RESOLUTION NO. 3213
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CONDITIONALLY APPROVING CONDITIONAL USE
PERMIT 93-010 AUTHORIZING THE DEVELOPMENT OF PATIO
HOMES PURSUANT TO SECTION 3.6.3.C OF THE EAST
TUSTIN SPECIFIC PLAN ON VESTING TENTATIVE TRACT MAP
14797.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application, of Conditional Use
Permit 93-010, has been filed on behalf of
California Pacific Homes to request authorization
to develop patio homes pursuant te Section 3.6.3.C
of the East Tustin Specific Plan on Vesting
Tentative Tract Map 14797.

That a public hearing was duly called, noticed and
held on said application on December 13, 1993, by
the Planning Commission.

That establishment, maintenance and operation of
the use applied for will not, under the
circumstances of this case, be detrimental to he
health, safety, morals, comfort, or general welfare
of the persons residing or working in the
neighborhood of such proposed use, nor detrimental
to the property and improvements in the
neighborhood of the subject property, nor to the
general welfare of the City of Tustin as evidenced
by the following:

The development of patio homes restricts the
density of the development to 15 dwelling
units per acre. Actual gross density of the
project would be 3.38 dwelling units to the
acre. Zoning for the site would permit a
maximum density of 10 dwelling units per acre
under East Tustin Specific Plan requirements.
The development of patio homes on this site
would provide a reduction in density of 66% of
the permitted maximum density.

The development of patio homes provides for a
minimum open space requirement of 400 square
feet per unit. The average open area per
family unit is 1,200 square feet.

The proposed development is configured in an
orderly fashion with a clear hierarchy of
streets including a private street, private
court (streets) and private court (drives),
the arrangement of which provides a protected
circulation system.
The proposed' patio home development would
conform to all of the requirements of the East
Tustin Specific Plan, applicable City Codes,
City Grading Manual, the Uniform Building Code
and all Fire and Safety Codes and as such,
would not be detrimental to the health,
safety, morals, comfort or general welfare of
the persons residing in the neighborhood nor
to the general welfare of the City.
II. The Planning Commission hereby approves Conditional Use
Permit No. 93-010 authorizing the development of patio
homes pursuant to Section 3.6.3.C. of the East Tustin
Specific Plan on Tract 14797, subject to the conditions
contained in Exhibit A of Planning Commission Resolution
Nos. 3214, 3215 and 3216.
PASSED AND ADOPTED by the Planning Commission of the City of
Tustin, at a regular meeting on the 13th day of December,
1993.
