HomeMy WebLinkAboutPC RES 32345 10 11 12 13 14 15 16 17 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 3234 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE EXCEPTION 93-005, A REQUEST TO REDISTRIBUTE THE MAXIMUM ALLOWABLE SQUARE FOOTAGE OF PRIMARY AND SECONDARY BUSINESS IDENTIFICATION WALL OR CANOPY SIGNS LOCATED AT 14122 NEWPORT AVENUE, TUSTIN The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ao That a proper application, Sign Code Exception 93- 005, has been filed by Robert Fiscus and Associates on behalf of Chevron U.S.A., Inc. requesting a Sign Code Exception from the City of Tustin Sign Code to allow the redistribution of the maximum allowable square footage of primary and secondary business identification wall or canopy signs. Be Pursuant to City of Tustin Sign Code Section 9204C, the request to redistribute the maximum allowable square footage of primary and secondary business identification wall or canopy signs can be supported by the following findings: · Siqn size and placement restrictions of the Siqn Code shall be followed as closely as practicable; in that the total sign area of the proposed signs, excluding the one pole sign to remain, totals 88.1 square feet and is significantly less than that allowed by the Sign Code. The proposal includes one (1) existing 11.7 square foot wall sign, one (1) 32 square foot monument sign, two (2) 2.6 square foot placard mounted canopy signs, four (4) 7.9 square foot channel letter canopy signs and four (4) 1.9 square foot spanner decals. The total size of the wall sign, canopy signs and spanner decals is approximately seventy (70) square feet less than the 125 square feet of primary and secondary business identification allowed for the service station. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3234 Page 2 · The intent and purpose of the sign regulations of the land use zone in which the siqn is located shall be followed as closely as practicable; in that the proposed sigD changes would maintain the City's appearance by reducing sign clutter, effectivel~ identifying the service station, and maintaining the visibility and effectiveness of on-premises signs, while limiting the area of signs. · There are special circumstances unique to the property to justify the Exception; in that the service station contains several nonconforming signs which would be removed upon installation of the decals, canopy signs and monument sign. · Granting of the Exception will not have a neqative impact on surrounding properties; in that the exception would allow the installation of spanner decals and canopy signs which are smaller than the existing signs or replace other signs. A condition of approval has been included which prohibits the illumination of the new Level II Spanners, thereby reducing the possibility for negative impacts on surrounding properties. · The sign application promotes the public health, safety, welfare and aesthetics of the community and that the granting of the exception meets the findings and intent of this chapter (Siqn Code)j; in that the proposed sign changes would effectively reduce the total square footage of sign copy at the service station. Co This project is Categorically Exempt from the requirements of the California Environmental Quality Act, pursuant to Section 15311 (Class 11). II. Recording Secretary SR:br EXHIBIT A RESOLUTION 3234 CONDITIONS OF APPROVAL SIGN CODE EXCEPTION 93-005 GENERAL (1) 1.1 The proposed project shall substantially conform to submitted plans date stamped February 14, 1994, on file with the Community Development Department as herein modified or as modified by the Director of Community Development. In accordance with this Exhibit, the Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are determined consistent with the approved plans. (1) 1.2 Unless otherwise specified, all conditions in this exhibit shall be complied with prior to issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Sign Code Exception approval shall become null and void unless sign permits and all construction is completed within twelve (12) months of the date of this exhibit. 1) 1.4 Approval of Sign Code Exception 93-005 is contingent upon the applicant signing and returning an "Agreement to Conditions Imposed" form as established by the Director of Community Development. (1) 1.5 The developer shall hold and defend the City of Tustin harmless for all claims and liabilities out of City's approval of the entitlement process for this project. (4) 1.6 Ail signs not covered by this action shall conform to the City of Tustin Sign Code including window signs which shall not exceed 25% of glass area upon which the sign is located. (4) ~.8 Corner landscaping shall be planted upon installation of the monument sign and maintained in a healthy condition. (4) ~.9 Internal illumination of the Level II spanners shall be permitted provided no complaints are received. In the event the City receives complaints, the Community Development Department, at their discretion, shall require the applicant to either reduce the wattage of said spanners or require the use of opaque non- illuminated spanners only, as needed to adequately eliminate complaints and light impacts on adjacent properties. If the applicant fails to comply within 30 days of a request by the Community Development Department, the applicant shall reimburse the City for all costs incurred for city staff time related to enforcement activities, including the City Attorney fees needed to gain compliance. (4) 1.~0 The existing double faced illuminated Chevron logo pole sign, the two (2) double faced illuminated Chevron pricing signs, the two (2) pole mounted metal pricing signs, the four (4) canopy signs and the two (2) light box decals shall be removed prior to final inspection of the spanners, new canopy signs and monument sign by the Community Development Department. PLAN SUBMITTAL (3) 2.~ At Building Plan Check/Sign Design Review, please submit three (3) sets of construction plans and two (2) sets of structural calculations. Provide continuous foundation under masonry wall of the monument sign and provide structural calculations for the foundation/footing design. (4) 2.~ Submit at Plan Check/Sign Design Review complete detailed landscaping and irrigation plans for the corner landscaping area consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide a plant table which lists botanical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. The irrigation plan shall show location and control of backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for all equipment must be provided. FEES (1) 3.1 Prior to issuance of any building permits, payment (3) shall be made of all applicable sign design review, environmental notice of exemption and building plan check and permit fees to the Community Development Department.
