HomeMy WebLinkAboutPC RES 32721 RESOLUTION NO. 3272 6 10 11 12 13 14 15 16 17 18 ~0 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE EXCEPTION 94-002, A REQUEST TO INCREASE THE MAXIMUM ALLOWABLE SQUARE FOOTAGE OF TENANT IDENTIFICATION SIGNAGE ON A TENANT DIRECTORY MONUMENT SIGN LOCATED AT 17662 SEVENTEENTH STREET, TUSTIN The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: ae That a proper application, Sign Code Exception 94-002, has been filed by John McKinney, on behalf of The Vons Companies requesting a Sign Code Exception from the City of Tustin Sign Code to permit a tenant identification sign to be 15 square feet in size, rather than the maximum of 6 square feet permitted for a tenant directory on a monument sign. B® Pursuant to City of Tustin Sign Code Section 9204C, the request can be supported by the following findings: l· ~iqn..size .and placement restrictions of the Siqn Code shall be followed as closely as practicable; The total size of the monument sign is 39 square feet, 48% less than the maximum permitted by the Sign Code. The size of tenant copy, size, location and placement of the sign are as close as practical to the code requirements. The monument sign is proposed to be 6 feet.in height and there will be a minimum of 150 feet of separation from the two existing monument signs within the center. The Sign Code requires a minimum of 50 feet of separation, and a maximum height of 6 feet. The two other tenant identification signs proposed for this directory sign meet the Sign Code limit of 6 square feet in size. The proposed 15 square foot Vons sign is 38% of the total sign area of the proposed monument sign and follows the sign Code requirements as close as practical. e The intent and purpose of the sign regulations of the land use zone in which the sign is located shall be followed as closely as practicable; The size, number, location and type of sign meet the intent and purpose of the sign regulations as closely as practical. The proposed sign would maintain the City's appearance by avoiding sign 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3272 Page 2 clutter, effectively identifying the business names, and maintain the visibility and effectiveness of on-premise signs, while limiting the number and area of signs. · There are special circumstances unique to the property which justify the Exception; There are special circumstances unique to the property which justify the request to deviate from the size limitation on one of the tenant identification signs. The placement of the main building on the site at approximately 246 feet from Seventeenth Street reduces the visibility of the existing Vons wall sign. The location of two large pad buildings adjacent to Seventeenth Street and the mature trees within the front landscaped area further limits visibility of the tenant. Since Vons is the largest tenant (31,000 square feet) within the center, the proposed 15 square foot sign is proportionate to their use. This will not set a precedent due to these unique circumstances. · Grantinq of the Exception will not have a negative Limpact on surrounding properties; Granting of a Sign Code Exception to exceed the size limitation for a tenant identification sign on a monument.sign will not have a negative impact on the surrounding properties. The exception would allow the installation of a tenant sign that is readily visible and easily readable. The monument sign is well below the maximum of 75 square feet sign area limit of the Sign Code. The sign is in scale with the center, identification monument sign and proportionate to the size of the tenant space. The tenant sign is appropriate to the type of activity on the site and will not contribute to sign clutter. · The si~n application promotes the public health, safety, welfare and aesthetics of the community and that the granting of the exception meets the findinqs and intent of this chapter (Sign Code), The proposed Sign Code Exceptions from the size limit for tenant identification signage on a center monument sign promotes the public health, safety, welfare and aesthetics of the community. The proposed monument sign is less than the maximum size permitted by Code. In addition, the monument sign could include more than three tenant identification signs, which would be more cluttered looking and less aesthetically pleasing. The 10 ll 12 13 14 Resolution No. 3272 Page 3 Ce overall appearance would minimize sign clutter and thus increase the effectiveness of signage for not only this business but also adjacent businesses. By having less text on this center monument sign, the copy will be more readable and less intrusive to the surroundings. This project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15311 (Class 11). II. The Planning Commission hereby approves the request to exceed the permitted signage for Vons identification on the center monument sign located at 17662 Seventeenth Street, Tustin, subject to conditions contained in Exhibit A, attached hereto. In accordance with this Exhibit, the Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are determined consistent with the approved plans. (1) 1.2 Unless otherwise specified, all conditions in this exhibit shall be complied with prior to issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Sign Code Exception approval shall become null and void unless sign permits and all construction is completed within twelve (12) months of the date of this exhibit. 1) 1.4 Approval of Sign Code Exception 94-002 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The applicant shall hold and defend the City of Tustin harmless for all claims and liabilities out of City's approval of the entitlement process for this project. (4) 1.6 Ail signs not covered by this action shall conform to the City of Tustin Sign Code .including window signs which shall not exceed 25% of glass area upon which the sign is located. Provide continuous foundation under masonry wall of the monument sign and provide structural calculations for the foundation/footing design. FEES (1) 3.1 Prior to issuance of any building permits, payment (3) shall be made of all applicable sign design review, environmental notice of exemption and building plan check and permit fees to the Community Development Department.
