HomeMy WebLinkAboutPC RES 32701 2 3 4 5 6 7 8 9 10 11 12 13 14 15 I 16 17 18 19 20 21 22 23 24 25 26 27 RESOLUTION NO. 3270 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING VARIANCE 94-004 TO INCREASE THE HEIGHT OF THE TWENTY FOOT (20') HIGH SCREEN FENCE ON BOTH SIDES OF THE DRIVING RANGE ON THE TUSTIN RANCH GOLF COURSE LOCATED AT 12442 TUSTIN RANCH ROAD TO FIFTY FEET (50') IN HEIGHT LOCATED 50 TO 150 FEET FROM THE TEE BOXES FOR SAFETY PURPOSES. The Planning Commission of the City of Tustin does hereby resolve as follows: ~ I. The Planning Commission finds and determines as follows: A. That a proper application, Variance 94-004, has been filed by Golf Course Enterprises Inc. on behalf of Sanyo Foods Corp. of America to increase-the height of the twenty foot (20') high screen fence on both sides of the driving range on the Tustin Ranch Golf Course located at 12442 Tustin Ranch Road to fifty feet (50') in height 150 feet from the tee boxes for safety purposes. B. That a public hearing was duly noticed, called and held by the Planning Commission on June 13, 1994, continued to the June 27, 1994, and the July 25, 1994 meeting of the Planning Commission; and that a public hearing was again duly noticed, called and held on August 8, 1994 by the Planning Commission. C. The Planning Commission has reviewed the subject request for a variance to increase the height of the twenty foot (20') high screen fence on both sides of the driving range on the Tustin Ranch Golf Course to fifty feet (50' ) in height and has made the following findings: 1. The applicant requests to increase the fence height from twenty feet (20') to fifty feet (50') and located 50 to 150 feet from the tee box to preclude the chance of stray golf balls hit over the fence and injuring golfers on the adjacent fairways for the 12th and 18th holes. This precaution would be in the best interest of golfers and the general public as it could prevent unnecessary injury. The variance is not a grant of special privilege, as many golf courses in the region utilize approximately 50 foot high fences to ensure the safety of golfers and pedestrians. 5 10 11 12 13 14 15 16 17 -- 18 '9 20 21 22 23 24 25 26 27 Resolution No. 3270 August 8, 1994 Page 2 · Two public work study sessions have been held to refine the design of the fence in order to mitigate concerns related to the increase height of the fence of nearby residents. Concessions have been made by the applicant, including decreasing the proposed height where possible, and utilizing materials that would require fewer fifty foot high poles than originally requested. Furthermore, as proposed, the 50 foot high fence would be screened by various trees at a rate of one tree per every 17.675 feet of fence. · As the driving range is located between two fairways, the chance that stray golf balls would hit a pedestrian is great. Therefore, the strict application of the height limitation deprives the property owner from protecting golfers and pedestrians on the adjacent fairways. De This project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to section 15304 (Class 4). II. The Planning Commission hereby approves Variance 94-004 to increase the height of the twenty foot (20') high screen fence on both sides of the driving range on the Tustin Ranch Golf Course located at 12442 Tustin Ranch Road to fifty feet (50') in height located 50 to 150 feet from the tee boxes for safety purposes, subject to the conditions contained in Exhibit A attached hereto. Recording Secretary E~IBIT A RESOLUTION NO. 3270 CONDITIONS OF APPROVAL VARIANCE 94-004 GENERAL (1) 1.1 The proposed project shall substantially conform to submitted plans date stamped August 8, 1994 on file with the Community Development Department as herein modified, or as modified by the Director of the Community Development Department in accordance with this Exhibit. The Director may also approve minor modifications to the plans if such modifications are determined to be consistent with the approved plans. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Variance approval shall become null and void unless all building permits have been issued within twelve (12) months of the date of this Exhibit and substantial construction is underway. Time extensions may be granted by the Planning Commission if a written request is received by the Community Development Department within thirty (30) days prior to expiration. (1) 1.4 Approval of Variance 94-004 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The applicant shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of the City's approval of the entitlement process for this project. (4) 1.6 Fence materials shall be maintained in good repair at all times. Ail tears shall be repaired or torn sections shall be replaced immediately. SOURCE CODES (1) STANDARD CONDITIONS (2) . Provide structural calculations and details for the fence structure. PLAN SUBMITTAL (4) 3.1 The driving range fence shall be located and designed as follows: a. The pole locations along the length of the driving range shall be located inside of the existing 20 foot high chain link fence of the driving range. Be The poles shall be located 150 feet from the tee boxes at both ends of the driving range. C. The proposed fencing shall start at a point 50 feet from the tee boxes at both ends of the driving range, and rise along a guy wire at an angle to the 50 foot high pole located 150 feet from the tee box as required above. De The proposed poles shall be constructed of concrete and include a natural color, exposed aggregate finish. The poles shall be spaced between 70 and 100 feet apart. (4) 3.2 Submit at plan check complete detailed landscaping and irrigation plans for all landscaping areas consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide summary table identifying plant materials. The plant table shall list botanical and common names, sizes, spacing, location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control of all backflow prevention devices, pipe size, sprinkler type, spacing' and coverage for to adequately maintain new planting materials. Details for all additional equipment must be provided. The Community Development Department may request minor substitutions of plant materials or request additional sizing or quantity materials during plan check. Note on landscaping plan that coverage of landscaping and irrigation materials is subject to field inspection at project completion by the Department of Community Development. Exhibit A Resolution No. 3270 Page 3 *** $.3 A minimum of 12 additional Mondell Pines shall be planted along the 12th fairway adjacent to the driving range fence, and a minimum of 12 additional Mondell Pines shall be planted a~ong the 18th fairway adjacent to the driving range fence. Said trees shall be a minimum of 36 inch box in size. Proposed location of trees shall be staked by the applicant upon completion of the 50 foot high driving range fence. Proposed location shall be approved within 72 hours of the applicant's notification to the City that the trees have been staked by a participant of the July 27, 1994 work study session, subject to final approval of the Community Development Department. FEES (3) 4.1 The following fees, but not limited to, shall be required as part of this project prior to issuance of permits: a · Plan check and permit fees to the Community Development Department. be New Development Tax to the Community Development Department, as applicable. C· School fees to the Tustin Unified School District, as applicable. (3) 4.2 Payment of the Foothill/Eastern Transportation Corridor fees to the Engineering Division will be required at the time a building permit is issued, applicable.
