HomeMy WebLinkAboutPC RES 3163 2 3 4 5 6 7 8 10 11 15 1G '1.7 18 ~-0 ~-1 ~7 RESOLUTION NO. 3163 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CONDITIflNALLY APPROVING CONDITIONAL USE PERMIT 93-012 AUTHORIZING.THE DEVELOPMENT OF PATIO HOMES PURSUANT TO SECTION 3.6.3.C OF THE EAST TUSTIN SPECIFIC PLAN ON TRACT 14784 The Planning Commission of the City of Tustin does hereby resolve as follows: I. The Planning Commission finds and determines as follows: ae That a proper application, of Conditional Use Permit 93-012, has been filed on behalf of California Pacific Homes to request authorization to Develop patio homes pursuant to Section 3.6.3.C of the East Tustin Specific Plan on Tract 14784. Be That a public hearing was duly called, noticed and held on said application on July 26, 1993, by the Planning Commission. Ce That. establishment, maintenance and operation of the use applied for .-will not, under the circumstances of this case, be detrimental to he health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood of such proposed use, nor detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin ~s evidenced by the following: · The development of patio homes restricts the density of the development to 15 dwelling units per acre. Actual density of t~e project would be 8.46 dwelling units to the acre. Zoning for the site would permit a maximum density of 25 dwelling units per acre under attached single family, condominium, or apartment development standards. The development of patio homes on this site would provide a reduction of density to 66% of the permitted maximum density. · The development of patio homes provides for a minimum open space requirement of 400 square feet per unit. The average open area per family unit is 2,556 square feet. 3 4 5 6 ? 8 10 1! 13 ~4 15 16 '17 18 9O 22 [ Resolution 3163 Page 2 · The proposed development is configured in an orderly fashion with a clear hierarchy of streets including a private street, private court (streets) and private court (drives), the arrangement of which provides a protected circulation system. · The proposed patio home development would conform to all of the requirements of the East Tustin Specific Plan, applicable City Codes, the Uniform Building Code and all Fire and Safety Codes and as such, would not be detrimental to the health, safety, morals, comfort or general welfare of the persons residing in the neighborhood nor to the general welfare of the City. II. The Planning Commission hereby approves Conditional Use Permit No. 93-012 authorizing the development of patio homes pursuant to Section 3.6.3.C. of the East Tustin Specific Plan on Tract 14784, subject to the conditions contained in Exhibit A of Planning Commission Resolution No's. 3162 and 3164. PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular meeting on the 26th day of July, 1993.
