HomeMy WebLinkAboutPC RES 327610 11 12 13 14 15 16 17 18 19 2O 21 22 23 24 25 26 27 28 RESOLUTION NO. 3276 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING VARIANCE 94-006 TO REDUCE THE REQUIRED NUMBER OF PARKING SPACES FROM FO%~TEEN (14) SPACES TO ELEVEN (11) SPACES ON THE PROPERTY LOCATED AT 13922 RED HILL AVENUE, TUSTIN. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application, Variance 94-006, has been filed by Mr. A1 Swearingen to reduce the required the required number of parking spaces from fourteen (14) spaces to eleven (11) spaces on the property located at 13922 Red Hill Avenue, Tustin. Bo That a public hearing was duly noticed, called and held by the Planning Commission on June 13, 1994. Ce The Planning Commission has reviewed the subject request for a variance to reduce the required number of parking spaces and has made the following findings: · Granting the variance shall not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and district in which the project is situated in that many other properties in the vicinity do not provide parking which meets city requirements, and that the proposed facility requires more parking than some other auto service facilities because of the large basement from which the automobiles are often serviced from and which is restricted to employees. · There are unusual or exceptional circumstances applicable to the property, including size, shape, topography, location or surroundings which deprive the subject property of' privileges enjoyed by other properties in the area in that the future proposed widening of both Red Hill Avenue and E1 Camino Real will reduce the size of the property by approximately 2,000 square feet, denying the property of land available for parking purposes. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3276 Page 2 De A Negative Declaration has been prepared and certified for this project in accordance with the provisions of the California Environmental Quality Act. II. The Planning Commission hereby approves Variance 94-006 to reduce the required numbe~ of parking spaces from fourteen (14) spaces to eleven (11) spaces on the property located at 13922 Red Hill Avenue, Tustin, subject to the conditions contained in Exhibit A of Planning Commission Resolution No. 3275, incorporated herein by reference.
