A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CONDITIONALLY APPROVING CONDITIONAL USE
PERMIT 93-033 AUTHORIZING A 436 UNIT CONDOMINIUM
DEVELOPMENT TO BE LEASED AS APARTMENTS PURSUANT TO
SECTION 3.6.2.A OF THE EAST TUSTIN SPECIFIC PLAN ON
TRACT 14447
The Planning Commission of the City of Tustin does hereby
resolve as follows: ,,
I. The Planning Commission finds and determines as follows:

That a proper application, Conditional Use Permit
93-033, has been filed by Irvine Apartment
Communities to request authorization to lease a 43.6
unit condominium development as apartments pursuant
to Section 3.6.2.A of the East Tustin Specific Plan
on Tract 14447.

That a public hearing was duly called, noticed and
held on said application on April 25, 1994, by the
Planning Commission.

That establishment, maintenance and operation of
the use applied for will not, under the
circumstances of this case, be detrimental to he
health, safety, morals, comfort, or general welfare
of the, persons residing or working in the
neighborhood of such proposed use, nor.detrimental
to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin as evidenced
by the following:

The proposed development is proposed to be
developed consistent with the development
standards for condominiums as provided for by
the East Tustin Specific Plan which exceed the
minimum development standards for apartments.

The proposed project is consistent with the
East Tustin Development Agreement which
authorizes a maximum of 25% of the total units
authorized within the East Tustin Specific
Plan, including the Phase I residential area,
to be developed with apartment units.

The proposed development has been designed to
provide additional covered parking in
accordance with the requirements for
condominiums as specified in the East Tustin
Specific Plan if the apartments are converted
to condominiums in the future.

II. The Planning Commission hereby approves Conditional Use
Permit No. 93-033 authorizing a 436 unit condominium
.project to be leased as apartments pursuant to Section
3.6.2.A of the East Tustin Specific Plan on Tract 14447,
subject to the conditions contained .in Exhibit A of
Planning Commission Resolution No's. 3249 and 3251.
PASSED AND ADOPTED by the Planning Commission of the City of
Tustin, at a regular meeting on the 25th day of April, 1994.
