A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 92-049
AND DESIGN REVIEW 92-056, AUTHORIZING THE
CONSTRUCTION OF A CHURCH FACILITY AND RELATED SITE
IMPROVEMENTS ON THE PROPERTY IDENTIFIED AS LOT 7 OF
TRACT 12870.
The Planning Commission of the City of Tustin does hereby -
resolve as follows:
I. The Planning Commission finds and determines as follows:

That proper applications, Conditional Use 92-049
and Design Review 92-056, have been filed on behalf
of The Church of Jesus Christ of Latter Day Saints
requesting authorization to construct a church
facility and related site improvements on the
property identified as Lot 7 of Tract 12870.
o
A public hearing was duly noticed, called and held
for said applications on March 13, 1995 by the
Planning Commission.
Co
That the establishment, maintenance, and operation
of the use applied for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use, nor be injurious
or detrimental to the property and improvements in
the neighborhood of the subject property, or to the
general welfare of the City of Tustin, as evidenced
by the following findings:
o
The church use and related buildings will
improve the general welfare of the community
by offering worship services and religious
studies.
.
The overall site layout has incorporated
existing infrastructure and has been designed
sensitively to remove the ingress/egress to as
far as possible from the intersection of
Rawlings Way and Tustin Ranch Road.
Additionally, adequate parking and shielded
outdoor lighting is. provided to indicated
appropriate safegaurds for the surrounding
properties.

The overall project will provide improvements,
architecturally including landscape and
hardscape elements, that will enhance the area
improving the general welfare of the City.

The project site will be adjacent to a future
public and institutional use along the
northern boundary, which will be potentially
developed as a elementary school facility.
Additionally, the site is bordered by Rawlings
Way to the west, providing physical separation
from the residential neighborhoods, reducing
noise impacts.
That a church would be allowed within the Medium
Density' Residential designation, subject tot he
approval of a conditional use permit, pursuant to
Section 3.6.2.C of the East Tustin Specific Plan.

Pursuant to Section 9272 of the Tustin City Code,
the Planning Commission finds that the location,
size, architectural features and general appearance
· of the proposed development will not impair the
orderly and harmonious development of the area, the
present or future development therein, the
occupancy as a whole. In making such findings, the
Commission has considered at least the following
items:
1. Height, bulk and area of buildings;
2. Setbacks and site planning;
3. Exterior materials and colors;
4. Type and pitch of roofs;
o
Size and spacing of windows, doors and other
openings;
o
Towers, chimneys, roof structures, flagpoles,
radio and television antennas;
o
Landscaping, parking area design and traffic
circulation;
·
Location, height and standards of exterior
illumination;
o
Location and appearance of equipment located
outside of an enclosed structure;

11. Physical relationship of proposed structures
to existing structures in the neighborhood;
12. Appearance and design relationship of proposed

future structures in the neighborhood and
public thoroughfares;
13. Proposed signing; and
14. Development Guidelines and criteria as adopted
by the City Council.
This project is covered by a previous EIR (85-2)
for the East Tustin Specific Plan. No additional
documentation is required.
II. The Planning Commission hereby approves Conditional Use
Permit No. 92-049 and Design Review 92-056 authorizing
the construction of a church facility and related site
improvements on the property identified as Lot 7 of Tract
12870, subject to all conditions contained in Exhibit A,
attached hereto.

GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted site plans for the project date stamped March
13, 1995, on file with the Community Development
Department, as herein modified, as modified by the
Director of Community Development Department in
accordance with this exhibit or as modified during the
building plan check process and as approved by the
Community Development Department.
(1) 1.2 Unless otherwise specified, all conditions contained in
this exhibit shall be complied with prior to the issuance
of any building permits for the project, subject to
review and approval by the Community Development
Department.
(1) 1.3 Design Review and Conditional Use Permit approval shall
become null and void unless all necessary building
permits are issued within eighteen (18) months of the
date on this exhibit and substantial construction is
underway. Time extensions may be granted by the
Community Development Department without penalty to the
applicant's use permit approval if a written request is
received by the Community Development Department within
thirty (30) days prior to expiration.
(1) 1.4 The applicants and property owners shall sign and return
an Agreement to Conditions Imposed form prior to the
issuance of any building permits.
(1) 1.5 The applicant shall hold and defend the City of Tustin
harmless for all claims and liabilities arising out of
the City's approval of the entitlement process for this
project.

OPERATIONS
(4) 2.1 No other activities shall be scheduled simultaneously
with the use of the chapel/rostrum area, the bishop,
clerk and cultural center rooms. A maximum of 547
persons are permitted at the church facility at one time,
based on the fixed seats provided inside the chapel and
rostrum area and the maximum allowable occupancy for the
cultural center rooms. Simultaneous use of the
facilities on the church site are limited by the total
number of parking allocated. A minimum of 224 parking
spaces shall be maintained on site.
PLAN SUBMITTAL
(1) 3.1 At building plan check submit three sets of construction
(3) level plans as follows:
A,
Grading and construction plans, structural
calculations, and Title 24 energy calculations.
Requirements of the Uniform Building Codes, State
Handicap and Energy Requirements shall be complied
with as approved by the Building Official.
Ail plans and calculations shall have wet signature
of a licensed engineer, and shall meet the
requirements of the Uniform Building Code and
Uniform Fire Code.
o
A final grading plan with specifications consistent
with the City of Tustin Grading Manual and
ordinance and prepared by a California Civil
Engineer will be required. Said plan shall be
consistent with the site plan, landscaping plan and
identify a dust control plan.
C o
Provide preliminary technical detail and plans for
all utility installations. Additionally, a note
shall be place on plans stating that no field
'changes shall be made without said changes first
requiring review and approved by the Community
Development Department.
D o
A precise soil engineering report provided by a
soils engineer within the previous twelve (12)
months from the date of plan check submittal.

Provide a detailed acoustical noise study prepared
by a qualified acoustical expert subject to review
and approval by the Community Development
Department.
Information to ensure ~ompliance with the
requirements of the Orange County Fire Chief
including required fireflow and installation, where
required, of fire hydrants subject to approval of
the Fire Department, City of Tustin Public Works
Department and East Orange County Water District.
For area justification and exiting requirements,
indicate the following information on the plans:
1) type of construction and occupancy group(s);
2)
the maximum number of occupants for each room
or area; and
3)
the fire rating of walls and fire sprinkler
system as required.
H .
Information, plans and/or specification to ensure
satisfaction of all Public Works Department
requirements.
(3) 3.2 Architectural plans shall not be submitted for Building
Permit Plan Check unless accompanied by a letter
approving proposed design by the Irvine Company.
(4) 3.3 The elevated stage areas shall be accessible by use of a
ramp. Throughout the facility access routes are
required.
(4) 3.4 In accordance with Title 24 Regulations of the State of
California, this project shall require seven (7)
accessible parking spaces, one (1) of which shall be van
accessible.
(4) 3.5 The c~ncrete block wall located between the loop turn-
around and Tustin Ranch Road shall be raised to forty-two
inches so as to sheild surrounding properties from
vehicular lights and subject to the review and approval
by the Community Development Department.

NOISE
(1) 4.1 Ail construction operations including engine warm up
(2) shall be subject to the provisions of the City of Tustin
Noise Ordinance and shall take place only during the
hours of 7:00 a.m. until 6:00 p.m., Monday through
Friday, and 9:00 a.m. to 5:00 p.m. on Saturdays, or other
times that the Building Official determines will be in
substantial conformance with the Noise Ordinance and the
public health and safety will not be impaired subject to
application being made at the time the permit for the
work is awarded or during progress of the work.
(1) 4.2 Construction hours shall be clearly posted on the project
site to the satisfaction of the Building Official.
(1) 4.3 Ail requirements of the City's Noise Ordinance (Chapter
6 of the Municipal Code) shall be met at all times which
in part requires noise levels not to exceed 55 dba at any
time.
BUILDING/SITE
(1) 5.1 Ail exterior colors to be used shall be subject to review
(4) and approval of the Community Development Department.
All exterior treatments must be coordinated with regard
to color, materials and detailing and noted on submitted
construction plans and elevations shall indicate all
colors and materials used.
(3) 5.2 Indicate lighting scheme for the project. Note locations
of all exterior lights and types of fixtures, lights to
be installed on the building shall be of a decorative
design. One (1) footcandle of light throughout the
parking lot is required in accordance with the City's
Security Ordinance. No lights shall be permitted which
may create any glare, or have a negative impact on
adjoining properties. The location and types of lighting
shall shield abutting properties and be subject to the
approval of the Community Development Department.
(3) 5.3 A detailed sign program for the proposal shall be
submitted for plan check which shall include the actual
locations of the monument sign and any other directional
signs which identify services and activities. The
program and any proposed sign shall comply in all
respects to the East Tustin Specific Plan and Tustin Sign
Code as applicable.

(1) 5.4 Note on final plans that a six-foot-high chain link fence
Shall be 'installed around the site prior to building
construction stages. Gated entrances shall be permitted
along the perimeter of the site for construction
vekicles.
(1) 5.5 Ail mechanical and electrical fixtures and equipment
shall be adequately and decoratively screened. A cross
section of the mechanical and electrical fixtures and
equipment on the roof shall be provided at plan check.
The screen shall be considered as an element of the
overall design of the project and shall blend with the
architectural design of the buildings. All telephone and
electrical boxes shall be indicated on the building plans
and shall be completely screened. Electrical
transformers shall be located toward the interior of the
project maintaining a sufficient distances from frontage
of the project.
(1) 5.6 Exterior elevations of the buildings shall indicate any
fixtures of equipment to be located on the roof of the
building, equipment heights and type of screening. All
parapets shall be at least six inches above rooftop
equipment for purposes of screening.
(1) 5.7 An adequate size trash enclosure with solid metal, self
closing, self latching gates shall be provided. Details
for gate attachments shall be provided. Said enclosure
shall be screened by a decorative wall of a minimum
height of six feet, and if required, a dense type of
landscaping. The location of said enclosure and types of
screening shall be subject to the approval of the
Community Development Department Director.
(1) 5.8 Provide exact exterior door details, window types and
treatments (i.e., framing color, glass tint).
(1) 5.9 Note on plans that all exposed metal flashing or trim
shall be painted to match the building.
(1) 5.10 Ail roof access shall be provided from the inside of the
building.
(1) 5.11 Roof scuppers shall be installed with a special lip
device so that overflow drainage will not stain the
walls.

(1) 5.12 Indicate the location of all exterior mechanical
equipment. Gas and electric meters shall either be
enclosing in the building or boxed behind a screen wall
designed consistent with the main building.
(4) 5.13 Ail handicap parking shall be properly marked and signed
to allow for enforcement as per the California Vehicle
Code.
LANDSCAPING, GROUNDS AND F_ARDSCAPE ELEMENTS
(7) 6.1 Submit at plan check complete detailed landscaping and
irrigation plans for all landscaping areas consistent
with adopted City of Tustin Landscaping and Irrigation
Submittal Requirements. Provide summary table applying
indexing identification to plant material in their
actual location. The plan and table must list botanical
and common names, sizes, spacing, actual location and
quantity of the plant materials proposed. Show planting
and berming details, soil preparation, staking, etc. The
irrigation plan shall show location and control of
backflow prevention devices, pipe size, sprinkler type,
spacing and coverage. Details for all equipment must be
provided. Show all property lines on the landscaping and
irrigation plan, public right-of-ways area, sidewalk
widths, parkway areas, and wall locations. The
Department of Community Development may request minor
substitutions of plant materials during plan check. Note
on landscaping plan that coverage of landscaping
irrigation materials is subject to field inspection at
project completion by the Department of Community
Development. The following landscape guidelines shall be
met:

One (1) 15 gallon tree for each five (5) parking
stall shall be planted within the parking lot, and
five (5) - 5 gallon shrubs shall be planted per 25
lineal feet of planter area.
b o
Perimeter landscaping for property lines adjacent
to Lot 6 of Tract 12870 and Lot 3 of Tract 13627
shall include one 15 gallon size tree and five -
five (5) gallon shrubs for every 30 lineal feet of
property line. Turf or ground cover shall be
provided in perimeter landscaping.

At least 5% of any parking lot area and any
additional portion not used for movement and

parking of vehicles shall be landscaped with trees,
shrubs and groundcovers.
Landscaping adjacent to structures on site shall be
provided at a rate of one 15 gallon tree for every
30 lineal feet of exterior wall.
A combination of planting materials shall be used
in all landscape areas.
Ground covers shall be planted between eight (8)
and twelve (12) inches on center.
Up along fences and/or walls and equipment areas,
landscape screening shall be provided with shrubs
and/or vines and trees on plan check drawings.
Ail plant materials shall be installed in a healthy
vigorous condition typical to the species and
landscaping must be maintained in a neat and
healthy condition. This will include but not be
limited to trimming, mowing, weeding, removal of
litter, fertilizing, regular watering, or
replacement of diseased or dead plants.
Driveway and parking areas shall be buffered with a
30 inch high minimum landscaping berm. Visual
clearance shall be maintained at the driveway.
Large scale buildings shall be complimented by
large scale landscaping, solar accessibility shall
also be considered in landscaping installation.
Landscape adjacent to the right-of-way shall be
coordinated with parkway landscaping. Perimeter
walls should be treated with vines in order to
soften large expanses of walls by adding greenery
and color. Vines should be informally grouped with
training devices installed.
Ail newly planted trees shall be staked in
accordance with the City's Landscaping and
Irrigation Guidelines.
Plant materials shall be chosen and located to
promote water and energy conservation.

No structures over 3 feet in height may be located
within the front yard setback.
(4) 6.2 Perimeter landscaping and hedges shall be maintained at
no more than a height of 42-inches to allow for
surveillance of property and parking lot.
PUBLIC WORKS
(4) 7.1 A separate 24" x 36" street improvement plan will be
required showing all required construction with the
public right-of-way. In addition, a construction traffic
control plan will be required which shall be prepared by
a California registered traffic engineer.
(4) 7.2 Any damaged or missing public improvements adjacent to
this property shall be repaired and/or replaced as
determined by the Engineering Division and shall include,
but not be limited to curb and gutter, sidewalk, street
paving, drive apron, and relocation of existing street
light, if determined necessary due to drive apron
construction.
(4) 7.3 The on-site catch basin located southerly of the drive
entrance from Rawlings Way will need to be connected to
the storm drain system.
FIRE
(4) 8.1 Prior to the issuance of any grading permits, water
improvement plans shall be submitted to and approved by
the Fire Chief for adequate fire protection and financial
security posted for the installation. The adequacy and
reliability of water system design, location of valves,
and the distribution of fire hydrants will be evaluated
and approved by the Fire Chief.
(4) 8.2 Prior to the issuance of any grading permits, site plans
shall be submitted to the Fire Chief for review and
approval.
(4) 8.3 Prior to the issuance of any building permits,
architectural plans shall be submitted to the Fire Chief
for approval. The building shall comply with the
requirements for a Group a Division 2.1 occupancy.

(4) 8.4 Prior to the issuance of any building permits for
combustible construction, evidence that a water supply
for fire protection is available shall be submitted to
and approved by the Fire Chief. Fire hydrants shall be
in place and operational to meet required fire-flow prior
to commencing construction with combustible materials.
Fire hydrants are required within 150 feet of all
portions of the building.
(4) 8.5 Prior to the issuance of any building permits, all
underground piping for automatic fire extinguishing
systems shall be approved and installed. Plans for an
automatic fire extinguishing system shall be approved by
the Fire Chief prior to installation. Such systems shall
be operational prior to the issuance of a certificate of
use and occupancy.
(4) 8.6 Prior to the issuance of any building permits, all
streets having a curb to curb width of less than 36 feet
shall be red curbed and posted "No Parking-Fire Lane" as
per 1988 Uniform Fire Code Section 10.207 in a manner
meeting the approval of the Fire Chief.
(4) 8.7 Prior to the issuance of any certificates of use and
occupancy, all fire hydrants shall have a "Blue
Reflective Pavement Marker" indicating its location of
the street or drive per Orange count Fire Department
Standard. On private property these markers are to be
maintained in a good condition by the property owner.
(4) 8.8 Prior to the installation of the fire alarm system, plans
shall be submitted to the Fire Chief for approval. The
system shall comply with the California Fire Code and
California Building Code for the installation of fire
alarms in a Group A division 2.12 occupancy
FEES
(1) 9.1 Prior to issuance of any building permits payment
(3) shall be made of all required fees including, but not
limited to those identified below. Payment will be
required based upon those rates in effect at the time of
permit issuance and are subject to change:

Ail applicable building, grading and private
improvement plan check and permit fees to the
Community Development Department to be determined
at building plan check.
School facilities fee to the Tustin Unified School
District subject to any agreement reached and
executed between the District and the Irvine
Company or proof of a release from any fee payment.
Required East Tustin Facility Fees as may be
adjusted to reflect cost of living increases prior
to issuance of any building permits, including
grading, for development:
1) Civic Center Expansion Fee ($9,921)
2) Irvine Boulevard Widening Fee ($1,101)
3) Fire Protection Facility Fee ($7,242)
Within forty-eight (48) hours of approval of the
subject project, the applicant shall deliver to the
Community Development Department, a cashier's check
payable to the COUNTY CLERK in the amount of $25.00
(twenty-five dollars) pursuant to AB 3185, Chapter
1706, Statutes of 1990, enable the City to file the
Notice of Determination required under Public
Resources code Section 21151 and 14 Cal. Code of
Regulations 15094. If within such forty-eight (48)
hour period that the applicant has not delivered to
the Community Development Department the above-
noted check, the approval for the project granted
herein shall be considered automatically null and
void.
In addition, should the Department of Fish and game
reject the Certificate of Fee Exemption filed with
the Notice of Determination and require payment of
fees, the applicant shall deliver to the Community
Development Department, within forty-eight (48)
hours of notification, a cashier's check payable to
'the COUNTY CLERK in the amount of $850 (eight
hundred fifty dollars) pursuant to AB 3158, Chapter
1706, Statutes of 1990. If this fee is imposed,
the subject project shall not be operative, vested
or final unless and until the fee is paid.
