HomeMy WebLinkAboutPC RES 322510 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 3225 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 93-018 AUTHORIZING THE CONSTRUCTION OF A NEW MONUMENT SIGN OR THE RELOCATION OF THE EXISTING MONUMENT SIGN, AND MODIFICATIONS OF THE PARKING LOT AREAS OF THE RED HILL LUTHERAN CHURCH FACILITY, LOCATED AT 13200 RED HILL AVENUE The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as f~llows: a. That a proper application, Conditional Use Permit No. 93-018, has been filed on behalf of Red Hill Lutheran Church requesting authorization to install a new monument sign or to relocate the existing monument sign, and modifications to the existing parking lot areas of the Red Hill Lutheran Church, located at 13200 Red Hill Avenue. m · That a public hearing was duly called, noticed and held for said application on January 10, 1994 by the Planning Commission. C . That the establishment, maintenance, and operation of the use applied for will not, under the circumstances of this case, be detrimental, to the health, safety, morals, comfort, or general welfare Of the persons residing or working in the neighborhood of such proposed use, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin as evidenced by the following: . The proposed monument sign location would permit business identification for the church facility closer to the entrance driveway of the parking lot, limiting the likelihood of persons using the south driveway which is reserved for exiting vehicular traffic only. . The proposed trash enclosure would bring the site into closer conformance with the City's design requirements for trash enclosures, and would increase the safety of the outdoor trash storage. · The proposed modifications to the parking lot would increase safety for handicapped persons using the handicap accessible parking spaces. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 3225 Page 2 D · The proposed modifications to the parking would increase safety for children playing on the south parking lot that is used for a playground during the school week by providing a physical barrier between the playground and the north parking area. · The additional playground amenities such a~ the volleyball court would provide greate~ opportunities for children's activities. . The proposed landscaping would buff~ the single family residences to the north of the project, and would bring the project inno closer conformance with the City's Landscaping and Irrigation Requirements. This project has been determined to be Categorically Exempt (Class 11) pursuant to Section 15311 of the California Environmental Quality Acn. II. The Planning Commission hereby approves Conditional Use Permit No. 93-018 authorizing the installation of a new monument sign, and modifications to the existing parking lot areas of the Red Hill Lutheran Church, located at 13200 Red Hill Avenue, subject to the conditicns contained in Exhibit A attached hereto and incorporated herein by reference. KATHLEEN CLANCY Recording Secretary EXHIBIT A CONDITIONAL USE PERMIT 93-018 CONDITIONS OF APPROVAL RESOLUTION NO. 3225 GENERAL (1) 1.1 The proposed project shall substantially conform with the submitted plans for the project date stamped January 10, 1994, on file with the Community Development Department, as herein modified or as modified by the Director of.the Community Development Department in accordance with th~s Exhibit. The Director may make minor modifications to the plans during plan check provided such changes are consistent with all applicable code requirements. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Conditional Use Permit approval shall become null and void unless building permits are issued within twelve (12) months of the date of this Exhibit. (1) 1.4 The developer shall hold harmless and defend the City of Tustin from all claims and liabilities arising out of the City's approval of the entitlement process for this project. (1) 1.5 Approval of Conditional Use Permit 93-018 is contingent upon the applicant and property owner signing and returning an "Agreement to Conditions Imposed" form, as established by the Director of Community Development. (1) 1.6 A minimum of 209 parking spaces shall be provided on site. The church sanctuary shall be limited to a total of 581 fixed seats based upon the parking rate of one space per three fixed seats. The number of children permitted in Sunday school classes while the sanctuary is being used for scheduled activities, shall be limited to the parking spaces available, based upon the parking rate of 1 space per 8 children, and one space for every teacher/employee. PLAN SUBMITTAL (1) 2.1 At building plan check submittal: (3) (7) A. A separate grading plan. This plan shall sh6w finish grades and slopes and drain sizes. Ail site drainage shall be handled on site and shall not be permitted to drain onto adjacent properties. Be Information, plans and/or specifications to ensure satisfaction of all Public Works Department requirements. Ce Information to ensure compliance with the requirements of the Orange County Fire Chief including required fireflow and installation, where required, of fire hydrants subject to approval of the Fire Department, City of Tustin Public Works Department and East Orange County Water District. (4) 2.2 Indicate the location of the required striping and the dimensions for the Handicap access aisle, the dimensions and clearances for the handicap parking spaces, ramps and sidewalks. These dimensions and clearances shall comply with the State Codes and the City of Tustin Standard No. 124c. (4) 2.3 Submit for plan check complete plans for the monument sign including the following: a · An elevation of the sign showing the dimensions of the sign, the dimensions of the sign's supporting members, the maximum and minimum height of the sign above existing or proposed grade level, sign copy, proposed lettering and background color. b· A dimensioned site plan showing the proposed location of the sign in relation to the boundaries of the lot upon which it is to be situated. C· A sign plan indicating the scope and structureal detail of the work to be done, including details of all electrical and mechanical connections, supports and footing and materials to be used. Exhibit A - Conditions of Approval Resolution 3225 Page 3 (4) 2.4 In the event that the existing monument sign is relocated to the proposed new monument sign location near the northerly driveway, the existing monument sign shall be reconstructed to meet the 1991 Uniform Building Code requirements, and all requirements of the Tustin Sign Code. Should the existing monument sign materials, including the base or sign can, be damaged or worn, such materials shall be replaced or repaired subject to the approval of the Community Development. (4) 2.5 Submit at plan check complete detailed landscaping a'~d irrigation plans for all landscaping areas consistent' with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide summary table applying indexing identification to plant material in their actual location. The plan and table must list botanical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. Show planting and berming details, soil preparation, staking, etc. The irrigation plan shall show location and control of backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for all equipment must be provided. Show all property lines on the landscaping and irrigation plan, public right-of-ways area, sidewalk widths, parkway areas, and wall locations. The Department of Community Development may request minor substitutions of plant materials during plan check. Note on landscaping plan that coverage of landscaping irrigation materials is subject to field inspection at project completion by the Department of Community Development. (4) 2.6 Landscaping materials shall be provided on the westerly elevation of the trash enclosure to adequatel~ screen the trash enclosure wall from the public right-of-way, subject to the Director of the Community Development Department:s approval. SITE AND BUILDING CONDITIONS (4) 3.1 A trash enclosure with six-foot high solid masonry walls and solid metal gates shall be provided ~n a location that allows access without blocking ingress to or egress from the site, as determined by the Director of Community Development. The applicant shall provide to the City evidence that the proposed trash enclosure has been reviewed and approved by Great Western Reclamation. Access to the trash enclosure shall be provided on a paved surface. (4) 3.2 A photometric study and details of all new exterior lighting fixtures shall be provided by the applicant for review and approval by the Director of Community Exhibit A - Conditions of Approval Resolution 3225 Page 4 Development. Ail fixtures shall comply with the City's Security Ordinance. Lighting at exterior doors, driveways and parking areas shall provide a minimum of one (1) footcandle of illumination, per the City of Tustin Security Code. No lights shall be permitted which may create any glare or have a negative impact on adjacent properties. All light, fixtures and mounting devices shall be of a decorative design. (4) 3.3 Ail street and parking improvements, sidewalks, curbs, gutter, storm drain, and pavement construction sha'!l comply with the City of Tustin construction standard~, Building Codes, City Ordinances and the State and Federal laws and regulations. PUBLIC WORKS DEPARTMENT (4) 4.1 Red Hill Avenue is classified as a major arterial highway and at some time in the future, an additional ten (10) feet of street right-of-way will be required for street widening along the entire frontage of this parcel. Please locate the relocated/new sign behind the ultimate future right-of-way line (60' from centerline of Red Hill Avenue). It is suggested that the sign be located a minimum of one (1) foot from the future right-of-way to ensure future maintenance accessibility. (4) 4.2 The relocation of the existing hydrant shall be per City of Tustin Standards and shall be at the property owners expense. (4) 4.3 A separate 24" x 36" street improvement plan, as prepared by a California Registered Civil Engineer, will be required for all construction within the public right-of- way. In conjunction with the above, a 24" x 36" traffic control plan, as prepared by a California Registered Traffic Engineer, will be required. (4) 4.4 Construction or replacement of any missing or damaged public improvement along the frontage o~ the subject parcel will be required, which shall include, but not be limited to the following: ae Curb and gutter; Sidewalk; Drive apron; and Street paving. Exhibit A - Conditions of Approval Resolution 3225 Page 5 FIRE DEPARTMENT (4) 5.1 After construction, Fire Department inspection will be required. At the time of inspection, the location of "red curbed" fire lanes will be determined. NOISE (1) 6.1 Ail construction operations including engine warm up shall be subject to the provisions of the City of Tustin Noise Ordinance and shall take place only during t~e hours of 7:00 a.m. until 6:00 p.m., Monday through Friday' unless the Building official determines that said activity will be in substantial conformance with the Noise Ordinance and the public health and safety will not be impaired subject to application being made at the time the permit for the work is awarded or during progress of the work. FEES (1) 7.1 Payment of all applicable Building plan check, grading plan check and permit fees shall be made to the Community Development Department prior to the issuance of any building permits, in accordance with the Tustin City Code.
