HomeMy WebLinkAboutPC RES 32931 RESOLUTION NO. 3293 10 11 12 13 14 15 16 17 IS 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE EXCEPTION 94-004, A REQUEST TO ALLOW A MASTER SIGN PROGRAM CONTAINING DEVIATIONS FROM THE TUSTIN SIGN CODE FOR THE BUILDING LOCATED AT 730 EL CAMINO WAY, TUSTIN The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: ae That a proper application, Sign Code Exception 94-004, has been filed by Marshall Krupp, requesting a Sign Code Exception from the City of Tustin Sign Code to allow a master sign program containing deviations from the Sign Code. Be Pursuant to City of Tustin Sign Code Section 9405C, the request to allow a master sign program containing deviations from the Code can be supported by the following findings: Siqn size and placement restrictions of the Siqn Code shall be followed as closely as practicable in that the proposal includes one (1) building identification wall sign of approximately 74 square feet, a maximum of six (6) business identification wall signs of 30 or 36 square feet each, and one (1) tenant directory/center identification monument sign of 25 square feet. The total area of the proposed signs equals a maximum of approximately 310 square feet. The sizes of all of the proposed signs are within the maximums allowed by the Sign Code for monument signs and wall signs. The size of the business identification wall signs is designed for ease of visibility for freeway motorists and is less than one half of the size of individual business identification allowed for buildings in Commercial Districts. The building identification wall sign is approximately equal to the maximum size sign allowed for business identification wall s~gns in Commercial Districts. All of the signs are in scale with the mass of the building elevation on which they are proposed. Given the architectural features and orientation of 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3293 Page 2 · the building, and the elevation of the adjacent freeway, the placement of the proposed wall signs is restricted to those few locations which are able to accommodate signage and provide effective exposure. As a result, some of signs would not be located on a primary or secondary wall of the identified tenant. One of the potential locations of the proposed monument sign is within five (5) feet of the south property line because of the potential for the reconfiguration of E1 Camino Way which would significantly limit the positioning of the proposed monument sign. The proposed setback of the monument sign from the southerly property line is justified considering the limited street frontage of the property and the absence of adjacent development to the south. The intent and purpose of the sign regulations of the land use zone in which the siqn is located shall be followed as · closely as. practicable in that the intent and purpose of the sign regulations will be followed as closely as practicable in that the proposed signage would maintain the City's appearance by following a strict master sign plan, effectively identifying the office building tenants, and maintaining the visibility and effectiveness of on- premises signs. There are special circumstances unique to the property which justify the Exception in that the office building is located on a street which no longer permits through traffic as a result of the widening of the Interstate 5 Freeway, thereby limiting the visibility of signage from the street and creating the need for exceptions from the criteria contained in the City's Sign Code. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3293 Page 3 · Grantinq of the Exception will not have a negative impact on surroundinq properties in that the exception would allow the installation of business identification wall signs and a building identification wall sign which are smaller than the signage permitted by the City's Sign Code for buildings in Commercial Districts. In addition, the signs will be primarily oriented toward the Interstate 5 Freeway, rather than toward other properties. · The sign application promotes the public health, safety, welfare and aesthetics of the community and that the granting of the exception meets the findings and intent of this chapter (Siqn Code) in that the proposed signs would follow a. master sign plan to ensure coordinated and quality sign design and would have a copy area which is significantly less than the area of sign copy allowed for buildings in Commercial Districts thereby promoting the welfare of the community and meeting the findings and intent of the Sign Code. Ce This project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15311 (Class ii). II. The Planning Commission hereby approves the request to allow a master sign program containing deviations from the Code at the office building located at 730 E1 Camino Way, Tustin, subject to conditions contained in Exhibit A, attached hereto. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3293 Page 4 PASSED AND ADOPTED at a regular Planning Commission meeting on the 12th day of September, 1994. Recording Secretary EXHIBIT A RESOLUTION 3293 CONDITIONS OF APPROVAL SIGN CODE EXCEPTION 94-004 GENERAL (1) 1.1 The proposed project shall substantially conform to submitted plans date stamped September 12, 1994, on file with the Community Development Department as herein modified or as modified by the Director of Community Development. In accordance with this Exhibit, the Director of Community Development may also approve subsequent minor modifications to plans during sign design review/plan check if such modifications are determined consistent with the approved plans. (1) 1.2 Unless otherwise specified, all conditions in this exhibit shall be complied with prior to issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Sign Code Exception approval shall become null and void unless a sign permit and building permit are issued for the monument sign and construction of the monument sign is completed within twenty four (24) months of the date of this exhibit. Time extensions may be granted by the Director of Community Development if a written request is received by the Community Development Department within thirty (30) days prior to expiration. (1) 1.4 Approval of Sign Code Exception 94-004 is contingent upon the applicant/property owner signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The developer shall hold and defend the City of Tustin harmless for all claims and liabilities out of City's approval of the entitlement process for this project. (4) 1.6 Ail signs not covered by this action shall conform to the City of Tustin Sign Code including window signs which shall not exceed 25% of glass area upon which the sign is located. (4) 2.2 There is one area on the south elevation of the building in which several of the wall signs are proposed to be located in close proximity to each other. This grouping of signs shall contain either two (2) signs or four (4) signs to maintain the symmetry of the sign placement. (4) 2.3 Each tenant shall be limited to business identification on the monument sign and on one (1) wall sign only. A maximum of one (1) tenant which is affiliated with the CSA logo shall be permitted to have business identification. Additional business identification for any other tenants which are affiliated with the CSA logo shall be prohibited. The total number of business identification wall signs shall be limited to the number of tenants occupying the building up to a maximum of six (6) signs. In the event that fewer than six (6) business identification signs are being used at any one time, any blank sign cans shall have installed a blank opaque sign panel which is textured and colored the same as the background of the other tenant sign panels. The lighting of the unused sign cans shall be disconnected to preclude any shadows or unnecessary background light. All areas where sign cans are removed and background discoloration or holes remain shall be appropriately patched and painted to match the building surface within thirty (30) days of removal of said sign can. Initially, only those sign panels and sign cans for tenants occupying the building as of the date of this exhibit shall be placed on the building. Additional sign cans shall be permitted to be installed as additional tenants occupy the building. (4) 2.4 In the event of a name change, the design of the letters in the monument sign and the individual channel letters contained within the building identification sign may be altered, but would be subject to the maximum copy si.zes established in the master=sign plan and would be subject to review and approval by the Community Development Department. (4) 2.5 The address numbers on the building shall be six (6) inches in height.. Exhibit A - Conditions of Approval Sign Code Exception 94-004 Resolution No. 3293 Page 3 PLAN SUBMITTAL (3) 3.1 At Building Plan Check/Sign Design Review, three (3) sets of construction plans and two (2) sets of structural calculations shall be submitted. Structural calculations for the foundation/footing design of the monument sign shall also be provided. (4) 3.2 Submit at Plan Check/Sign Design Review a landscape/ irrigation plan for the monument sign landscape area. If existing landscaping is proposed to be used, please provide this information on the plans at plan check. Provide a plant table which lists botanical and common names, sizes, spacing, actual location and quantity of the plant materials proposed and/or existing. FEES (1) 4.1 Prior to issuance of any building permits, payment (3) shall be made of all applicable building plan check and permit fees to the Community Development Department. (1) 4.2 Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the County Clerk, in the amount of $25.00 (twenty-five dollars) to enable the City to file with the County Clerk, the appropriate environmental documentation pursuant to the California Environmental Quality Act. If within such forty eight (48) hour period, the applicant has not delivered to the Community Development Department the above noted check, the approval for the project granted herein shall be considered automatically null and void. In addition, should the Department of Fish and Game reject the Certificate of Fee Exemption filed with the environmental determination and require payment of fees, the applicant shall deliver to the Community Development Department within forty eight (48) hours of notification, a cashier's check payable to the County Clerk in the amount of $850.00 (eight hundred fifty dollars) if an EIR was prepared or $1,250 (twelve hundred fifty dollars) if a Negative Declaration was prepared. If this fee is imposed, the subject project shall not be operative, vested or final unless and until the fee is paid. SR:br
