RESOLUTION NO. 3309
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE
PERMIT 94-024, ESTABLISHING A MASTER SIGN PLAN AT
TUSTIN RANCH PLAZA SHOPPING CENTER LOCATED AT
13125-13331 JAMBOREE ROAD
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

A proper application for Conditional Use Permit 94-
024 was filed by Sanderson J. Ray Development
requesting approval of a master sign plan for the
Tustin Ranch Plaza Shopping Center.

Pursuant to Sign Code Section 940466, an applicant
with a project of at least 30,000 square feet of
building area may request to deviate from the
standards contained in the Sign Code, subject to a
conditional use permit.

A public hearing was duly noticed, called, and held
on said application on November 14, 1994, by the
Planning Commission.

Pursuant to Section 9291 of the Tustin City Code,
the Commission finds that the proposed Master Sign
Plan, as conditioned, will not be detrimental to
the health, safety, morals, comfort or general
welfare of persons residing or working in the
general area nor will it be injurious or
detrimental to the property or general welfare of
the City of Tustin as evidenced by the following:
·
The Master Sign Plan, as conditioned, will
provide for signs that are compatible with,
and complimentary to the proposed
architectural design and treatments of Tustin
Ranch Plaza Shopping Center.
·
The locations, proportions, areas, and styling
of the proposed sign types are not injurious
or detrimental to the welfare of the City or
its residents.

Pursuant to Section 9291 of the Tustin City Code,
the Commission finds that the proposed 23 foot high'
pole signs with approximately 300 square feet in
copy area would be detrimental to the health,
safety, morals, comfort and general welfare of
persons residing or working in the general area and

would be injurious or detrimental to the property
or general welfare of the City of Tustin as
evidenced by the following:
·
The Sign Code regulations provide for
effective business identification; ensures
compatibility of proposed signs with the
surrounding environment; and avoids sign
clutter by limiting the size of signs. Sign
Code Section 940462 permits a center
identification pole sign to be a maximum of 20
feet in height with 50 square feet of sign
copy area with a conditional use permit
provided that the signage is compatible with
the size and scale of the project and
surrounding community. However, the character
of the surrounding residential neighborhoods
is of high quality architectural design
enhanced by lush landscaping and low profile
signage where necessary; characteristics which
ensure stable property values. Therefore, a
23 foot high sign is not compatible with the
character of the surrounding area, and would
be detrimental to the surrounding
neighborhood.
·
The fact that the subject shopping center is a
neighborhood commercial facility that will
primarily draw repeat customers from the
surrounding residential neighborhoods
precludes the necessity of a 23 foot high
business identification sign.
·
The proposed pole sign, at 23 feet in height
with approximately 300 square feet of copy
area, is excessive, as described above, and
would create sign clutter, as the additional
area would not be necessary to draw regular
patrons who know of the shopping center's
location from the surrounding residential
neighborhoods. It is evident by examining
signage for other newly developed neighborhood
shopping centers with supermarkets such as
Ralphs's in the south Orange County area that
a 23 foot high business identification pole
sign is not necessary to identify the shopping
center.

Categorically Exempt (Class 11) pursuant to Section
15311 of the California Environmental Quality Act.

Ge
This project has been reviewed for consistency with
the Air Quality Sub-Element of the City of Tustin
General Plan and has been determined to be
consistent or has been conditioned to be consistent
with the Air Quality Sub-Element.
II.
The Planning Commission hereby approves Conditional Use
Permit 94-024 establishing a Master Sign Plan for Tustin
Ranch Plaza Shopping Center subject to conditions
contained in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular meeting of the Tustin Planning
Commission, held on the 14th day of November, 1994.

CONDITIONS OF APPROVAL

GENERAL
(1) 1.1 Ail sign plans shall substantially conform with the plans
date stamped November 14, 1994, on file with the
Community Development Department, as herein modified, or
as modified by the Director of Community Development
Department in accordance with this exhibit. Minor
modifications at working drawings submittal may be
submitted for review and approval by the Director of
Community Development if found to be in substantial
conformance with the approved plans.
(1) 1.2 The applicant shall sign and return an Agreement to
Conditions Imposed form prior to issuance of sign or
building permits for any sign installations under the
provisions of the subject Master Sign Plan.
(1) 1.3 A revised master sign plan incorporating all conditions
of approval contained herein shall be submitted to the
Community Development Department prior to the issuance of
sign permits for any signs within the subject project.
(1) 1.4 The applicant shall 'hold and defend the City of Tustin
harmless for all claims and liabilities arising out of
the City's approval of the entitlement process for this
project.
SIGNS
(1) 2.1 Ail signs shall comply with the applicable provisions of
the Uniform Building Code and the National Electrical
Code as adopted by the City (including UL approvals).
(1) 2.2 Permits shall be required for all signs as necessary.
(1) 2.3 Construction level plans, including any required
structural calculations, for all project signs shall be
submitted, reviewed and approved by the Community
Development Department prior to issuance of sign permits.

(4) 2.4 Center identification signs shall be a maximum of 14 feet
in height with proportionally scaled copy area. Monolith
signs shall be used instead of pole signs.
(4) 2.5 The center identification pole sign on Irvine Boulevard
shall be located behind the sidewalk, within the
landscape setback, 45-feet east of the primary driveway.
The center identification pole sign on Jamboree Road
shall be located behind the sidewalk within the landscape
setback, 170 feet north of the primary (signalized)
driveway.
(4) 2.6 Major tenant primary business identification signs shall
be a maximum of 120 square feet in area, including a
maximum of 36 square feet of supplemental signage.
(4) 2.7 Secondary business identification for Anchor A (Ralph's)
and Anchor C (Payless) major tenant spaces shall be
limited to a maximum of 45.5 square feet, and shall be
located on a secondary elevation.
(4) 2.8 Secondary business identification for Anchor A (Ralph's)
shall not be illuminated.
(4) 2.9 The gasoline service station located on Pad A shall be
(8) limited to one three sided monument/pricing sign
consistent with the requirements of the City of Tustin
Sign Code. The monument sign shall be a maximum of 24
square feet in area per face, and a maximum of six-feet
in height. Pricing information shall be incorporated
within the business identification monument sign, and no
other freestanding pricing signs shall be permitted.
(4) 2.10 Secondary copy for Pad A shall be limited to a total of
50 square feet and may be divided into multiple signs and
be located on the canopy and/or spandral structure
provided that no more than one secondary sign is located
on. the same elevation with exception of spandral on the
same elevation.
(4) Z.ll The gasoline service station located on Pad A shall
(8) provide gasoline pump information consistent with the
requirements of the City of Tustin Sign Code. Said
signage is for the purpose of. providing instructions
only; State and Federal required signs are exempted. Two
gasoline pump information signs shall be permitted per
pump island elevation. Gasoline pump information signs

may be a maximum of two-square feet, attached to pump
island only, not on top of or attached to gasoline pumps.
No advertisement of products, logos or business
identification is allowed. All business identification
signs shall be removed from master sign plan drawings.
(4) 2.~Z The use of theme banners shall be limited to those light
standards indicated on Master Sign Plan item 17, which
are located at the three entries to the shopping center
on Jamboree Road and Irvine Boulevard.
(4) Z.~$ Business identification shall be prohibited from all
theme banners.
(4) Z.~4 Note on item 10 that the maximum primary wall sign area
(8) is 15% of the storefront not to exceed 75 square feet.
(4) Z.~5 Note on item 11 that arcade tenant signs may not exceed
(8) six square feet in area, consistent with the Sign Code.
(4) Z.~6 Note the actual color of the background stucco texture
and the base detail for all of the monument signs on the
revised plans.
FEES
(5) 3.~ Payment of all plan check and permit issuance fees to the
Building Division shall be required prior to the issuance
of sign and building permits.
*** 3.2 Within forty-eight (48) hours of approval of the subject
(5) project, the applicant shall deliver to the Community
~ Development Department, a cashier's check payable to the
COUNTY CLERK in the amount of $25.00 (twenty five
dollars) pursuant to AB 3158, Chapter 1706, Statues of
1990, to enable the City to file the Notice of
Determination required under Public Resources Code
Section 21152 and 14 Cal. Code of Regulations 15075. If
within such forty-eight (48) hour period that applicant
has not delivered to the Community Development Department
the above-noted check, the approval for the project
granted herein shall be considered automatically null and
void.
