A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, CONDITIONALLY APPROVING DESIGN REVIEW 94-034 TO
MODIFY THE SITE DESIGN TO ALLOW CONSTRUCTION OF
ADDITIONAL PARKING SPACES LOCATED AT 3015 EL CAMINO REAL.
The Planning Commission of the City of Tustin does hereby resolve
as follows:
I. The Planning Commission finds and determines as follows:

That proper applications for Design Review 94-034 was
filed on behalf of Red Robin International requesting
approval to modify the parking and on-site circulation in
order to establish additional parking spaces at 3015 E1
Camino Real, in the Tustin Market Place.

Pursuant to Section 9272 of the Tustin Municipal Code,
the Commission finds that the location, size,
architectural features and general appearance of Design
Review 94-034 will not impair the orderly and harmonious
development of the area, the present or future
development therein, or the occupancy as a whole. In
making such findings, the Commission has considered at
least the following items:
1. Height, bulk and area of buildings.
2. Setbacks and site planning.

Landscaping, parking area design and traffic
circulation.
·
Location, height and
illumination.
standards of exterior
5. Location and method of refuse storage.
·
Physical relationship of proposed improvements to
existing structures in the neighborhood.
·
Appearance and design relationship of proposed
improvements to existing structures and possible
future structures in the neighborhood and public
thoroughfares.

Development Guidelines and criteria as adopted by
the City Council.

That this project has been determined to be a minor
modification to an existing development and is therefore
categorically exempt (class 1) pursuant to Section 15301
of the California Environmental Quality Act.

That the project has been reviewed for consistency with
the Air Quality Sub-Element of the City of Tustin General
Plan and has been determined to be consistent or has been
conditioned to be consistent with the Air Quality Sub-
Element.
II. The Planning-Commi~ion hereby approves Design Review 94-034
to modify the Marketplace site plan and add new parking spaces
at 3015 E1 Camino Real in the Tustin Market Place, subject to
the conditions contained in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 28th day of November, 1994.

CONDITIONS OF APPROVAL
RESOLUTION NO. 3312
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date-stamped November,
28, 1994 on file with the Community Development
Department, as herein modified, or as modified by the
Director of Community Development Department in
accordance with this Exhibit. The Director may also
approve minor modifications to the plans if such
modifications are determined to be consistent with the
approved plans.
(1) 1.2 Unless otherwise specified, the conditions contained in
this Exhibit shall be complied with prior to the issuance
of any building or grading permits for the project,
subject to review and approval by the Community
Development Department.
(1) 1.3 Design Review approval shall become null and void unless
all building and/or grading permits are issued within
eighteen (18) months of the date of this Exhibit and
substantial construction is underway.
(1) 1.4 The applicant and property owner shall sign and return an
"Agreement to Conditions Imposed" form prior to issuance
of building and/or grading permits.
(1) 1.5 The applicant and property owner shall hold and defend
the City of Tustin harmless for all claims and
liabilities arising out of the City's approval of the
entitlement process for this project.

Final landscaping plans, prepared by a licensed
landscaped for approval of the Comunity Development
Department.
SITE CONDITIONS
(4) 3.1 A revised master site plan (scale 1"=60') for the entire
Tustin Marketplace shall be provided to the Community
Development Department identifying the number and
location of all existing and proposed parking spaces,
drive aisles, buildings and/or pads and compact and
handicapped parking spaces. All compact and handicapped
parking spaces shall be labeled appropriately on the site
plan.
(4) 3.2 Provide plans and details for all lighting fixtures and
note locations on the site plan. One footcandle of light
throughout the parking lot is required. Any additional
light standards shall be consistent in size, type and
design with those existing in the parking area.
(4) 3.3 The most easterly row of parking spaces should be
extended north to be directly adjacent to the existing
parking spaces and eliminate a landscaped area. This
will provide a continous lane of parking spaces.
(4) 3.4 The east/west drive aisle and handicapped parking located
directly south of this vacant pad should be eliminated
and replaced with parking connecting the parking aisles.
With modifications to the landscape islands and use of
"diamond" planters as found throughout the Marketplace
parking area, additional parking spaces shall be
provided.
(4) 3.5 The handicapped parking spaces adjacent to the pad may be
eliminated since they would.not be required as part of
this project.'
(4) 3.6 The proposed parking area modifications are considered
temporary and may be replaced with a free-standing
building, provided that such future development has
adequate on-site circulation and parking and does not
create traffic impacts. Such future development will be
subject to the development review procedures of the East
Tustin Specific Plan.

LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS
(1) 4.1 Submit at plan check complete detailed landscaping and
(7) irrigation plans for all landscaping areas consistent
with adopted City of Tustin Landscaping and Irrigation
Guidelines and consistent with the landscaping concept
plan. Said plans shall be consistent with the existing
landscape palette for the Tustin Marketplace.
Provide summary table applying indexing identification to
plant materials in their actual location. The plant
table shall list botanical and common names, sizes,
spacing, actual location and quantity of the plant
materials proposed. Show planting and berming details,
soil preparation, staking, etc. The irrigation plan
shall show location and control of backflow prevention
devices (screened from view from right-of-way and on-site
by shrubs), pipe size, sprinkler type, spacing and
coverage. Details for all equipment shall be provided.
Show all property lines on the landscaping and irrigation
plan, public right-of-way areas, sidewalk widths, parkway
areas, and wall locations. The Department of Community
Development may request minor substitutions of plant
materials or request additional sizing or quantity. Note
on plans that adequacy of coverage of landscaping and
irrigation materials is subject to field inspection at
project completion by the Department of Community
Development.
(7) 4.2 The submitted landscaping plans at plan check shall
reflect the following requirements:

Shrubs shall be a minimum of 5 gallon size and
shall be spaced a minimum of 8 feet on center when
intended as screen planting.

Ground cover shall be planted between 8 to 12
inches on center.

When 1 gallon plant sizes are used, the spacing may
vary according to materials used.

Ail plant materials shall be installed in a healthy
vigorous condition typical to the species and
landscaping must be maintained in a neat and
healthy condition. This will include but not be
limited to trimming, mowing, weeding, removal of
litter, fertilizing, regular watering, or
replacement of diseased or dead plants.
FEES
(6) 5.1 Prior to issuance of any permits, the applicant shall pay
the following fees:

Ail applicable grading and building plan check and
permit fees to the Community Development
Department;
*** 5.2 Within forty-eight (48) hours of approval of the subject
(5) project, the applicant shall deliver to the Community
Development Department, a cashier's check payable to the
COUNTY CLERK in the amount of $25.00 (twenty five
dollars) pursuant to AB 3158, Chapter 1706, Statues of
1990, to enable the City to file the Notice of
Determination required under Public Resources Code
Section 21152 and 14 Cal. Code of Regulations 15075. If
within such forty-eight (48) hour period that applicant
has not delivered to the Community Development Department
the above-noted check, the approval for the project
granted herein shall be considered automatically null and
void.
In addition, should the Department of Fish and Game
reject the Certificate of Fee Exemption filed with the
Notice of Determination and require payment of fees, the
applicant shall, deliver to the Community Development
Department, within forty-eight (48) hour of noti'fication,
a cashier's check payable to the COUNTY CLERK in the
amount of $1,250 (one thousand, two hundred' fifty
dollars) pursuant to AB 3158, Chapter 1706, Statues of
1990. If this fee is imposed, the subject project shall
not be operative, vested or final unless and until the
fee is paid.
