HomeMy WebLinkAboutPC RES 33171 RESOLUTION NO. 3317 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING AMENDMENT TO CONDITIONAL USE PERMIT 94-003 AND DESIGN REVIEW 94-005 TO MODIFY CONDITION 2.5 OF RESOLUTION 3279 RELATED TO THE SOIL REMEDIATION PROGRAM ON THE PROPERTY LOCATED AT 1011 EL CAMINO REAL The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application to amend Conditional Use Permit 94-003 and Design Review 94-005 was filed by Donely-Bennett Architects to modify Condition 2.5 of Resolution 3279 related the soil remediation program on the property located at 1011 E1 Camino Real. Bo That a public hearing was duly called, noticed and held on said applications on December 12, 1994, by the Planning Commission. Ce That establishment, maintenance and operation of the use applied for will not, under the circumstances of this case, be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, nor detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin in that the proposed amendment would accommodate the continued soil remediation program on the property which would benefit the health and safety of persons in the vicinity. II. BARBARA REYES Recording Secretary EXHIBIT A AMENDMENT TO CUP 94-003 AND DR 94-005 CONDITIONS OF APPROVAL RESOLUTION NO. 3317 *** 1.1 Condition No. 2.5 of Planning Commission Resolution No 3279 is hereby modified to read as follows: "The soil remediation activities on the site shall be monitored and reported in accordance with the Corrective Action Plan approved by the Orange County Health Care Agency." (1) 1.2 The applicant and property owner shall sign and return an "Agreement to Conditions Imposed" form for this Resolution prior to issuance of building permits. (1) 1.3 The applicant and property owner shall hold and defend the City of Tustin harmless for all claims and liabilities arising out of the City's approval of the entitlement process for this project. (1) 1.4 Ail other Conditions of Planning Commission Resolution No. 3279 shall remain in full force and effect.
