The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a Tentative Tract Map No. 14797 was submitted to the Planning commission on behalf of California Pacific Homes for the purpose of subdividing approximately 26 acres of land legally described as Lots 11, LL & KK of Tract 13627. In conjunction with review of Tentative Tract Map No. 14797, California Pacific Homes has submitted an application for Hillside Review pursuant to Section 8914.A of the Tustin City Code for those areas which are located within the Hillside District as identified in the East Tustin Specific Plan. Be That the Planning Commission discussed said application at a regular meeting held on December 13, 1993. Ce That in conjunction with said Hillside Review application, the applicant submitted the following information: · A composite site analysis map which identifies site features such as significant views, significant ridgelines, mature vegetation and significant topographic character. · A conceptual landscaping plan for the planting of temporary and permanent slopes. · A conceptual grading plan that included areas of proposed cut and fill, location of pads and slope analysis of hillside areas including pertinent cross setting profiles. · A preliminary geological investigation and soils report. D· That pursuant to Section 8914(c) (8) of the Tustin City Code, the Planning Commission has reviewed the subject application for Hillside Review using the guidelines for hillside grading contained in the Grading Manual to ensure the attainment of the following objectives: ] '2 3 4 7 9 10 11 13 14 17 18 ~0 ~4 ~7 Resolution No. 3215 Page 2 i · Compliance with the Grading Manual and Hillside Guidelines contained in the manual. , Visual, drainage and slope erosion impacts from any proposed parcelization resulting from slope conditions are within either the property owner's management and control or the Homeowners' Association, whichever is applicable. · Sites are planned in such a way so as to preserve or enhance important vistas and maintain the overall landform character of the land use area, particularly those seen from public places. · Preservation of the open space values of the central Peters Canyon ridge as identified in the East Tustin Specific Plan by excluding buildings and overhead utility lines from being developed on the top of the ridgeline and by careful siting of structures and landscaping adjacent to the ridgeline. · Where feasible, grading and siting reflects the natural topography of the land, ~rainage patterns and minimizes creation of excessively large leveled areas by grading. · Grading on hillside areas will soften hard edges left by cut and fill operations. Where an adverse visual impact may occur, rounded finished contours have been required. , Graded slopes (cut of fill), including roadsides, will undergo permanent revegetation in a timely manner to minimize change of erosion and siltation. 10. Provision for drainage and erosion control have been made to avoid any damage to existing landforms. 11. Provision and approval of an independent engineering study concerning the potential impacts of slope instability, liquefaction, landslide and seismic potential for proposed development within a Geologic Hazard Special Study Zone. ] 3 4 7 10 11 13 14 15 1G 17 18 19 24 9_7 Resolution No. 3215 Page 3 12. Roadway alignment and grading impacts in hillside areas are minimized and hillside roadways are designed consistent with guidelines contained in the Grading Manual. 13. Slope gradients will vary when adjacent to roadways to create open areas to be planted, thus softening the appearance of man-made slopes. 14. Preparation and recordation of a declaration of covenants, conditions and restrictions providing for the development and maintenance of slopes and drainage devices will be a condition of approval on Tract 14797. II. The Planning Commission hereby approves Hillside Review 93-001 for Tentative Tract Map 14797, subject to the conditions of approval attached hereto as Exhibit A. Recording Secretary EXHIBIT A HILLSIDE REVIEW 93-001 CONDITIONS OF APPROVAL RESOLUTION NO. 3215 GENERAL 1.1 Hillside grading shall substantially conform with the submitted plans on file with the Community Development Department, as herein modified, or as modified by the Director of Community Development Department in accordance with this Exhibit. Future hillside review by the Planning Commission will be required prior to or concurrently where additional grading of individual lots will occur unless hillside review 'is not required pursuant to Section 8914(b) (3) of the City Code. 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of a grading permit for rough or final grading of Tract 14797 subject to review and approval by the Community Development Department. 1.3 Hillside review approval shall become null and void unless a grading permit is issued within 24 months of the date of this resolution or upon expiration of Tentative Tract Map 14797, whichever occurs first. 1.4 Prior to the issuance of a rough grading permit for Tract 14797, the applicant shall execute a slope repair agreement subject to approval of the Community Development Department and City Attorney's office for those slopes identified on the slope warranty exhibit in conformance with the criteria established in Section 11.0 of the City's Grading Manual which requires that all man- made slopes equal to or greater than five feet in vertical height and having an average slope at or steeper than four horizontal feet to one vertical foot but not to exceed 2:1 be subject to an agreement. 1.5 Prior to the issuance of a rough grading permit for Tract 147~7, ti~ applicant shall execute any amendments required for those slopes currently covered under the slope repair agreement for Tract 13627 subject to approval of the Community Development Department and City Attorney's office subject to the provisions of Section 11.2 (D) of the City's Grading Manual, including but not limited to slopes along Pioneer Road. 1.6 Ail requirements of the Grading Ordinance and Grading Manual shall be met and any grading shall be consistent with provisions contained in the Grading Manual unless otherwise indicated on the approved grading and development plans. The grading shall include a variety Exhibit A Hillside Review 93-001 Conditions of Approval Resolution No. 3215 Page 2 of slope ratios and horizontal radii in order to blend the manufactured slopes into the natural terrain. Grading specifications shall comply with all requirements of Condition Nos. 4.1 through 4.3 contained in Exhibit A of Planning Commission Resolution No. 3216, which specify that manufactured slopes have a curvilinear shape and be landscaped to minimize impacts. In addition, prior to issuance of a grading permit, the subdivider shall execute a slope warranty program in compliance with the Grading Manual. Maintenance of common area slopes shall be the responsibility of the Homeowners' Association and slopes within private yards, the responsibility of the homeowner. 1.8 The precise grading plan shall include a detailed design of the proposed crib wall on Lot "BB" to more closely align with the surrounding terrain by curving the wall and varying the pitch to give a more natural appearance. The final design details of the crib wall shall be approved by the Director of Community Development. Landscaping and Irrigation plans shall comply with all requirements of Condition Nos. 4.1 through 4.9, included in Exhibit A of Planning Commission Resolution No. 3214, and Condition Nos. 4.1.C and 4.2 included in Exhibit A of Planning Commission Resolution No. 3216 in order to minimize erosion and siltation. In addition, slope landscaping will be designed so as to soften the appearance of manufactured slopes and provide an undulating character. 1.~0 Payment of all fees is required in accordance with Conditions 9.1 through 9.4, inclusive, of Exhibit A of Planning Commission Resolution No. 3216. ~.~ Prior to the issuance of any grading permits, the previously submitted vegetation map (prepared by a qualified biologist) shall be incorporated as part of the grading plan to clearly indicate the location of all coast sage scrub existing on the site. No coastal sage scrub shall be permitted to be removed as part of the grading operation. Under the current gnatcatcher listing, no coastal sage scrub may be removed unless specific approval for such removal is provided by the U. S. Fish and Wildlife Service (USFWS). If no coastal sage Exhibit A Hillside Review 93-001 Conditions of Approval Resolution No. 3215 Page 3 scrub is located within the limits of grading, then the grading permit may be issued. 1.12 The limits of grading shall be securely fenced off prior to issuance of a grading permit in order to ensure that coastal sage scrub is not impacted by the grading operation. 1.13 The landscape plan shall comply with guidelines established in the September, 1976 Fire Protection Planning Task Force Report adopted by the Orange County Board of Supervisors and entitled "Fire Hazard Background Report and Recommendations for the Reduction of Fire Hazard at the Natural Open Space/Urban Development Interface Orange County, California." ~.~4 The project shall include fire-resistant roofing materials, Class A minimum and be approved by the Fire Department. · .~5 Deed restrictions shall be recorded on all properties taking access from "B" Street (Units 19 through 54) to preclude modifications to the slope of roof or additions to the building that would extend above the 25 foot maximum height approved as part of DR 93-009. The restriction shall also prohibit modifications to roof color and stucco wall color without approval of the Director of the Community Development Department.
