HomeMy WebLinkAboutORD 529 (1971) ORDTNANCE NO. 529 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE ANNEXATION OF NISSON-RED HILL-MITCHELL ANNEXATION NO. 72 TO THE CITY OF TUSTIN, CALIFORNIA. 4 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF TUSTIN 5 WIIEREAS, pursuant to the provisions of the Governmnet Code of the State of California, appt'ication was made to the 6 Local Agency Formation Commission to annex to the City of ~Tustin all that territory situated in the County of Orange, State of 7 California, hereby desic. nated as "NISSON-RED HILL-MITCHEILL ANNEX- ATION NO. 72". And dEsCribed in Exhibit "A" attached hereto and 8 incorporated herein by this reference as though set forth herein in~ full; and 9 WHEREAS, the Local Agency Formation Commission, in ~0 session duly assembled, on September 8, 1971, did approve said ,sed annexation; and 11 WHEREAS, on the 20th day of September, 1971, the Council 12 Df the City of Tustin did pass a~d adopt Resolution No. 71-59 giving notice of the proposal to annex certain uninhabited territo~ 15 to the City of Tustin, said territory being therein designated as "Nisson-Red Hill-Mitchell Annexation No. 72" said Resolution descri! ~4 the boundaries of the territory proposed to be annexed; and 15 WHEREAS, the written consent of the owners of more than two-thirds of the value of the territory of the subject annexatio__n 16 has been hereto filed with the City Clerk, agreeing and consenti] to pay indebtedness and liability of the City contracted prior~ j 17 to, or existing at, the time of the annexation; and ~8 ~.~{EREAS, said Resolution No. 71-59 contained .a notice of the day, hour and place when and where the Council of the City of 19 Tustin would hear protests made by any person owning real property within the territory proposed to be annexed, the time of said ~0 hearing being prescribed by law; and ~1 WHEREAS, on the 1st day of November , 1971 at the hour of 7:30 o'clock, P.M., in the Council Chambers, 275 South "C" ~2 Street in the City of Tustin, County of Orange, State of California said time and place 'being the day, hour and place fixed in said ~5 Resolution for hearing protests to the said annexation, the said Ci Council did hear and pass upon all protests made to the proposed , ~4 annexation and did determine that protests had not been made by the owners of one-half of the value of the privately and publicly ~5 owned territory proposed to be annexed as determined by said legislative body; and 26 WHEREAS, said territory is contiguous to the City of ~7 Tustin, and is uninhabited territory in the County of Orange; 28 NOW, THEREFORE, the said Council of the City of Tustir does hereby approve the annexat. ion of the territory. hereinafter 29 described to the City of Tustin, and does hereby further ordain that said territory be and it is hereby annexed to the City of 50 Tustin. 51 EXHIBIT "A" Beginning at the point of intersection of the centerlines of Red Hill Avenue and Mitchell Avenue, said poin6 of intersection being the most -westerly corner of Lot 35, BloCk 11, Irvines Subdivision, as per map - recorded in Book 1, Page 88 of Miscellaneous Maps, Records of-Orange-County California, and also being an-angle point in the existing boundary of the City of Tustin, California, as established by the Red Hill Avenue-Mitchell Avenue North Annexation, per Ordinance No. 432, passed and adopted May 19, 1969, said angle point being the most southerly corner of said ~"annexation; Thence, leaving' said City of Tustin boundary, S. 49o40,18- E., along the centerline of Mitchell Avenue and along the southwesterly line of said Lot 35, a distance of 173.00 feet, to an angle point in the westerly boundary of Tract No. 3935, as per map rec6rd~d in Book 153, Pages 16 and 17 of Miscellaneous Maps, Records of said Orange County; Thence, N. 40o20,32" E., along the westerly boundary of said Tract No. 3935, a distance of 133.00 feet, to an angle point in said westerly boundary; Thence, N. 49o40'18,, W. along said westerly boundary, a distance of 13 00 feet, to t~e most ' · southerly corner of Lot 3 of said Tract No. 3935; Thence, N. 40 20'32" E., along the southeasterly line of Lots 3, 2 and 1 of said Tract No. 3935, a distance of 196.91 feet, to the most easterly corner of said Lot 1, said most easterly corner. also being a point on the northeasterly boundary of said Tract No. 3935; Thence, S. 49o40,58" E., along the northeasterly boundary of said Tract No. 3935, a distance of 500.43 feet, to the most easterly corner of said Tract No. 3935; Thence, N. 40o20',47,, E., along the northeasterly extension qf the southeasterly boundary of said Tract No. 3935, a distance of 329.78 feet, to the most southerly corner of Parcel 2 of a Parcel Map recorded in Book 1, Page 21 of Parcel Maps, Records of said Orange County; Thence, N. 49°40,58- W., along the southwesterly line of said Parcel 2, a distance of 460.45 feet, to the most westerly corner of said Parcel 2; Thence, N. 40o20,32,, E., along the northwesterly line of said Parcel 2, a distance of 269.05 feet, to the most northerly corner of said Parcel 2, said corner also being a point on the southerly right-of-way line of Nisson Road (56' wide), and a point dn a non-tangent curve, concave northerly and having a radius of 528.00 feet, a radial line to said point bears S. '35o29'51" W.; Thence, N.. 35o29'51" E., along said radial line, a distance of 56.00 feet, to the intersection with the northerly right-of-way line of said Nisson Road, said point of intersection also being a point on the existing boundary of said City of Tustin, as established by the Red Hill Avenue-Santa Ana Freeway South Annexation, per Resolution No. 982, passed and adopted February 17, 1969, and a point on a non-tangent curve, concave northerly and having a radius of 472.00 feet, a radial line to said point bears S. 35o29 '51" W.; Thence, along the arc'of said curve and along said City boundary, through a central angle of 4o50'21", a distance of 39.87 feet to the point of tangenc with a line having a bearing of N. 49o39,48,, W.; Thence, N. 49~39'48,, W., along said tangent line and continuing along said City boundary, a distance of 188.46 feet, to an angle point in said City boundary, said angle point being a point on the southeasterly boundary of the Pankey Annexation to said City of Tustin, per Ordinance No. 99, passed and adopted April 23, 1956; Thence, S. 40o20,32- W., continuing along said City boundary, as established by last mentioned annexation, a distance of 73~ feet more or Thence~ S. 49o39,28" E., continuing along said City boundary, as established by last mentioned annexation, a distance of 33.00 feet, to an angle point in said City boundary, said angle point also being a point on the centerline of Red Hill Avenue; Thence, S. 40o20'32"W., continuing along said City boundary, a d~stance of 910.28 feet, to the point of beginning. That said territory, the annexation of which ~o ~he 2 City of Tustin is hereby approvedr is all the territory situate in the County of Orange, State of California, more particularly 3 described in Exhibit "A' attached hereto and made a part hereof by this .reference. -4 That the City Council hereby finds and determines '5 that the enactment of this Ordinance as an emergency, urgency me.asure is required for the preservation of public health and 6 welfare, and this Ordinance shall go into effect immediately upon adoption.
