HomeMy WebLinkAboutPC RES 32981 RESOLUTION NO. 3298 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I · A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING SIGN CODE EXCEPTION 94-005 REQUESTING AN EXCEPTION FROM TUSTIN CITY CODE SECTION TO ALLOW BALLOONS AND OFF-SITE ADVERTISING IN CONJUNCTION WITH A HOT AIR BALLOON FESTIVAL TO BE HELD SEPTEMBER 22-25, 1994 LOCATED ON LOT 27 OF TRACT 13627. The Planning Commission finds and determines as follows: A· That a proper application for Sign Code Exception 94-005 was filed by Korff Enterprises, Inc. requesting a Sign Code Exception from the Sign Code to allow hot air balloons and cold air inflatable balloons and off site advertising in conjunction with a hot air balloon festival to be held September 22-25, 1994 located on Lot 27 of Tract 13627 Be Pursuant to City of Tustin Sign Code Section 9405c, approval of the request to authorize an exception to the Sign Code can be supported by the following findings: · Sign size and placement restrictions of the Siqn Code shall be followed as closely as practicable;. While under the definition of the Sign Code, the hot air and cold air inflatable balloons would be considered aerial signs, the restrictions of the Sign Code would be followed as closely as practical by limiting all balloons to the event site, except for the hot air balloons which would leave the site at various times throughout the event and which is inherent with a hot air balloon festival. Site Facility Signs would conditioned to be consistent with those permitted within the East Tustin Specific Plan area and limited to the main event site (Lot 27 of Tract 13627). The proposed Promotional signs would be not be consistent with sign placement and has been conditioned to be eliminated. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution 3298 Page 2 · · · , The intent and purpose of the siqn requlations of the land use zone in which the siqn is located shall be followed as closely as practicable; Confining all off-site advertising to the event grounds, except for directional signs which may be part of the Parking/Traffic Management Plan approved by the Engineering Division, would be consistent with past practice related to specific events such as the Taste of Tustin, Dinosaur Dash, Chili Cook-Off and Tiller Days. This includes the proposed Site Facility Signs and Promotional Signs. There are special circumstances unique to the property which justify the Exception; Since this property is vacant, there are not buildings or structures which could be used to locate signs. The event is temporary in nature and all signs would be removed upon completion of the event. Grantinq of the Exception will not have a neqative impact on surrounding properties; As previously mentioned, the event is temporary in nature and all signs would be removed upon completion of the event. All signs related to the event would be confined to the event site as previously noted. The sign application promotes the public health, safety, welfare and aesthetics of the community and that the qrantinq of the exception meets the findinqs and intent of this chapter (Sign Code). By confining the signs to the event site, the public health, safety, welfare and aesthetics would be protected to minimize sign clutter. II. The Planning Commission hereby approves Sign Code Exception 94-005 requesting a Sign Code Exception from the Sign Code to allow hot air balloons and cold air inflatable balloons with advertising in conjunction with a hot air balloon festival to be held September 22-25, 1994 located on Lot 27 of Tract 13627, subject to the conditions contained in the attached Exhibit A attached hereto. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution 3298 Page 3 PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular meeting on the 22nd of August, 1994. Recording Secretary EXHIBIT A RESOLUTION NO. CONDITIONS OF APPROVAL SIGN CODE EXCEPTION 94-005 GENERAL (1) 1.1 The proposed project shall substantially conform to submitted plans date stamped September 22, 1994, on file with the Community Development Department as herein modified or as modified by the Director of Community Development. In accordance with this Exhibit, the Director of Community Development may also approve subsequent minor modifications to plans during sign design review/plan check if such modifications are determined consistent with the approved plans. (1) 1.2 Unless otherwise specified, all conditions in this exhibit shall be complied with prior to issuance of any building permits for the project, subject to review and' approval by the Community Development Department. (1) 1.3 Approval of Sign Code Exception 94-005 is contingent upon the applicant, Korff Enterprises, Inc., signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.4 The applicant shall hold and defend the City of Tustin harmless for all claims and liabilities out of City's approval of the entitlement process for this project. SIGN RESTRICTIONS *** 2.1 Ail signs which advertise the event shall be located on Lot 27 of Tract 13627, except those signs that may be required for directional purposes in conjunction with an approved Traffic/Parking Management Plan approved by the Engineering Division. *** 2.2 The Site Facility signs shall not exceed 96 square feet in size and be limited to one sign per each street frontage of the main event site (Lot 27 of Tract 13627). *** 2.3 Booths within the main event grounds (Lot 27 of Tract 13627) may display any kind of signs and banners. No fees are required. No fees required. *** 2.5 Ail signs related to the event shall be removed within three (3) days after the conclusion of the event. PLAN SUBMITTAL (3) 3.1 At Building Plan Check/Sign Design Review, three (3) sets of construction plans and two (2) sets of structural calculations for the site facility signs shall be submitted. Structural calculations for the foundation/footing design of the Site Facility Signs shall also be provided. FEES (1) 4.1 Prior to issuance of any building permits, payment (3) shall be made of all applicable building plan check and permit fees to the Community Development Department.
