HomeMy WebLinkAboutPC RES 33161 RESOLUTION NO. 3316 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, RECERTIFYING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR AMENDMENT TO DESIGN REVIEW 94-005 AND CONDITIONAL USE PERMIT 94-003 INCLUDING REQUIRED FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. The Planning Commission of the City of Tustin does hereby resolve as follows: The Planning Commission finds and determines as follows: ae The request to amend Design Review 94-005 and Conditional Use Permit 94-003 is considered a "project" pursuant to the terms of the California Environmental Quality Act. Be A Negative Declaration has been previously prepared and certified for this project and has been distributed for public review. Ce Whereby, the Planning Commission of the City of Tustin has previously considered evidence presented by the Community Development Director and other interested parties with respect to the subject Negative Declaration. De The Planning Commission has previously evaluated the proposed final Negative Declaration and determined it to be adequate and complete. II. The Negative Declaration for Tentative Tract Map 14914, Conditional Use Permit 94-003 and Design Review 94-005 previously certified on June 13, 1994 was considered prior to approval of this project. The Planning Commission having final authority over the subject project hereby finds: this project is within the scope of the Negative Declaration previously approved; the effects of this project were examined in the Negative Declaration. All feasible mitigation measures are incorporated into this project. The Negative Declaration is, therefore, determined to be adequate for this project and satisfies all requirements of the California Environmental Quality Act. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3316 Page 2 Based on the Negative Declaration, the Planning Commission has found that the project involves no potential for any adverse effect, either individually or cumulatively, on wildlife resources and therefore makes a De Minimis Impact Finding related to AB 3158, Chapter 1706, Statutes of 1990. In addition, there will not be a significant effect on the environment as mitigation measures have been incorporated into the project's approval which mitigate any potential significant environmental effects. Applicable mitigation measures identified in the Negative Declaration have been incorporated into this project which mitigates any potential significant environmental effects thereof. The mitigation measures are identified in Exhibits A of Planning Commission Resolution Nos 3279 and 3280 related to Tentative Tract Map 14914, Conditional Use Permit 94-003 and Design Review 94-005.
