HomeMy WebLinkAboutPC RES 32661 RESOLUTION NO. 3266 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE EXCEPTION 94-001, A REQUEST TO INCREASE THE NUMBER OF SIGNS AND REDISTRIBUTE THE MAXIMUM ALLOWABLE SQUARE FOOTAGE OF PRIMARY AND SECONDARY BUSINESS IDENTIFICATION WALL SIGNS LOCATED AT 135 SOUTH PROSPECT AVENUE, TUSTIN The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application, Sign Code Exception 94-001, has been filed by Dennis Stout on behalf of Tustin Tire and Brake requesting a Sign Code Exception from the City of Tustin Sign Code to permit: . Two additional primary signs facing onto First Street (Sign "C"- a new supplemental sign for the north side of Building #1 identifying "Automotive Repair" and Sign "E" - a new business identification sign proposed to be located on an existing trellis with a product name); . Three additional secondary signs facing onto Prospect Avenue (two of Sign "C" - supplemental signs for the west side of Building #1, each identifying "Complete Automotive Repair" and Sign "B" - a new business identification sign located on the west side of Building #1 with a product name; . Three separate supplemental signs (Sign "C") to be located on Building #1; , 89 square feet of primary signage, both business identification and supplemental information (Sign "C" and "D" on Building #1 and Sign "E" on the trellis) when the limit is 75 square feet; , 52.6 square feet of secondary signage (one Sign "B" and two Sign "C") when the limit is 25 square feet; . A product name on Signs "A", "B", "E", and "F" on Building #1, the trellis and the proposed monument sign, when not part of the business name; and o A monument sign for a business with 134 feet of street frontage when the Sign Code requires a minimum of 150 feet of street frontage 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3266 da ~ 2 m o Pursuant to City of Tustin Sign Code Section 9204C, the request can be supported by the following findings: Sign size and placement restrictions of the Sign Code shall be followed as closely a~ practicBble; The total wall sign area of the applicant's proposal plus staff recommended modifications is 125 square feet and equals the total allowed by the Sign Code. The number of signs, size of supplemental copy and length of street frontage are as close as practical to the code requirements. The site includes two buildings that are low profile and in character with the goals of the First Street Specific Plan. Given the architecture of the existing buildings, there is insufficient wall space to accommodate only three wall signs, and the supplemental signs appear more balanced separated from the business identification signs. The size and height of the monument sign meets the code requirements. The street frontage is only 11% less than the 150 feet requirement, a minor amount. The existing business identification on the First Street monument sign is ineffective due to designa nd location and is often blocked by illegal temporary signage. , The intent and purpose of the sign regulations of the land use zone in which the sign is located shall be followed as closely as practicable; The size and number of signs, supplemental copy signs and length of street frontage meets the intent and purpose of the sign regulations as closely as practical. The proposed signs would maintain the City's appearance by avoiding sign clutter, effectively identifying the business, name and services and maintaining the visibility and effectiveness of on-premise signs, while limiting the number and area of signs. · There are special circumstances unique to the property which justify the Exception; There are special circumstances unique to the property which justify the request to deviate from the number and size limitations on identification and supplemental signs and to have less than the required street frontage. The design and placement of the two buildings on the site hinders the applicant's ability to meet the specific requirements of the sign code. The buildings were designed to be low profile and pedestrian in scale with numerous windows, in order to be consistent 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3266 Page 3 with the First c-~et Specific Plan. As a result, supplemental signs need to be separated from business identification signs to increase their visibility. Additional secondary sign area is needed to ensure that the sign is readable since the building is separated from Prospect Avenue by a parking area. Granting of the Exception will not have a negative impact on surrour, dinq properties; Granting of the Exception for number and size limits, separate supplemental signs and a monument sign with less than the required street frontage will not have a negative impact on the surrounding properties. The exception would allow the installation of business identification signs that are readily visible and do not exceed the total sign area limits of the Sign Code. The signs are in scale with the building design and proportionate with available wall space. They are appropriate to the type of activity on the site and will not contribute to sicn clutter. The size and location and design of the monument sign is consistent with the code requirements and there is adequate separation between adjoining monument signs. The purpose for establishing a minimum street frontage was to minimize sign clutter and prevent freestanding si_~ns to be located on small frontages. · The siqn application promotes the public health, safety, welfare ~nd aesthetics of the community and that the granting of the exception meets the findings and intent of this chapter (Sign Code). The proposed Sigr. Code Exceptions from the size and number limit for identification signs, separate supplemental signs and street frontage limits for monument signs promotes the public health, safety, welfare and aesnhetics of the community. The proposal would effectively distribute the total permitted square footage of sign copy on four different elevations of the two buildings thereby reducing the amount of signage visible at any one time. The overall appearance would minimize sign clutter and thus increase the effectiveness of signage for not only this business but also adjacent businesses. The supplemental signs will be more easily read and will coordinate with existing signage on the site. There is adequate separation between existing monument signs in the area and the proposed monument sign. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3266 Page 4 6. Product Name. The proposal to include a product name in a business identification sign when not a part of the business name is justified in that the business is an authorized Goodyear dealer and as such Goodyear does permit sign identification. However, Tustin Tire & Brake's contract with Goodyear prohibits the use of "Goodyear" as part of the business name. The product name has been incorporated into the business name signage and appears no different than if it were legally part of the business name. The product name will not negatively impact surrounding areas since the size and design of the sign meets code limits and is in character with the goals of the First Street Specific Plan. Ce This project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15311 (Class 11). II. The Planning Commission hereby approves the request to modify the permitted signage for the auto service business located at 135 S. Prospect Avenue, Tustin, subject to conditions contained in Exhibit A, attached hereto. Recording Secretary SJP:br EXHIBIT A RESOLUTION 3266 CONDITIONS OF APPROVAL SIGN CODE EXCEPTION 94-001 GENERAL (1) 1.1 The proposed project shall substantially conform to submitted plans date stamped May 23, 1994, on file with the Community Development Department as herein modified or as modified by the Director of Community Development. In accordance with this Exhibit, the Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are determined consistent with the approved plans. (1) 1.2 Unless otherwise specified, all conditions in this exhibit shall be complied with prior to issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Sign Code Exception approval shall become null and void unless sign permits and all construction is completed within twelve (12) months of the date of this exhibit. 1) 1.4 Approval of Sign Code Exception 94-001 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The applicant shall hold and defend the City of Tustin harmless for all claims and liabilities out of City's approval of the entitlement process for this project. (4) 1.6 Ail signs not covered by this action shall conform to the City of Tustin Sign Code including window signs which shall not exceed 25% of glass area upon which the sign is located. PLAN SUBMITTAL (3) 2.1 At Building Plan Check/Sign Design Review, please submit three (3) sets of construction plans and two (2) sets of structural calculations. Provide continuous foundation under masonry wall of the monument sign and provide structural calculations for the foundation/footing design. (4) 2.2 Sign "E" shall be eliminated. In addition, one of the Sign "C" on the west side of Building #1 shall be removed and Sign "B" may be increased in size up to a maximum of 24.25 square feet. FEES (1). 3.1 Prior to issuance of any building permits, payment (3) shall be made of all applicable sign design review, environmental notice of exemption and building plan check and permit fees to the Community Development Department.
