HomeMy WebLinkAboutPC RES 32271 RESOLUTION NO. 3227 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CONDITIONALLY APPROVING DESIGN REVIEW 93-035 TO ALLOW CONSTRUCTION OF A 29,000-SQUARE FOOT AUTO SALES AND SERVICE FACILITY LOCATED AT 50 AUTO CENTER DRIVE. The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That proper applications for Design Review 93-035 was filed on behalf of James Parkinson requesting approval of a 29,000-square foot auto sales and service facility at 50 Auto Center Drive. S · That the project is exempt from the provisions of Measure "M" in that the estimated project generated traffic does not cause the roadway system to exceed established levels of service standards. Ce This project is covered by a previous EIR (85-2) for the East Tustin Specific Plan. No additional documentation is required. Do Pursuant to Section 9272 of the Tustin Municipal Code, the Commission finds that the location, size, architectural features and general appearance of Design Review 93-035 will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Commission has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning. 3. Exterior materials and colors. 4. Type and pitch of roofs. · Size and spacing of windows, doors and other openings. · Towers, chimneys, roof structures, flagpoles, radio and television antennae. · Landscaping, parking area design and traffic circulation. 8. Location and method of refuse storage. 11. Physical relationship of proposed structures to existing structures in the neighborhood. 12. Appearance and design relationship of proposed structures to existing structures and possible future structures in the neighborhood and public thoroughfares. 13. Proposed signage. 14. Development Guidelines and criteria as adopted by the City Council. II. The Planning Commission hereby approves Design Review 93-035 allowing construction of a 29,000-square foot auto sales and service facility at 50 Auto Center Drive, subject to the conditions contained in Exhibit A, attached hereto. Recording Secretary EXHIBIT A DESIGN REVIEW 93-035 CONDITIONS OF APPROVAL RESOLUTION NO. 3227 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped January 24, 1994, on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. The Director may also approve minor modifications to the plans if such modifications are determined to be consistent with the approved plans. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Design Review approval shall become null and void unless all building permits are issued within eighteen (18) months of the date of this Exhibit and substantial construction is underway. (1) 1.4 The applicant and property owner shall sign and return an "Agreement to Conditions Imposed" form prior to issuance of building permits. (1) 1.5 The applicant shall hold and defend the City of Tustin harmless from all claims and liabilities arising out of the City's approval of the entitlement process for this project. (2) 1.6 Prior to issuance of any building or grading permits the project site shall be annexed into the Tustin Auto Center Association and the Tustin Auto Center CC&R's shall be amended and recorded to include this site and the necessary deed restrictions shall be recorded against this property. Said document shall be subject to review and approval by the Community Development Department and City Attorney prior to recordation. (2) B. (3) (2) (3) (2) (3) Construction plans, structural calculations, and Title 24 energy calculations. Requirements of the Uniform Building Codes, State Handicap and Energy Requirements shall be complied with as approved by the Building Official. Preliminary technical detail and plans for all utility installations including cable TV, telephone, gas, water and electricity. Additionally, a note on plans shall be included stating that no field changes shall be made without corrections submitted to and approved by the Building Official. C· Final grading and specifications consistent with the site plan and landscaping plans, prepared by a registered civil engineer for approval of the Community Development Department and based on the Orange County Surveyor's bench mark datum. D · A precise soils engineering report provided by a soils engineer within the previous twelve (12) months as determined by the Building Official. SITE AND BUILDING CONDITIONS (4) 3.1 Provide plans and details for all lighting fixtures· Note the location on site plan and building elevations. One (1) footcandle of light throughout the parking lot. Fixtures on the building shall be of a decorative design. (4) 3.2 Ail exposed metal flashing or trim shall be provided and painted to match the building. (1) 3.3 Note on final plans that a six-foot high chain linked fence shall be installed around the site prior to building construction stages. Gated entrances shall be permitted along the perimeter of the site for construction vehicles. Exhibit A Design Review 93-035 Conditions of Approval Resolution No. 3227 Page 3 (1) 3.4 Exterior elevations of the building shall indicate any (4) fixtures or equipment to be located on the roof of the building and equipment heights. The building parapet shall be an integral part of the building design and shall screen all roof mounted equipment. All roof mounted equipment and vents shall be a minimum of six inches below the top of the parapet. (4) 3.5 No exterior downspouts shall be permitted; all roof drainage shall utilize interior piping, but may have exterior outlets at base of building. (4) 3.6 Roof scuppers shall be installed with a special lip device to that overflow drainage will not stain the walls. (4) 3.7 Indicate the location of all exterior mechanical equipment. Gas and electric meters shall either be enclosed in the building or boxed behind a screen wall designed consistent with the main building. (4) 3.8 Note on plans that outdoor storage shall be prohibited. (4) 3.9 An adequate size trash enclosure with solid metal, self closing, self latching gates shall be provided. Details for gate attachments shall be provided. Said enclosure shall be screened by a decorative wall of a minimum height of six feet. The trash enclosure shall be consistent with other trash enclosures in the Auto Center. The location, design and type of screening shall be subject to the approval of the Community Development Dept. (4) 3.10 Any outdoor speaker boxes and equipment shall be located to be consistent with noise ordinances to the satisfaction of the Community Development Department staff so that no noise is directed toward adjoining businesses and properties. (4) 3.1~ Provide exact exterior door details, window types and treatments (i.e., framing color, glass tint). (4) 3.~2 Ail roof access shall be provided from the inside of the building. (4) 3.13 Ail locks and hardware meet requirements as set forth in Tustin Security Code. Exhibit A Design Review 93-035 Conditions of Approval Resolution No. 3227 Page 4 (4) 3.~4 In the event that the subject property, or the property located at 30 Auto Center Drive to the west, is sold to another party, the access way between the two properties shall be closed with a masonry wall consistent with the Auto Center Design Guidelines, subject to review and approval by the Community Development Department. (4) 3.15 The roll up door providing access to the south end of the parts department shall remain closed, unless parts are being delivered. LANDSCAPING, GROUNDS AND ~IARDSCAPE ELEMENTS (1) 4.~ Submit at plan check complete detailed landscaping and (7) irrigation plans for all landscaping areas consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements and consistent with the landscaping concept plan. Said plans shall be consistent with the existing landscape palette for the Auto Center Master Plan. Provide summary table applying indexing identification to plant materials in their actual location. The plant table shall list botanical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control of backflow prevention devices (screened from view from right-of-way and on-site by shrubs), pipe size, sprinkler type, spacing and coverage. Details for all equipment shall be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk widths, parkway areas, and wall locations. The Department of Community Development may request minor substitutions of plant materials or request additional sizing or quantity. Note on plans that adequacy of coverage of landscaping and irrigation materials is subject to field inspection at project completion by the Department of Community Development. (7) 4.2 Landscape concept plans should reflect the following (use notes on the plans as applicable for the concept plan only): a · Turf is unacceptable for grades over 25%. combination of planting materials must be used, ground cover on large area alone is not acceptable. Ce Shrubs shall be a minimum of 5-gallon size and shall be spaced a minimum of five feet on center when intended as screen planting. d. Ground cover shall be planted between 8 to 12 inches on center in a triangular pattern. e . f . Note that all plant materials shall be installed in a healthy and vigorous condition typical to the species. Landscaping shall be maintained in a neat and healthy condition, including but not limited to trimming, weeding, removal of litter, fertilizing, regular watering and replacement of dead or diseased plants. g~ An additional landscaped area shall be provided at the north end of the site to accommodate trees and vines. (5) 4.3 Ail landscaping should be kept below the window areas to maintain visibility. SIGNS (4) 5.1 Business identification wall signs, including logos, shall comply with the requirements of the Tustin Auto Center Sign Program, as approved by the Planning Commission. (4) 5.2 Ail incidental signs for this project including entry, exit, yield and handicap signs, shall be designed consistent with such signage used elsewhere in the Tustin Auto Center, subject to review and approval by the Community Development and Public Works Departments. (4) 5.3 No sign component shall flash, blink or be otherwise animated. Such animation is strictly prohibited. ENGINEERING DIVISION/PUBLIC WORKS (5) 6.1 The curb on Auto Center Drive will need to be painted red from the southerly end of the northerly drive to 25' southerly. Exhibit A Design Review 93-035 Conditions of Approval Resolution No. 3227 Page 6 (1) 6.2 Separate street improvement plan (24" x 36" sheet) is required showing all existing public improvements adjacent to this site along with all proposed construction within the public right-of-way, which shall include but not be limited to the following: a , Curb and gutter Sidewalk Drive aprons Domestic water service Fire service (if required) Sanitary sewer service This plan shall be prepared by a California Registered Civil Engineer. (1) 6.3 A grading plan delineating the following will be required: a · c · Existing street elevation at key locations. Final pad/finish floor elevations and key elevations for all site grading. All final pad elevations to be a minimum of 1.0 feet above the base flood elevation as defined by FEMA. All flood hazard areas of record must be shown. FIRE DEPARTMENT (5) 7.1 Prior to the issuance of any building permits for combustible construction, evidence that a water supply for fire protection is available shall be submitted to and approved by the Fire Chief. Fire hydrants shall be in place and operational to meet requirements and fire flow prior to commencing combustible materials. (5) 7.2 Prior to the issuance of any building permits, all underground piping for automatic fire extinguishing systems shall be approved. Plans for an automatic fire extinguishing system shall be approved by the Fire Chief prior to installation. Such systems shall be operational prior to the issuance of a certificate of use and occupancy. (5) 7.3 Prior to the issuance of any building permits, construction details for any controlled entry access shall be approved by the Fire Chief. These details shall include width, clear height and means of emergency vehicle over-ride. Installation of controlled entry access will have an impact on emergency vehicle response time. Exhibit A Design Review 93-035 Conditions of Approval Resolution No. 3227 Page 7 (5) 7.4 Prior to the issuance of any certificates of use and occupancy, all fire hydrants shall have a "Blue Reflective Pavement Marker" indicating its location on the street or drive per Orange County Fire Department Standard. On private property these markers are to be maintained in good condition by the property owner. (5) 7.5 Prior to the issuance of any building permits, a note shall be placed on the plans indicating proposed fire lanes which shall be approved by the Fire Chief. A plan shall be approved by the fire department indicating the curbs to be painted red and the type of signage to be utilized. (5) 7.6 Prior to the issuance of any building permits, the applicant shall provide a letter of intended use to the Fire Chief. Include the following: a · The type of repair work to be performed. Will welding be performed on the site? How will the parts be stored? High pile stock? (5) 7.7 Prior to the issuance of any building permits and review of any architectural plans, submit to the Fire Chief a Chemical Classification Form. (5) 7.8 Prior to the issuance of any building permits, contact the Orange County Fire Department Hazardous Materials Disclosure Office to obtain a Hazardous Materials Business Information and Chemical Inventory Packet. This shall be complete and submitted to the Fire Chief before the issuance of any building permits. (5) 7.9 Prior to the issuance of any building permits, the following notes shall be provided on the site plan- a · be c · Fire Department Final Inspection Required. Schedule inspection 2 days in advance. Phone 832-1011. Locations and classifications of extinguishers to be determined by fire inspector. Storage, dispensing or use of any flammable and combustible liquids, flammable and compressed gasses and other hazardous materials shall comply with Uniform Fire Code Regulations. Exhibit A Design Review 93-035 Conditions of Approval Resolution No. 3227 Page 8 d · e . Buildings(s) not approved for high piled combustible storage. Materials in closely packed piles shall not exceed 15 feet in height, 12 feet on pallets or in racks and 6 feet for tires, plastics and some flammable liquids if high stock piling, comply with UFC, Art. 81 and NFPA Std. 231, 231C and 231D. Plans of modifications to or new fire protection, detector or alarm system(s) shall be approved by the Fire Department prior to installation. NOISE (1) 8.1 All requirements of the City's Noise Ordinance (Chapter 6 of the Municipal Code) shall be met at all times. FEES (1) 9.1 Prior to issuance of any building permits, payment shall be made of all required fees, including, but not limited to' a · Sanitary sewer connection fees to the Irvine Ranch Water District. b. Payment of the major thoroughfare and bridge fees will be required at the time a building permit is issued. C · Ail applicable building, grading and private improvement plan check and permit fees to the Community Development Department. d · New Development fees to the Community Development Department. e · School facilities fee to the Tustin Unified School District, subject to any agreement reached and executed between the District and the Irvine Company or proof of a release from payment of any fee. f · Within forty-eight (48) hours of approval of the subject project, the applicant shall deliver to the Community Development Department, a cashier's check payable to the COUNTY CLERK in the amount of $25.00 (twenty-five dollars) pursuant to AB 3158, Chapter 1706, Statutes of 1990, to enable the City of Tustin to file the Notice of Determination required under Public Resources Code Section 21151 and 14 Exhibit A Design Review 93-035 Conditions of Approval Resolution No. 3227 Page 9 Cal. Code of Regulations 15094. If within such forty-eight (48) hour period that the applicant has not delivered to the Community Development Department the above-noted check, the approval for the project granted herein shall be considered automatically null and void. In addition, should the Department of Fish and Game reject the Certificate of Fee Exemption filed with the Notice of Determination and require payment of fees, the applicant shall deliver to the Community Development Department, within forty-eight (48) hours of notification, a cashier's check payable to the COUNTY CLERK in the amount of $850.00 (eight hundred and fifty dollars) pursuant to AB 3158, Chapter 1706, Statutes of 1990. If this fee is imposed, the subject project shall not be operative, vested or final unless and until the fee is paid.
