin Market Place Master Sign
Plan by adding Subsection B.3. as shown in Exhibit
A, attached hereto; and subject to the following
conditions:

Within thirty (30) calendar days of approval
of the subject project, the applicant shall
submit three (3) reproducible 8~" x 11" copies
of each revised page of the Tustin Market
Place Sign Plan for insertion into the master
document on file with the City. The proposed
Amendment shall be in a form such that it will
become an integral part of the Sign Plan
rather than as an Addendum to the Sign Plan.

The applicant and property owner shall sign
and return an Agreement to Conditions Imposed
form within thirty (30) calendar days of
approval of the subject project.
Ce
The applicant and property owner shall hold
harmless and defend the City of Tustin for all
claims and liabilities arising out of the
City's approval of the entitlement process for
this project.
PASSED AND ADOPTED by the Planning Commission o~ the City
