A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF TUSTIN, CONDITIONALLY APPROVING CONDITIONAL USE
PERMIT 93-023 AUTHORIZING THE ESTABLISHMENT OF A
PAWN BROKER BUSINESS IN AN EXISTING TENANT SPACE ON
THE PROPERTY LOCATED AT 13011 NEWPORT AVENUE, SUITE
101.
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application for Conditional Use
Permit 93-023 was filed by Mr. David Long
requesting authorization to establish a pawn broker
business within an existing tenant space on the
property located at 13011 Newport Avenue, Suite
101.
That a public hearing was duly noticed, called and
held on said application by the Planning Commission
on August 23, 1993.
The proposed use is subject to approval of a
conditional use permit pursuant to City Code
Section 9233c(q).
That the establishment, maintenance or 6peration of
the use applied for will not, under the
circumstances of this particular case, be
detrimental to the health, safety, morals, comfort
and general welfare of the persons residing or
working in the neighborhood of such proposed use,
nor will it be injurious or detrimental to property
and improvements in the neighborhood or the general
welfare of the City as evidenced by the following:

The proposed pawn broker business will be
accessory to the existing use and will contain
only items of a similar nature to the existing
coin and collectibles business. Conditions of
approval are included in Exhibit A, attached
here, to assure that the business will be
compatible with surrounding uses.

The subject location is within an established
shopping center which maintains a variety of
business types and the addition of a pawn
broker business can be accommodated with onl~
minor tenant improvements and would therefore
be appropriate. I

Access to the shopping center has been
established and the introduction of this use
will not result in a nee~ to provide
additional improvements off-site; therefore
detriment to surrounding properties is not
anticipated.
·
Parking for the shopping center has been
approved to permit a variety of uses including
· bank, restaurant and retail stores. This use,
which is classified as retail, would not
result in negative impacts to neighboring
tenants as the current parking provided is
adequate.

This project has been determined to be
Categorically Exempt (Class 1) pursuant to Section
15301 of the California Environmental Quality Act.
II. The Planning Commission hereby approves Conditional Use
Permit 93-023 authorizing the establishnent of a pawn
broker business in an existing tenant space on the
property located at 13011 Newport Avenue, Suite 101,
subject to conditions contained in Exhibit A attached
hereto.
PASSED AND ADOPTED at a regular meeting of the Tus{in Planning
Commission, held on the 23rd day of August 1993.

CONDITIONS OF APPROVAL
CONDITIONAL USE PERMIT 93-023
GENERAL
(1) 1.1 The proposed project shall substantially conform to the
submitted plans date stamped August 23, 1993, on file
with the Community Development Department as herein
modified or as modified by the Director of Community
Development.
(1) 1.2 Conditional Use Permit 93-023 approval shall become null
and void if the pawn broker business is not established
within twelve months.
(1) 1.3 Approval of Conditional Use Permit 93-023 is contingent
upon the applicant signing and returning an "Agreement to
Conditions Imposed" form, as established by the Director
of Community Development.
*** 1.4 Conditional Use Permit 93-023 shall not become effective
until all of the requirements of Tustin City Code Section
3613 are satisfied. Failure to obtain the required
approvals shall render this Use Permit authorization null
and void. In addition, this use permit shall become null
and void if the business license is not kept current.
This Use Permit only authorizes the following business
activities:
a.
The pawn broker business shall be accessory to
the existing coins and collectibles business
in that no more than 49% of the retail space
shall be occupied by "pawn" items; and
be
The pawn broker business shall be limited to
the following types of "high-end" merchandise:
jewelry, watches, estate items, collectibles
and a small amount of electronic equipment.
1.5 The applicant shall hold harmless and defend the City of
Tustin for all claims and 1-iabilities arising out of the
City's approval of the entitlement process for this
project.

(1) Z.1 A record of all transactions shall be kept on the
premises at all times and shall be made available for
inspection by the Tustin Police Department upon request.
The contents of said record shall comply with Tustin City
Code Section 3612(a).
(1) Z.2 The reporting of daily transactions shall be made to the
Tustin Police Department on the following day of such
transactions. The contents of this report shall comply
with Tustin City Code Section 3612(b).
(1) 2.3 A holding period of ten days from the date that the
receiving transaction for any article that was reported
to the Tustin Police Department shall be required prior
to said article being sold in accordance with Tustin City
Code Section 3614.
(1) 2.4 The holding period of any article may be extended upon
written notification by the Tustin Police Department in
accordance with Tustin City Code Section 3614.
(1) 2.5 Ail articles received in pawn shall be made available for
inspection upon request by the Tustin Police Department.
(1) Z.6 The hours of operation for the pawn broker business shall
be limited to between 7:00 a.m. and 9:00 p.m. of any day
in accordance with the Tustin City Code Section 3615.
SITE MODIFICATIONS
(1) 3.1 Exterior business identification signs shall be submitted
for review and approval by the Community Development
Department and sign permits issued, if applicable.
(1) 3.2 Any tenant improvements requiring a building permit shall
be submitted for plan check for approval by the Community
Development Department and the Orange County Fire
Department and applicable building plan check and permit
fees paid.
(1) 3.3 Any special locking devices proposed for installation
. shall be reviewed and approved by the Orange County Fire
Department prior to installation.
