A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CALIFORNIA, APPROVING SIGN CODE
EXCEPTION 93-004, A REQUEST TO ALLOW THE LOCATION
OF SECONDARY BUSINESS IDENTIFICATION WALL OR CANOPY
SIGNS ON LEVEL II SPANNERS LOCATED AT 14501 RED
HILL AVENUE, TUSTIN
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, Sign Code Exception 93-
004, has been filed by Robert Fiscus and Associates
on behalf of Chevron U.S.A., Inc. requesting a Sign
Code Exception from the City of Tustin Sign Code to
allow the location of secondary business
identification wall or canopy signs on Level II
Spanners.
Pursuant to City of Tustin Sign Code Section 9204C,
the request to locate secondary business
identification wall or canopy signs on Level II
Spanners can be supported by the following
findings:

Siqn size and placement restrictions of the
$iqn Code shall be followed as closely as
practicable; in that the total sign area of
the proposed signs totals 35.8 square feet and
is significantly less than that allowed by the
Sign Code. The proposal includes one (1) 32
square foot monument sign and two (2) 1.9
square foot spanner decals. Given that wall
and canopy signs cannot be accommodated by the
architecture of the service station, the
proposed spanners provide a spacious and
visible location for the proposed decals which
total approximately 1/30 the size of the 125
square feet of primary and secondary business
identification wall or canopy signs allo~ed
for the service station.

The intent and purpose of the siqn regulations
of the land use zone in which the siqn is
located shall be followed as closely as
practicable; in that the proposed sign
changes would maintain the City's appearance
by avoiding sign clutter, effectively
identifying the service station, and
maintaining the visibility and effectiveness
of on-premises signs, while limiting the
number and area of signs.

There are special circumstances unique to the
property to justify the Exception; in that the
service station cannot accommodate any wall or
canopy signs, and the nonconforming pole signs
would be removed upon installation of the
decals and monument sign.

Grantinq of the Exception will not have a
neqative impact on surroundin~ properties; in
that the exception would allow the
installation of spanner decals which are
smaller than the existing light box decals. A
condition of approval has been included which
prohibits the illumination of the new Level II
Spanners, thereby reducing the possibility for
negative impacts on surrounding properties.

The sign application promotes the public
health, safety, welfare and aesthetics of the
community and that the grantinq of the
exception meets the findinqs and intent of
this chapter (Sign Code); in that the proposed
sign changes would effectively reduce the
total square footage of sign copy at the
service station.

This project is Categorically Exempt from the
requirements of the California Environmental
Quality Act, pursuant to Section 15311 (Class 11).
II. The Planning Commission hereby approves the request to
locate the secondary business identification wall or
canopy signs on Level II Spanners at the service station
located at 14501 Red Hill Avenue, Tustin, subject to
conditions contained in Exhibit A, attached hereto.
PASSED AND ADOPTED at a regular Planning Commission meeting on
the 14th day of February, 1994.

CONDITIONS OF APPROVAL
SIGN CODE EXCEPTION 93-004
GENERAL
(1) 1.1 The proposed project shall substantially conform to
submitted plans date stamped February 14, 1994, on file
with the Community Development Department as herein
modified or as modified by the Director of Community
Development.
In accordance with this Exhibit, the Director of
Community Development may also approve subsequent minor
modifications to plans during plan check if such
modifications are determined consistent with the approved
plans.
(1) 1.2 Unless otherwise specified, all conditions in this
exhibit shall be complied with prior to issuance of any
building permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Sign Code Exception approval shall become null and void
unless sign permits and all construction is completed
within twelve (12) months of the date of this exhibit.
(1) 1.4 Approval of Sign Code Exception 93-004 is contingent upon
the applicant signing and returning an "Agreement to
Conditions Imposed" form as established by the Director
of Community Development.
(1) 1.5 The developer shall hold and defend the City of Tustin
harmless for all claims and liabilities out of City's
approval of the entitlement process for this project.
(4) 1.6 Ail signs not covered by this action shall conform to the
City of Tustin Sign Code including window signs which
shall not exceed 25% of glass area upon which the sign is
located.

(4) 1.7 Ail portable signs and banners in violation of the Tustin
Sign Code shall be removed.
(4) 1.S The reference to "food mart" on the monument sign shall
not be included on the plans submitted for plan
check/design review. The operation of a food mart at the
subject location shall be prohibited unless a conditional
use permit for a convenience market is approved by the
Planning Commission.
(4) 1.9 Ail damaged corner landscaping shall be replaced upon
installation of the monument sign and maintained in a
healthy condition.
(4) 1.~0 Internal illumination of the Level II spanners shall be
permitted provided no complaints are received. In the
event the City receives complaints, the Community
Development Department, at their discretion, shall
require the applicant to either reduce the wattage of
said spanners or require the use of opaque non-
illuminated spanners only, as needed to adequately
eliminate complaints and light impacts on adjacent
properties. If the applicant fails to comply within 30
days of a request by the Community Development
Department, the applicant shall reimburse the City for
all costs incurred for city staff time related to
enforcement activities, including the City Attorney fees
needed to gain compliance.
(4) ~.~ The existing double faced illuminated Chevron logo pole
sign, the double faced illuminated Chevron pricing sign,
the two (2) pole mounted metal pricing signs and the four
(4) light box decals shall be removed prior to final
inspection of the spanners and monument sign by the
Community Development Department.
PLAN SUBMITTAL
(3) Z.~ At Building Plan Check/Sign Design Review, please submit
three (3) sets of construction plans and two (2) sets of
structural calculations. Provide continuous foundation
under masonry wall of the monument sign and provide
structural calculations for the foundation/footing
design.

FEES
(1) 3.1 Prior to issuance of any building permits, payment
(3) shall be made of all applicable sign design review,
environmental notice of exemption and building plan check
and permit fees to the Community Development Department.
