HomeMy WebLinkAboutPC RES 3184 1 2 3 4 5 1 8 9 10 11 12 13 14 15 17 18 19 90 24 28 RESOLUTION NO. 3184 A RESOLUTION OF THE PLANNING COMMiSSiON OF THE CITY OF TUSTIN, APPROVING VARIANCE 93-005, TO INCREASE THE PERMITTED AMOUNT OF DETACHED RESIDENTIAL PATIO DWELLING UNITS SERVED BY A PRIVA/E COURT FROM TWELVE (12) DWELLING UNITS TO THIRTEEN (13) DWELLING UNITS LOCATED ON "Z" COURT (STREET) OF VESTING TENTATIVE TRACT MAP 13733, TUSTIN, CALIFORNIA. The Planning Commission of the City of Tustin does hereby resolve as follows: I · The Planning Commission finds and determines as follows: ae That a proper application, VarianCe 93-005, has been filed on behalf of California Pacific Homes requesting a Variance from the East Tustin Specific Plan, Section 3.5H3a to increase the permitted amount of detached residential units served by a private court from twelve (12) dwelling units to thirteen (13) dwelling units located on "Z" Court (Street) of Vesting Tentative Tract Map 13733. Be That a public hearing was duly called, noticed and held on said application on August 23, 1993, by the Planning Commission. Ce That the granting of a Variance from the East Tustin Specific Plan, Section 3.5H3a to increase the permitted amount of detached residential ~nits served by a private court from twelve (12) dwelling units to thirteen (13) dwelling units located on "Z" Court (Street) can be supported by the following findings: le That any variance qranted shall be subject to such conditions as will assure that the adjustment thereby authorized shall not constitute a qrant of special privileqe inconsistent with the limitation upon other properties in the vicinity and district in which the subject property is situated in that: ae A twenty (20) foot wide emergency access easement shall be required which provides the necessary Fire Department and emergency access to proposed units; and 1 4 .5 8 9 10 11 12 13 14 17 18, 19 20 21 22 23 24 25 2(~ 27 28 Resolution No. 3154 Page 2 be The required parking has been provided within the within a 200 foot .radius of the unit which it is intended to serve. Four (4) driveways, 19 feet or greater in length, will be provided within the subject 13 dwelling units private court which would permit additional driveway parking for the individual residents. · That because of special circumstances applicable to the property, including size, shape, topography, location or surroundings, the strict application of the ~oninq Ordinance is found to deprive subject property of privileges enjoyed by other properties in the vicinity and under identical zone. classification in that: a · The configuration of "Z" Court (Street) site is unusual in that the southeasl corner results in an acute angle requiring a modified dwelling unit site plan layout in order to utilize the site efficiently. The subject dwelling units and private court are in compliance with the remainder of the applicable patio home development standards for private courts. II. The Planning Commission hereby approves Variance 93-005 granting the increase the permitted amount of detached residential units served by a private court from twelve (12) dwelling units to thirteen (13) dwelling units located on "Z" Court (Street) of Vesting Tentative Tract Map 13733, subject to the conditions contained in Exhibit A of Planning Commission Resolution No's. 3183 and 3185. PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular meeting on the 23rd day of August, 1993.
