A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE
EXCEPTION 95-002, A REQUEST TO AMEND THE MASTER
SIGN PLAN FOR THE PROPERTY TO ALLON A THIRD
PROJECT IDENTIFICATION MONUMENT SIGN AND SEVEN
(7) POLE-MOUNTED AUTO DIRECTIONAL SIGNS AT THE
RESIDENTIAL PROJECT LOCATED AT 12771 ROBINSON
DRIVE, TUSTIN
The Planning Commission of the City of Tustin does hereby
resolve as follows:

The Planning Commission finds and determines as
follows:

That a proper application, Sign Code Exception
95-002, has been filed by Gannon Design,
requesting a Sign Code Exception from the City of
Tustin Sign Code to amend the master sign plan
for the property to allow a third project
identification monument sign and seven (7) pole-
mounted auto directional signs.

Pursuant to City of Tustin Sign Code Section
9405C, the request to amend the master sign plan
for the property to allow a third project
identification monument sign and seven (7) pole-
mounted auto directional signs can be supported
by the following findings:
Sign size and placement restrictions of the
Sign Code shall be followed as closely as
practicable in that the ten (10) square feet
of lettering on the monument sign and the
six square foot size of each of the seven
(7) directional signs are all within the
maximum sizes established in the City's sign
regulations for these types of signs. The
proposed third project identification
monument sign has been designed to be in
proportion with the project's entry wall and
has been placed at the project entry gates
to reinforce project identity. The
directional signs are proposed to be
installed on the light poles to improve
visibility for guests and delivery and
emergency personnel. The number of signs
has been limited to key areas for
directional purposes only.

The intent and purpose of the siqn
regulations of the land use zone in which
the siqn is located shall be followed as
·

closely as practicable in that the proposed
signage would maintain the City's appearance
by their inclusion in a strict master sign
plan, effectively identifying the
residential complex, and maintaining the
visibility and effectiveness of on-premises
signs.
There are special circumstances unique to
the property which justify the Exception in
that the residential complex contains entry
gates which are setback from the street
entrance to the complex and would otherwise
lack identifying signage; and in that unlike
other Tustin Ranch developments, the
interior streets have been designed to a
width which will accommodate on street
parking which could obscure the visibility
of ground-mounted auto directional signs,
thereby creating the need for exceptions
from the criteria contained in the Sign
Code.
Grantinq of the Exception will not have a
negative impact on surroundinq properties in
that the exception would allow the
installation of a third project
identification monument sign and seven (7)
pole-mounted directional signs which are
within the sizes permitted by the City's
Sign Code for such signage and would be
minimally or not visible from areas outside
the complex. All of the directional signs
will be oriented toward the interior of the
complex and the third monument sign would be
located approximately 172 feet within from
the property line. The ten (10) inch letter
height would be minimally visible from
Robinson Drive.
The siqn application promotes the public
health, safety, welfare and aesthetics of
the community and that the qrantinq of the
exception meets the findinqs and intent of
this chapter (Sign Code) in that the
proposed signs would be incorporated into
the master sign plan for the complex to
ensure coordinated and quality sign design
and would have a copy area which is less

than the area of sign copy allowed for such
signs, thereby promoting the welfare of the
community and meeting the findings and
intent of the Sign Code.

This project is Categorically Exempt from the
requirements of the California Environmental
Quality Act, pursuant to Section 15311 (Class
11).
II. The Planning Commission hereby approves the request to
amend a master sign plan for the property to allow a
third project identification monument sign and seven
(7) pole-mounted auto directional signs located at
12771 Robinson Drive, Tustin, subject to conditions
contained in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular Planning Commission meeting
on the 24th day of April, 1995.

CONDITIONS OF APPROVAL
SIGN CODE EXCEPTION 95-002
GENERAL
(1) 1.1 The proposed project shall substantially conform to
submitted plans date stamped April 24, 1995, on file with
the Community Development Department as herein modified
or as modified by the Director of Community Development.
In accordance with this Exhibit, the Director of
Community Development may also approve subsequent minor
modifications to plans during sign design review/plan
check if such modifications are determined consistent
with the approved plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of any
building permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Sign Code Exception approval shall become null and void
unless a sign permit and building permit are issued for
the monument sign and construction of the monument sign
is completed within twelve (12) months of the date of
this exhibit. Time extensions may be granted by the
Director of Community Development if a written request is
received by the Community Development Department within
thirty (30) days prior to expiration.
(1) 1.4 Approval. of Sign Code Exception 95-002 is contingent upon
the applicant and property owner signing and returning an
"Agreement to Conditions Imposed" form as established by
the Director of Community Development.
(1) 1.5 The developer shall hold and defend the City of Tustin
harmless for a~! claims and liabilities out of City's
approval of the entitlement process for this project.

SIGN RESTRICTIONS
(4) 2.1 Landscaping to completely surround the monument sign
shall be planted upon installation of the monument sign
in accordance with the approved landscape plans for the
project and all landscaping shall be maintained in a
healthy condition, subject to final approval of the
Community Development Department.
(4) 2.2 Any changes to the individual locations of each of the
seven (7) auto directional signs would be subject to
review and approval by the Community Development
Department.
PLAN SUBMITTAL
(3) 3.1 At Building Plan Check/Sign Design Review, three (3) sets
of construction plans and two (2) sets of structural
calculations shall be submitted. Structural calculations
for the foundation/footing design of the monument sign
shall also be provided.
FEES
(1) 4.1 Prior to issuance of any building permits, payment
(3) shall be made of all applicable building plan check and
permit fees to the Community Development Department.
(1) 4.2 Within forty-eight (48) hours of approval of the subject
project, the appiican~ shall deliver to the Community
Development Department, a cashier's check payable to the
County Clerk, in the amount of $25.00 (twenty-five
dollars) to enable the City to file with the County
Clerk, the appropriate environmental documentation
pursuant to the California Environmental Quality Act. If
within such forty eight (48) hour period, the applicant
has not delivered to the Community Development Department
the above noted check, the approval for the project
granted herein shall be considered automatically null and
void.

In addition, should the Department of Fish and Game
reject the Certificate of Fee Exemption filed with the
environmental determination and require payment of fees,
the applicant shall deliver to the Community Development
Department within forty eight (48) hours of notification,
a cashier's check payable to the County Clerk in the
amount of $850.00 (eight hundred fifty dollars) if an EIR
was prepared or $1,250 (twelve hundred fifty dollars) if
a Negative Declaration was prepared. If this fee is
imposed, the subject project shall not be operative,
vested or final unless and until the fee is paid.
