HomeMy WebLinkAboutPC RES 32241 RESOLUTION NO. 3224 5 10 11 12 13 14 15 16 19 20 21 22 23 24 25 26 27 28 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, RECOMMENDING TO THE TUSTIN CITY COUNCIL APPROVAL OF FINAL TRACT MAP 13733 The Planning Commission of the City of Tustin does hereby · resolve as follows: I. The Planning Commission finds and determines as follows: A® That Final Tract Map 13733 has been submitted by California Pacific Homes. Be That a public hearing was held by the Planning Commission on August 23, 1993. At this hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 13733 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 13733 on September 7, 1993. Ce That following tentative map approval, applicant filed Final Tract Map 13733. the De The Final Map is considered ministerially exenpt pursuant to Section 15268(b) of the California Environmental Quality Act. Ee That the proposed s~bdivision is in conformance with the Tus~in Area General Plan, adcpted East Tustin Specific Plan, the Development Agreement and Subdivision Map Act as it pertains to the development of residential units. Fe The 1.1592 acres of parkland required for this development was previously dedicated with recordation of Tract 12870. Ge That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract Map 13733 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. He That the site is physically suitable for the t}Te of development proposed. I · That the site is physically suitable for the proposed density of development. J. K® That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public-at-large, for access through or use of the property within the proposed subdivision. ne That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. Me That the Final Maps are in substantial conformance with the Vesting Tentative Tract Map, Amendment to the Vesting Tentative Map and Design Review 93-044. II. The Planning Commission hereby recommends to the City Council approval of Final Tract Map 13733, subject to final approval by the City Engineer. PASSED AND ADOPTED at a regular meeting of the Tustin Planning Commission, held on the 14th day of February, 1994.
